The Trump administration’s criticism of Microsoft followed layoffs affecting Xbox and broader disputes over the company’s use of foreign-worker programs. But the available reporting does not establish that Xbox laid off employees to replace them with H-1B visa holders. Microsoft denied that explanation and said the visa figures cited in the debate applied to Microsoft as a whole, not specifically to Xbox.
What sparked the criticism?
Microsoft announced a major round of layoffs in July 2025 that affected Xbox and other parts of the company. In 2026, another wave of Xbox job cuts became entangled in claims about Microsoft’s foreign-worker hiring. Then, on October 8, 2026, the Associated Press reported that Vice President JD Vance announced Microsoft and several other companies were being suspended from a green-card labor-certification program.
Vance cited Microsoft’s layoffs alongside figures for H-1B visas and green cards, framing them as evidence of a problem with the company’s hiring practices. Those figures prompted questions about whether Microsoft was replacing U.S. workers with foreign workers. The figures, however, concern different employment and immigration processes; by themselves, they do not show that particular laid-off employees were replaced by visa holders.

That claim has not been established by the available reporting. Microsoft communications lead Frank Shaw said Xbox’s recent workforce changes were restructuring because the Xbox business was “not healthy,” and said, “They were not made to replace employees with foreign workers.” He also said the H-1B figures being discussed were Microsoft-wide, not Xbox-specific. These are Microsoft’s statements, not an independent audit of the roles affected by the cuts.

It is important to separate the fact that Xbox is part of Microsoft from the scope of the reported visa figures. A company-wide count cannot establish that Xbox hired H-1B workers into the same jobs, teams, or locations where Xbox employees were laid off.
Why do the reported layoff and visa figures differ?
The figures come from different speakers and sources, and they do not all describe the same measure or period. In particular, an application, an approval, a visa, a green card, and a layoff count are not interchangeable. The table keeps the claims attributed to their sources rather than combining them into a single total.

| Figure | What it describes | Source and qualification |
|---|---|---|
| 6,000 American workers laid off; 6,300 H-1B visas; almost 3,000 green cards | Figures Vance cited about Microsoft when announcing the reported suspension. | Associated Press, October 8, 2026; these are figures attributed to Vance. |
| About 6,000 H-1B applications; 80% for extensions or changes of status | Microsoft said most of its filings concerned existing employees, not new hires. It said the remaining new-hire filings were for people already legally in the United States who chose to join Microsoft, and represented 1% of its U.S. workforce. | Microsoft’s account, as reported by the Associated Press, October 8, 2026. |
| 16,000 layoffs “this year alone”; 5,189 foreign H-1B employees approved in FY2025 | Counts presented together in a statement about Microsoft. | U.S. Senate Committee on the Judiciary Democratic press release, 2026. The release’s layoff timeframe and the FY2025 approval period are not the same measure. |
| More than 5,000 H-1B workers approved; layoffs totaling more than 15,000 | An unnamed software company cited as an example in the White House proclamation. | White House proclamation, September 19, 2025. The proclamation does not name the company; contemporary coverage connected the example to Microsoft, but the proclamation itself does not identify it. |
Microsoft’s account describes the purpose of its filings differently from the administration’s criticism: it said most applications were for current workers extending or changing status, rather than new hires. Neither account, as presented in these sources, provides a role-by-role accounting that links particular visa filings to particular Xbox layoffs.
What immigration actions did the administration take?
The September 2025 entry restriction
A September 19, 2025 White House proclamation restricted entry into the United States for certain H-1B specialty-occupation workers who were outside the country unless the petition was accompanied or supplemented by a $100,000 payment, subject to exceptions. The proclamation specified a 12-month period beginning September 21, 2025, absent an extension. This was an entry restriction with stated exceptions, not a general description of every H-1B application or every worker already in the United States.

The September 2026 order addressing layoffs
On September 18, 2026, President Trump signed an executive order directing agencies to consider employer layoffs when processing H-1B labor condition applications, petitions, visas, and entry if layoffs in the previous year or planned future layoffs negatively affect similarly situated U.S. workers. The order also directed the Labor Department to begin reviewing previously submitted labor condition applications within 30 days. This measure is separate from the 2025 entry restriction and addresses how layoffs should be considered in specified H-1B processes.
The reported green-card program suspension
The Associated Press reported on October 8, 2026, that Vance announced Microsoft and other companies were being suspended from a program that allows foreign workers to apply for green cards, describing it as a green-card labor-certification program. That report establishes what was announced; it does not, by itself, establish the truth of the allegations behind the announcement. The precise official notice, legal authority, duration, and procedural path were not confirmed in the available reporting, so they should not be inferred.

An allegation, an announced government action, a final rule, and a proven finding are different things. The reported suspension and the administration’s statements should not be presented as proof that Microsoft—or Xbox—replaced laid-off U.S. employees with foreign workers.

In 2021, the Justice Department announced a settlement with Microsoft over immigration-related discrimination claims involving hiring and employment-authorization verification. The department said its investigation found repeated requests for immigration documents from some lawful permanent residents, refugees, and asylees when those documents were not required. That historical settlement is relevant background about a separate matter; it does not establish whether the later allegations about layoffs and foreign-worker hiring are true.

How to read the story accurately
- Keep the employer and business unit distinct: Xbox is part of Microsoft, but the figures cited in the immigration debate were Microsoft-wide, according to Microsoft’s communications lead.
- Keep the metrics distinct: layoffs, H-1B applications, approvals, visas, and green cards count different things.
- Attribute contested figures: Vance’s numbers, Microsoft’s explanation, and the Senate committee release are separate claims from separate sources.
- Do not infer a replacement link: the available reporting does not independently connect specific Xbox layoffs to specific foreign-worker hires.
