Is Stake legal in Oregon, and can you play Stake.us in OR? Oregon law treats many chance-based games involving something of value and a possible prize as gambling, including traditional casino games offered online. Oregon authorities have not specifically resolved Stake.us’s legal status, and its current Oregon access rules are not verified here. Check the platform’s current eligibility terms; do not assume that calling a product a sweepstakes makes it lawful.

How Oregon defines gambling

Oregon Revised Statutes section 167.117(7) defines gambling around three elements: a person stakes or risks something of value on a contest of chance or an uncontrolled future event, and there is an understanding that someone may receive something of value depending on the outcome. The Oregon Department of Justice summarizes the test as value risked, chance or an event outside the player’s control, and the possibility of receiving value as a result. Does Oregon law apply to casino-style games online?

Yes. In its 2025 opinion, the Oregon DOJ said traditional gambling games do not become exempt from the statutory definition merely because they are delivered through a website or application. Asked whether games such as poker, blackjack, and slot machines are exempt when offered online, the DOJ’s answer was “No.” The opinion discusses specified hypothetical products and the statutory elements; it does not mean that every online game or sweepstakes product is automatically illegal.

The opinion also treats Oregon State Lottery activity separately under its statutory exemption. It is not a ruling about Stake.us, nor does it determine the legality of every product using virtual tokens or a sweepstakes format.

Is Stake.us allowed in Oregon?

The official Oregon sources cited here do not name Stake.us or decide whether its current product meets Oregon’s legal definition of gambling. That analysis would depend on the product’s actual mechanics, including whether players risk something of value, whether chance determines outcomes, and whether prizes or redemptions provide something of value. Its current Oregon eligibility rules also have not been independently confirmed here.

So the platform-specific answer remains unresolved: neither the general DOJ opinion nor a “sweepstakes” label establishes that Stake.us is legal or available in Oregon. Availability alone would not settle the legal question.

Why Oregon’s social gaming license is not blanket permission

The Oregon Secretary of State’s Business Xpress directory describes a social gaming license for games between players in a private business, club, or place of public accommodation. It says the game is authorized only after obtaining that license. This narrow, local licensing description is not a general authorization for online casino-style services. An August 2023 Oregon Secretary of State audit discussed how gambling technology had evolved faster than state law and described a Racing Commission licensee offering online games with casino-like interfaces. What to check before trying to play

  1. Check Stake.us’s current eligibility terms. Look for an explicit statement about Oregon, and review the current rules for token purchases, gameplay, prizes, and redemptions.
  2. Do not treat access as proof of legality. A website loading in Oregon, or a sweepstakes label, does not answer how the product fits Oregon’s legal test.
  3. Do not bypass location restrictions. Follow the platform’s access controls and applicable state rules rather than using a location workaround.
  4. For a definitive answer, seek current Oregon legal advice. A platform-specific assessment needs both the product’s current mechanics and an analysis of how Oregon law applies to them.
