On February 28, 2005, Senator Patrick Leahy introduced the Anti-Phishing Act of 2005 as S. 472 in the U.S. Senate. It proposed criminal penalties for knowingly using spoofed email and sham websites to obtain personal information, while Leahy said parody and political speech would be protected. The measure was referred to the Senate Judiciary Committee; the available record here does not establish its final disposition or that it became law.
What was Senator Leahy’s anti-phishing bill?
S. 472 was a bill introduced in the 109th Congress under the title “Anti-Phishing Act of 2005.” The Congressional Record records its introduction by Senator Leahy on February 28, 2005, and referral to the Senate Judiciary Committee. BetaNews reported on the proposal on March 4, 2005, describing Leahy’s effort to address phishing scams.
This was a U.S. federal legislative proposal from 2005, not a current bill. The introduction and committee referral are established, but those facts alone do not show whether S. 472 advanced, passed, or became law.

What conduct did S. 472 target?
Leahy described phishing as deceptive messages that appear to come from a trusted institution and send recipients to a sham website to surrender account information. He also discussed “pharming,” which he described as redirecting someone to a fraudulent site even when the person enters a legitimate web address. These are descriptions in his 2005 statement, not a current technical definition.

Leahy said the proposal would criminalize knowingly sending spoofed email linked to sham websites with criminal intent, as well as the sham websites used in those schemes. His stated rationale was that such scams undermine trust in online transactions and that traditional wire-fraud or identity-theft cases may be pursued only after someone has already been defrauded.
What penalties were reported?
BetaNews reported that the draft contemplated up to five years’ imprisonment and fines of up to $250,000 for successfully prosecuted offenders. Those figures describe proposed penalties in the 2005 report; they are not evidence that the penalties were enacted or apply under current law. Leahy’s Congressional Record statement supports a proposed maximum prison term of five years but does not state the $250,000 fine figure.

How did the proposal address parody and political speech?
Leahy said the bill protected parody and political speech from being prosecuted as phishing. He stated: “The Anti-Phishing Act protects parodies and political speech from being prosecuted as Phishing.” BetaNews also described the proposal as limited to protect First Amendment rights. These were descriptions of the bill’s intended scope by its sponsor and a contemporaneous news report, not a legal ruling on constitutionality.
Was there also a House Anti-Phishing Act?
Yes. A House hearing document identifies a separate measure, H.R. 1099, also titled the “Anti-Phishing Act of 2005.” The document summarizes that House proposal as covering certain unauthorized websites or domain names and deceptive messages used to solicit identifying information, with fines, imprisonment of up to five years, or both.

H.R. 1099 and S. 472 were distinct bills in the same Congress. The fact that they shared a title does not establish their exact legislative relationship, and the House summary should not be treated as a precise description of the Senate bill.

The official Congressional Record passage confirms that Leahy introduced S. 472 and that it was referred to the Senate Judiciary Committee on February 28, 2005. The sources cited here do not establish the bill’s final disposition or whether a related proposal became law. It would therefore be inaccurate to describe S. 472 as enacted legislation or as having current legal effect on the basis of this record.
