A report published October 3, 2026, says Tompkins County prosecutors declined an offer to review additional interview statements collected by Cornell University Police during an investigation of an alleged sexual assault involving a Cornell student. The account, attributed to records reported by The New York Times, conflicts with an earlier explanation from District Attorney Matt Van Houten about what materials his office received. The underlying notes were not directly reviewed for this report, and the available accounts do not explain the discrepancy.
What the new report says
TMZ reported on October 3, 2026, that Cornell University Police Department investigator Jeffrey Northrop spoke with Jeff Huddle, a member of the Tompkins County District Attorney’s staff, about additional interviews and statements gathered in the investigation. According to TMZ, Northrop’s notes indicate the office declined an opportunity to review that material during the initial investigation. TMZ attributed its account to records obtained by The New York Times; the notes and the originating Times report were not directly reviewed here. TMZ’s report
The syndicated account says Northrop’s notes recorded prosecutors as saying, “criminal charges would not be pursued in this case”. That wording is reported secondhand through TMZ’s account of the records, rather than verified against the notes themselves. It should not be treated as a direct statement from prosecutors.
How that differs from Van Houten’s earlier account
The same reporting contrasts the newly described notes with Van Houten’s earlier explanation of what his office received. As recounted by TMZ, Van Houten said prosecutors had received Jane Doe’s sworn statement and a screenshot of alleged Chi Phi Snapchat messages, but not the full transcript of her two-day interview. The reporting places them in tension, but the sources available do not establish why the accounts differ or independently determine what the office received.
What is known about the special prosecutor
The syndicated report says Governor Kathy Hochul appointed New York Attorney General Letitia James to take over as special prosecutor. The BBC also reported James’s appointment on October 2, 2026. BBC report on the appointment The appointment does not, by itself, establish whether anyone was charged, whether a finding was made, or what decision the special prosecutor ultimately reached; the sources reviewed do not report an outcome.
