U.S. federal law does not require restaurants to use a physical time clock. Employers must keep complete, accurate time and payroll records for covered, non-exempt employees, and may use a shared clock, POS punches, worker-entered hours, or another method. State and local rules can add requirements, so the right setup depends on both your jurisdiction and your existing systems.
What records does a restaurant have to keep?
For covered, non-exempt employees, the Fair Labor Standards Act (FLSA) requires employers to maintain records that support wage calculations. The U.S. Department of Labor (DOL) lists information such as each employee’s daily and weekly hours, pay basis and rate, earnings, deductions, and pay-period and payment details in its Fact Sheet #21: Recordkeeping Requirements under the Fair Labor Standards Act.
DOL says payroll records generally must be retained for at least three years. Records used to calculate wages, including time cards and work or time schedules, generally must be kept for two years. These are federal retention periods; state or local requirements may differ.

A system should also capture all identifiable time spent on assigned work or regularly required duties. DOL’s FLSA Hours Worked Advisor discusses how work time is treated; do not assume that brief or inconvenient work can simply be omitted.

What time-clock options can a restaurant use?
Dedicated physical clock
Employees use a shared device to record when they start and finish work. It can suit a restaurant that wants a distinct clock-in point, but the device itself does not guarantee accurate records or compliance. Check how punches reach payroll and how corrections are reviewed.
POS-based punches
Employees clock in through a point-of-sale workflow. This can connect timekeeping to the workstation staff already use, but compatibility depends on the specific POS and labor-management products. That documentation does not establish compatibility with other vendors’ systems.

Web-based or employee-entered time
Employees may enter their own start and finish times through software or another recordkeeping process. DOL Fact Sheet #21 says, “Employers may use any timekeeping method they choose,” including a time clock, a timekeeper, or employees writing their own times, as long as the records are complete and accurate.
How to choose a restaurant timekeeping setup
- Map your current workflow. Identify where employees clock in, how managers approve edits, and how hours reach payroll. Include the POS, scheduling, payroll, and HR systems you already use.
- Check the rules for each location. Federal guidance is only a baseline. The DOL’s Restaurant Employment Toolkit notes that state law may provide additional protections. Review applicable wage, break, scheduling, and record-retention rules before choosing software.
- Verify record quality and access controls. Confirm that the system can produce the records you need, preserve edits or other relevant history, and restrict access appropriately. Ask vendors to explain how the system authenticates users and protects data.
- Test reporting and handoffs. Check whether managers can review exceptions and produce required records, and whether approved time reaches payroll accurately. Do not treat a product’s integration claim as proof that it works with your particular POS or payroll setup.
- Compare total fit, not just the device. A shared clock may be appropriate if it fits your workflow and reliably feeds payroll; an integrated system may reduce duplicate entry if it is compatible and supports the records you need. Confirm setup requirements and responsibilities for corrections before buying.
When local scheduling rules affect software choice
Some jurisdictions require more than basic punch capture. New York City’s Department of Consumer and Worker Protection (DCWP), for example, recommends that software for fast-food employers covered by the city’s Fair Workweek Law support integration across scheduling, timekeeping, payroll, and HR; authentication and data integrity; recordkeeping reports; and automated compliance monitoring. That is a city-specific example, not a requirement for every restaurant. If your business operates in multiple locations, verify requirements for each jurisdiction rather than assuming one system configuration satisfies them all.

Questions to ask before you buy
- Does the system work with the exact POS and payroll products we use?
- Can it retain and export the time and wage records we must keep?
- How are missed punches, manager edits, and employee disputes recorded and reviewed?
- Does it support scheduling or reporting rules that apply in our locations?
- What happens if internet access or a workstation is unavailable, and how are records reconciled afterward?
- Who is responsible for checking that recorded hours match the work employees actually performed?
