Rhode Island’s general minimum wage is $16.00 per hour, effective January 1, 2026. Rules on pay, overtime, breaks, leave and young workers vary by worker category, employer size, occupation and situation. This guide summarizes Rhode Island Department of Labor and Training (DLT) guidance checked October 7, 2026; it is general information, not a decision about an individual claim.

What is the current minimum wage in Rhode Island?

The general minimum wage is $16.00 per hour effective January 1, 2026, according to the DLT’s 2026 employee notice. The notice also lists lower rates for limited categories: $14.40 for qualifying students, $12.00 for certain 14- and 15-year-olds, and a $3.89 cash wage for tipped workers. These are not general alternatives to the standard rate; eligibility and any applicable conditions must be checked against the DLT’s current guidance.

Tipped employees

The $3.89 figure is the tipped cash wage, not a guaranteed total wage. DLT guidance says cash wages plus tips must reach the applicable regular minimum wage; if they do not, the employer must pay the difference. Tip-credit requirements apply, so workers and employers should confirm the current rules rather than assume that receiving tips alone makes the lower cash wage permissible.

How often must an employer pay employees?

“Most Rhode Island employers are required to pay their employees every week,” according to the DLT Labor Standards FAQ. Exceptions exist, including circumstances in which a different pay schedule may be allowed. The DLT’s December 2024 guidebook discusses exceptions and payroll details, but employers should verify any specific approval or pay-frequency requirement against current DLT materials before relying on it.

What workers should check

  • Compare the pay period and payday with the schedule your employer has communicated.
  • Keep pay statements, schedules and your own record of hours worked.
  • If pay is late or missing, raise the issue with payroll or the employer and keep a record of the response. For unresolved wage issues, see the complaint section below.

What employers should maintain

DLT requires accurate daily and weekly time records. The agency’s guidebook also covers payroll records and wage statements, but its specific retention and pay-statement details should be checked against current statutes and regulations because the guidebook was revised in December 2024.

Should you be paid overtime for working more than 40 hours?

For eligible workers, Rhode Island’s general rule is at least 1.5 times the regular rate for hours worked over 40 in a workweek. The DLT’s January 2026 employee notice states: “Overtime Pay – At least 1½ times the regular rate of pay for all hours worked over 40 in any one workweek.” Some occupations and establishments are exempt, and federal as well as state rules may affect coverage.

Check the actual exemption, not just the job title or salary

Being paid a salary, by itself, does not establish that a worker is exempt from overtime. The worker’s duties, occupation and applicable legal tests matter. If classification is uncertain, compare the facts of the job with current DLT and federal guidance rather than relying only on a title or pay method.

Sunday and holiday work

Rhode Island has special rules for certain retail Sunday and holiday work, including how those premium-pay hours interact with overtime calculations. The premiums do not universally stack in every situation. Workers and employers should check the applicable occupation, hours and calculation under DLT guidance before estimating what is due.

Does an employer have to provide a meal break?

DLT’s FAQ describes a state meal-period requirement of 20 minutes for a six-hour shift or 30 minutes for an eight-hour shift. Exceptions include licensed health-care facilities and worksites with fewer than three employees on a shift. Because the exceptions and circumstances matter, these durations should not be read as a promise that every employee receives the same break in every setting.

If you believe a required meal period was not provided, note the shift length, the number of employees on the shift, the worksite type and what break you actually received. Those details can help clarify whether an exception may apply.

Does Rhode Island require paid sick leave?

Most employees are covered by Rhode Island’s Healthy and Safe Families and Workplaces Act, which provides for up to 40 hours of sick and safe leave annually. Employers with at least 18 employees must provide paid leave; employers with fewer than 18 employees must provide leave that may be unpaid.

Permitted uses

Covered reasons include an employee’s illness, injury or routine medical appointment; specified safety needs related to domestic violence, sexual assault or stalking; and similar health or safety needs of a child, spouse, domestic partner or household member.

Notice and documentation

DLT says advance notice applies when the need for leave is foreseeable at least 24 hours ahead. Documentation is limited in specified circumstances. Employees and employers should consult the current DLT leave guidance for the circumstances and limits that apply rather than treating the notice or documentation rules as unlimited.

Does an employer have to offer paid vacation?

Rhode Island does not generally require employers to offer paid vacation. If an employer provides vacation, DLT says accrued vacation is payable at separation after the employee has worked there for at least one year. Whether a particular amount is accrued or due can depend on the employer’s policy and the facts, so retain the policy and final pay records when reviewing a separation payment.

Can a person under 18 work in Rhode Island?

Yes, but the permitted work depends on age and other circumstances. School status, school vacations, federal coverage and specific exceptions can affect hours and curfews. DLT distinguishes rules for ages 14–15 from those for ages 16–17, so a single schedule should not be applied to all minors.

Hiring workers ages 14–15

Employers hiring 14- or 15-year-olds must complete the Intention to Employ a Minor form. The employer must retain the minor’s Special Limited Permit to Work. The DLT also lists a $12.00 minimum-wage rate for certain 14- and 15-year-olds working within the stated weekly limit; the rate is conditional, not a general wage for every worker under 16.

Hiring workers ages 16–17

Older minors remain subject to work-hour, curfew and rest restrictions. Employers should use the DLT’s current age-specific youth employment guidance and forms to verify the rules for the minor’s age, school circumstances and job rather than extending the under-16 permit process or schedule to every minor.

What should workers and employers do about a possible violation?

For workers

  1. Write down the dates, hours, pay received and the rule you believe may not have been followed. Keep schedules, pay statements, relevant leave communications and any records you already have.
  2. Check the current DLT Labor Standards guidance for the relevant topic, including wage rates, overtime, youth employment or sick and safe leave.
  3. For a wage issue, use the DLT Wage Complaints page, the official starting point for a state wage complaint. DLT Labor Standards investigates specified matters including minimum wage, pay, overtime, Sunday and holiday premiums, and vacation pay at termination.
  4. For a discrimination concern, use the separate channels identified by DLT: the Rhode Island Human Rights Commission or the state Division of Equity, Diversity & Inclusion.

For employers

  • Use the current DLT workplace notice and check that the rates and exceptions relevant to the workforce are understood.
  • Review payroll frequency, timekeeping, overtime classification, meal-period practices, leave administration and youth-employment paperwork against current state requirements.
  • Consult current DLT forms, notices and guidance for exceptions; the DLT laws index points to statutes covering wages, payment, leave, child labor, wage discrimination, whistleblowers and Sunday or holiday work.

Where do discrimination and worker-classification questions fit?

Discrimination complaints follow state channels separate from DLT wage complaints. DLT directs people who believe they experienced discrimination to the Rhode Island Human Rights Commission or the Division of Equity, Diversity & Inclusion. Worker classification and wage-discrimination questions can involve fact-specific legal tests; the December 2024 DLT guidebook discusses these subjects, but current law and the circumstances of the job should be checked before drawing a conclusion.
