The $92 million TikTok privacy settlement was a fund in a U.S. class action over allegations that TikTok collected and used users’ personal data without sufficient notice or consent. It was not a $92 million payment to each user, and the historical claim deadline has passed. The settlement notice says the court had not found in favor of either side, and TikTok and the other defendants denied the claims.
What the $92 million TikTok settlement covered
The settlement resolved a private class action in the U.S. District Court for the Northern District of Illinois. Plaintiffs alleged that TikTok and related defendants collected and used personal information without adequate notice and consent. The defendants denied the allegations, and the settlement avoided a trial; it did not establish that the defendants were liable. The court-authorized settlement notice states: “The Court has not found in favor of either Plaintiffs or Defendants.”
The $92 million was the total settlement fund, intended to cover payments to valid claimants as well as notice and administration costs, attorneys’ fees and expenses, and service awards. It was not a guaranteed individual award.

- Nationwide class: U.S. residents who used the TikTok app before September 30, 2021.
- Illinois subclass: Illinois residents who used the app in Illinois to create videos before September 30, 2021.
Eligibility under the notice depended on meeting its class definition and submitting a timely, valid claim form. The notice’s filing instructions and deadlines are historical; they do not create a current opportunity to file a new claim.
How much was each TikTok settlement payment?
Payments depended on the fund, costs, and number of valid claims, so the fund total did not translate into one fixed payment per person. Under the allocation described by the court, each valid nationwide claimant received one share, while each valid Illinois subclass claimant received six shares.

These amounts were estimates cited in the 2022 approval opinion, based on the then-current estimate of valid claims. They should not be treated as confirmed final payments or as proof of what any particular claimant received. For historical case or payment records, consult the settlement administrator at the settlement website; the available materials do not verify an individual reader’s payment status.

In addition to the fund, the court described restrictions addressing how TikTok handled certain information and user content. These included provisions concerning biometric information, geolocation and GPS data, clipboard information, certain transfers or storage outside the United States, and uploading user content before a user saves or publishes it. The restrictions were subject to the settlement’s disclosure terms; they should not be read as an unlimited ban on all such practices.

Does the settlement cover later TikTok privacy claims?
Not automatically. A 2024 court order described the class period as use of the app before September 30, 2021, and the release as covering claims arising from conduct on or before October 13, 2022. In later cases concerning TikTok’s in-app browser, the court declined at that stage to dismiss the claims based on the earlier settlement. That ruling was about the cases before the court, not a blanket decision about every later privacy claim. See the 2024 order.
Is the TikTok settlement still accepting claims?
No new claim should be filed on the basis of the old notice. It required a timely, valid form and lists historical deadlines and instructions. The notice does not establish that claims remain open today. If you already filed, use the administrator’s records for questions about your submission or any historical payment; this article cannot confirm an individual claim’s status.

The $400 million figure concerns a separate federal government matter announced by the U.S. Department of Justice on August 21, 2026, and updated October 2, 2026. It is not an increase to, replacement for, or payment under the $92 million class action.

The Federal Trade Commission lists the separate ByteDance/TikTok COPPA case as filed August 2, 2024. The DOJ announcement describes the resolved government claims as allegations, not a finding of liability. Read the DOJ announcement and the FTC case listing for details.
