Yes—but only initially. U.S. District Judge Robert Pitman preliminarily blocked Texas from enforcing the Texas App Store Accountability Act (SB 2420) on December 23, 2025. The Fifth Circuit stayed that injunction on June 4, 2026, and the Supreme Court declined emergency requests to block enforcement on July 6, 2026. Those later orders changed the law’s interim enforcement status, but none of the decisions identified here finally resolves whether SB 2420 is constitutional.
Did a judge block the Texas app store law?
Judge Robert Pitman issued a preliminary injunction on December 23, 2025. The order barred Texas Attorney General Ken Paxton and people acting on his behalf from implementing, enacting or enforcing SB 2420 while the lawsuit proceeded.
A preliminary injunction is temporary relief issued before a final trial judgment. It preserves the court’s view of the parties’ positions during the case; it is not a final ruling that permanently invalidates the law.

Can Texas enforce SB 2420 now?
The Fifth Circuit changed the immediate position on June 4, 2026, by granting Texas’s motion to stay Judge Pitman’s injunction pending appeal. With that stay in place, the district court’s enforcement block is paused while the appeal continues. The stay itself is not a final decision on constitutionality.

On July 6, 2026, the Supreme Court declined the challengers’ emergency requests to block enforcement. That action left the interim appellate posture in place; it did not hold that SB 2420 is valid, and it did not end the case.
Based on the decisions identified here, Texas may pursue enforcement while the appeal proceeds, subject to any later court order. The available decisions do not establish a subsequent final merits judgment upholding or striking down the law.

What does the Texas App Store Accountability Act require?
According to the Texas Attorney General’s June 1, 2026 summary, SB 2420 regulates app-store accounts and transactions involving minors. The State says the law requires app-store owners to:

Why did the courts issue different interim orders?
The district court concluded that the challengers were likely to show that SB 2420 violates the First Amendment and refused Texas’s request to stay its injunction. The Fifth Circuit later granted Texas’s stay motion after finding that Texas had made a strong showing that the district court committed reversible errors.
One important dispute concerns the level of First Amendment review. The Fifth Circuit said significant parts of the law likely warranted intermediate scrutiny rather than the strict scrutiny applied by the district court. The Fifth Circuit’s published per curiam order states: “The district court issued universal preliminary injunctions against SB2420 after applying strict scrutiny.”

That reasoning addresses the standards and errors relevant to temporary relief and the appeal. It does not itself decide the statute’s ultimate constitutionality.

What happens next?
The Fifth Circuit appeal remains the next major procedural stage identified by these orders. The parties may continue litigating the First Amendment questions, and a later appellate or district-court judgment could alter the law’s status. Until a final merits decision or another controlling order is issued, the preliminary injunction, appellate stay and Supreme Court emergency ruling should not be described as a definitive constitutional outcome.
