Thailand’s Securities and Exchange Commission (SEC) has issued rules allowing Bitcoin and Ether exchange-traded funds to be established under a defined regulatory framework. The rules take effect on 16 October 2026; as of the SEC’s 8 October announcement, no fund launch, issuer, or listing date had been announced.
What Thailand’s new crypto ETF rules establish
The SEC announced on 8 October 2026 that it had issued 11 notifications covering crypto ETFs and related fund-management and oversight arrangements. They apply the general ETF framework alongside requirements for mutual funds investing in digital assets. Asset managers seeking to establish a fund must demonstrate organizational readiness, including qualified people, operating systems, and arrangements with service providers. The notifications take effect on 16 October 2026.
The framework creates a route for products; it is not confirmation that a Thai Bitcoin or Ether ETF is already available. The announcement names neither an issuer nor a custodian, and gives no first-listing date.
Which cryptocurrencies can a fund track?
The initial eligible assets are Bitcoin and Ethereum (Ether). The SEC says eligibility will consider liquidity, broad acceptance, network security, and investor protection. The funds are intended as passive, single-asset strategies tracking the crypto asset in which each invests.

For each accounting year, a fund must maintain at least 80% average net exposure to one crypto asset, according to the Thai SEC’s 2026 rule announcement. That is a portfolio requirement, not a return target or guarantee that the fund will closely match the asset’s price at every moment.

Trading on the Stock Exchange of Thailand
Crypto ETFs are to be listed and traded exclusively on the Stock Exchange of Thailand (SET). The announcement establishes the intended trading venue but does not say that any fund has completed a listing.

Custody and fund supervision
Fund assets must be safeguarded by digital-asset custodians regulated by the SEC. Qualified digital-asset custodians and other digital-asset businesses may apply to serve as mutual-fund supervisors, subject to readiness criteria. The final announcement also says qualified foreign custodians may be permitted when the SEC considers that appropriate to the circumstances.

What investor protections are included?
The framework requires measures intended to help investors understand the product and its risks before trading:

- Investor education on crypto ETF characteristics and risks.
- A process for investors to acknowledge and confirm that they understand the risks before trading.
- Guidance from securities companies on appropriate allocation and risk tolerance.
- A prohibition on margin loans to buy crypto ETFs.
- Fund disclosures covering product characteristics, structure, investment mechanisms, service providers, and specific risks.
These requirements do not remove the volatility or other risks of exposure to crypto assets. Investors will need to assess the disclosures and the particular fund’s structure and providers once a product is filed.
Can Thai mutual and private funds invest in these ETFs?
Thai mutual funds and private funds may invest in Thai crypto ETFs subject to existing investment limits. The SEC says these funds had previously been permitted to invest only in foreign crypto ETFs. Its announcement does not state the numeric limits, so the applicable restriction must be checked in the relevant rules or fund documents.

How the policy moved from consultation to rules
- 10 April 2026: The SEC consulted on principles for spot crypto funds structured as mutual funds, with professional asset managers and specialized custody.
- 24 August 2026: It consulted on draft notifications and revised custody proposals, including an onshore-first approach and possible permission for qualified foreign custodians.
- 8 October 2026: The SEC announced that it had issued 11 notifications.
- 16 October 2026: The notifications’ stated effective date.
The August consultation also discussed proposed initial restrictions on alternative products linked to foreign crypto ETFs, including certain depositary receipts and brokerage-facilitated access for retail investors. The October announcement does not repeat those proposals, so they should not be treated as confirmed final requirements on the basis of the announcement alone.

The practical next step is a specific fund filing and, ultimately, a SET listing. Before evaluating a product, check its official filings for the underlying asset, tracking approach, fees, holdings, custody and other service providers, and risk disclosures. Verify claims about a launch or provider against an SEC filing or SET listing; the October announcement itself does not establish that any particular fund exists.
