A Los Angeles Times letter published Oct. 3, 2026, urges local officials to audit school anti-bullying policies after a student died following a fall at Benjamin Franklin High School in Highland Park. The student’s family reportedly said he had been bullied; the letter does not establish that bullying caused his death, and no official conclusion about the cause is cited here.
What the letter asks officials to do
In her letter to the editor, Marlene Guerrero calls on the local school board and district superintendent to immediately audit anti-bullying policies, ensure mental-health counselors are adequate and accessible, and hold school leadership accountable. These are the writer’s recommendations, not verified findings about district performance.
Guerrero writes, “I urge the local school board and the district superintendent to immediately audit our schools’ anti-bullying policies.” She also argues, “We must stop viewing bullying as a normal rite of passage or a survival fight to see who is the strongest.”

The distinction between the family’s reported account and an established cause of death matters. The cited letter reports the family’s bullying claim, but does not prove a connection to the student’s death.

What a meaningful policy audit should check
California Department of Education resources offer a practical starting point. Its sample policy is adaptable local guidance, not a finding that any particular district has met or failed a standard. The sample action plan can help translate policy language into implementation steps.
- Scope and definitions: Does the policy explain what conduct it covers, including bullying and cyberbullying?
- Reporting: Can students, parents, and staff find a clear, usable route to report suspected bullying?
- Investigation and response: Does the policy call for prompt investigation and appropriate intervention, including action by staff who witness bullying when it is safe to intervene?
- Protection and privacy: Are confidentiality and protection from retaliation addressed?
- Communication and access: Can pupils and families readily find policy and complaint information, including online?
- Support and follow-through: Are counseling and other responses addressed for students who are targeted and those who persist in bullying?
- Review: Does the district periodically assess whether the policy and prevention efforts are working?
The California Department of Education’s broader prevention guidance also points to training for the school community, responses to observed incidents, surveys, and representative prevention committees as possible parts of a prevention program. An audit should examine not just whether a policy exists, but whether staff and families can use it and whether the district reviews implementation over time.

California guidance and the 2026 cyberbullying requirement
California’s school-safety framework calls for systematic safety planning and addresses bullying-prevention training. Relevant statutory text includes amendments effective Jan. 1, 2025. Separately, AB 772 took effect Jan. 1, 2026, adding Education Code section 234.41. The California Department of Education’s training-and-resources page says the law requires CDE, by June 30, 2026, to develop, post, and distribute a model policy to local educational agencies for certain reported off-campus cyberbullying. The described conduct is sufficiently severe or pervasive to have the actual and reasonably expected effect of creating an intimidating or hostile educational environment.
That CDE page describes the statutory requirement; it does not establish whether the model policy has since been posted and distributed. The state’s 2023–24 education-equity monitoring instrument also identifies policy access, complaint processes, and cyberbullying as review areas, but it is dated and should not be treated as a complete statement of current law. Districts and families should consult current official guidance for present requirements.
