Sports betting is a wager on what happens in a real sporting event; daily fantasy sports (DFS) is an entry-based contest in which a fantasy lineup earns points from athletes’ performances. That difference shapes how you participate, how results are calculated, and which rules may apply. It is a format distinction—not a universal legal classification: state law and the exact bet or contest terms matter.
How sports betting and DFS work

In short, a bet turns on a selected real-event result; a DFS entry is scored against other lineups using a contest’s rules. DFS formats can compress season-long fantasy into daily or weekly contests. Some use salary caps, which limit the combined cost of the athletes selected; rules differ by contest. CRS’s 2016 overview describes those mechanics, but its older market and state-availability information should not be treated as current.
What the difference means for a participant
Your decision
With a wager, you select an event outcome or proposition. With DFS, you select a group of athletes and compete based on how their statistics translate into points. A DFS lineup’s success therefore depends on both athlete performance and the contest’s scoring and ranking rules; a wager is settled according to the terms of the selected bet.

A DFS contest may compare your lineup with many other entries, and its prize structure determines how results translate into payouts. For a wager, the bet’s terms determine the result and any payout. Entry fees, odds, payout structure, scoring rules, and contest size vary by product. The format distinction alone does not establish which has better odds or expected value; there is no single comparison that applies across different bets and contests.

Skill and outcomes
Fantasy contests use athlete statistics, but calling every DFS product a “skill game” is not a universal legal conclusion. A contest can involve lineup choices and statistical analysis while still being subject to statutory conditions and state-specific treatment.
Why legality depends on more than the label
Sports wagering: state authorization matters
In 2018, the U.S. Supreme Court invalidated the Professional and Amateur Sports Protection Act (PASPA). The IRS explains that each state may decide whether to allow sports wagering. That means the answer depends on the state and the rules for the particular product; the phrase “sports betting” does not by itself establish that an offer is authorized where you are.

DFS: the federal exception has conditions
The Unlawful Internet Gambling Enforcement Act (UIGEA) includes a fantasy-sports exception at 31 U.S.C. § 5362(1)(E)(ix). Among its conditions, prizes must be established in advance; outcomes must reflect relative knowledge and skill and be based predominantly on accumulated athlete statistics from multiple real-world sporting events; and an outcome cannot be based on a single real-world team or solely on one athlete’s single performance. These conditions do not mean every DFS contest qualifies for the exception or is legal in every state.
State rules can separately regulate or restrict fantasy contests. Illinois, for example, expressly treats fantasy contests as legally distinct from sports wagering and provides for regulation of fantasy contest operations under 230 ILCS 45/25-120. The Illinois statute cites Public Act 104-468, effective June 16, 2026; it is an example of Illinois law, not a nationwide rule.

How to check a specific offer
- Identify the state whose rules apply to where you are participating.
- Check that state regulator’s current guidance or law for sports wagering or fantasy contests.
- Read the operator’s terms for the exact bet or contest, including how it is scored, settled, and paid.
- Do not infer legality from the product name alone: state treatment can depend on the specific rules and structure.
For federal-law background, the Congressional Research Service report updated February 24, 2016 describes earlier DFS mechanics and legal debates. It is historical context, not a current guide to state availability.

The IRS’s sports-wagering page concerns federal excise taxes on businesses that accept wagers. It lists a 0.25% tax on the amount wagered and a $50 annual occupational tax for wagers authorized by a state, and a 2% tax and $500 annual occupational tax for wagers not authorized by a state. Those figures describe taxes for wager-accepting businesses, not personal tax rates or a complete explanation of an individual’s obligations.
