The U.S. government’s accusation that Microsoft replaced American workers with foreign H-1B workers was not an established finding of fraud or worker displacement. On Oct. 8, 2026, Vice President JD Vance announced that Microsoft and other companies were being suspended from a green-card-related program and made the allegation. Microsoft disputed the implication that its filings brought new workers from abroad. Hours later, President Donald Trump presented Microsoft CEO Satya Nadella with the National Medal of Technology and Innovation.
What did the government accuse Microsoft of?
On Oct. 8, 2026, Vice President JD Vance announced the suspension of Microsoft and several other firms from a program used in the employment-based green-card process, according to the Associated Press. Vance accused Microsoft of replacing U.S. workers with foreign workers. He said, “You cannot lay off American workers and then replace them with foreign indentured servants.” The phrase was Vance’s political characterization, not a neutral legal term or a court’s finding.
Vance cited 6,000 U.S. layoffs, 6,300 H-1B visas and nearly 3,000 green cards. Those figures are attributable to his announcement as reported by AP; the available accounts do not show that they describe matched groups of workers, jobs or time periods. They therefore do not establish that each visa or green card represented a replacement hire.

What did Microsoft say about its H-1B applications?
Microsoft said it filed approximately 6,000 H-1B applications in the prior fiscal year, and that 80% were to extend or change the status of people already employed at the company. It said the remaining applications were for people already legally in the United States. The company’s statement, quoted by AP, said: “These were not to hire new people.”

These categories matter. An application is not the same as an approved visa, and an extension or status-change filing for an existing employee is not evidence by itself that a newly recruited worker arrived from abroad. Microsoft’s response disputes the inference that its filings show new foreign hires replacing laid-off Americans; it does not, on its own, reconcile every figure Vance cited.
Why did Trump give Nadella a medal that day?
Hours after Vance’s announcement, President Donald Trump presented Nadella with the National Medal of Technology and Innovation, AP reported. Trump praised Nadella’s role in Microsoft’s transformation and its software’s impact on businesses, students and consumers. He did not address the hiring allegation during the presentation, according to AP. The timing created a striking contrast, but the reporting does not establish that the award was a response to the announcement or that the presentation resolved the dispute.

What is known—and not known—about the suspension?
The announcement concerned a program used in the employment-based green-card process. The sources available do not include a formal suspension order or an agency notice specific to Microsoft. As a result, the legal authority, duration, exact scope and process for challenging the suspension are not established in those accounts. The announcement should not be treated as proof that a regulator or court found Microsoft committed fraud or displaced workers.

A Sept. 18, 2026, executive order set out the administration’s broader policy position on H-1B visas and called for interagency coordination. It directed agencies to consider whether an employer sponsor had laid off, or planned to lay off, similarly situated U.S. workers when processing H-1B applications and related matters. The order says, “I have determined that continued efforts must be made to protect and prioritize the American workforce.” This is policy context, not evidence that Microsoft committed the conduct described in the order.

The White House order also asserted that technology-sector layoffs from 2022 through 2026 totaled 800,000 to 1.3 million, and estimated a $9,000 to $20,000 wage gap in H-1B-reliant industries. Those are figures stated by the administration; the cited order passage does not provide underlying study details sufficient to treat either as an independently verified, universal measure. 2025 Senate inquiry
In a Sept. 24, 2025, letter, Senators Charles Grassley and Richard Durbin questioned Nadella about Microsoft’s H-1B hiring amid layoffs, including recruitment, displacement, pay, contractors and direct employment. The senators cited 5,189 approved H-1B beneficiaries for Microsoft in fiscal year 2025 and described the company as the third-largest employer of newly approved beneficiaries. That figure is part of their letter, not a finding in the 2026 announcement. A congressional inquiry raises questions; it does not establish misconduct. The letter is available from the Senate Judiciary Committee.

Separate 2021 DOJ settlement
In 2021, the Justice Department settled claims involving Microsoft’s requests for immigration documents from some non-U.S. citizens and lawful permanent residents during hiring and work-authorization reverification. DOJ described the matter as citizenship-status discrimination and improper documentary practices. It is legally and factually distinct from the 2026 allegation about replacing U.S. workers with H-1B workers. DOJ’s account, updated in 2025, is available here.
