Qualcomm and Huawei announced a multi-year patent agreement on October 5, 2026, but their public statements do not confirm that Qualcomm will pay Huawei net. The deal is a reciprocal cross-license covering 5G, compute, AI and networking, alongside Qualcomm’s planned purchase of certain Huawei U.S. patents. It remains subject to regulatory approvals.

What Qualcomm and Huawei agreed to

The companies described the arrangement as a broad, multi-year patent license agreement. Each grants the other rights to patents in the covered technology areas, so it is a cross-license—not simply Qualcomm paying for a one-way license to Huawei’s patents. The announcements were made jointly on October 5, 2026, from Shenzhen and San Diego. Huawei’s announcement and Qualcomm’s announcement identify the scope as 5G, compute, AI and networking.

Qualcomm will also buy selected Huawei patents

Separate from the cross-license, Qualcomm agreed to purchase certain Huawei U.S. patents in compute, AI, networking and other technologies. The companies did not identify the individual patents or disclose a purchase price. The public statements do not explain how this patent purchase relates financially to any licensing payments between the companies.

Is Qualcomm paying Huawei more than Huawei pays Qualcomm?

The announced terms do not answer that question. Neither company disclosed a payment breakdown, the price for the selected U.S. patents, or a net amount payable by either side. The headline claim that Qualcomm “will pay Huawei” therefore goes beyond what the public deal terms establish: a patent purchase is confirmed, but a net payment from Qualcomm to Huawei is not.

Huawei described the agreement as consistent with FRAND principles—fair, reasonable and non-discriminatory licensing. That is the company’s characterization of its licensing practices, not a disclosure of the deal’s financial balance.

Why this is a turnaround—and what “first time” means

The deal marks a notable change in the direction of the relationship, but not necessarily a first-ever payment from Qualcomm to Huawei. Reuters reported that Huawei first paid Qualcomm for a patent license in 2001. The new agreement adds reciprocal patent rights and Qualcomm’s purchase of selected Huawei patents, but the companies have not said that Qualcomm will be the net payer for the first time.

Reuters also reported that Huawei expected the cumulative value of its patent-licensing agreements to exceed $6.9 billion once this agreement was completed. That figure refers to Huawei’s licensing agreements in aggregate; it is not the value of the Qualcomm agreement or the amount Qualcomm will pay. Reuters reporting carried by MarketScreener also says Huawei’s first patent-licensing income came from Motorola in 2011.

When does the deal take effect?

The October 5 announcement said the transaction would close after the necessary regulatory approvals. As of that announcement, it had not yet closed. The companies have not publicly provided a closing date or further approval details.

Why the agreement matters

For readers, the key distinction is between access to patents and the sale of patent assets. The cross-license gives both companies rights within the stated fields, while the separate purchase transfers certain Huawei U.S. patents to Qualcomm. The deal therefore does more than settle a one-way licensing arrangement, but the undisclosed financial terms prevent a reliable conclusion about who pays whom on net.

Qualcomm’s licensing executive John Han said the agreement reflects Qualcomm’s recognition of Huawei’s continued innovation and intellectual property in 5G and other fields. Huawei’s intellectual-property chief Alan Fan said its investment in research and development had driven innovation in mobile communications and other technology fields. Those are the companies’ stated views of the agreement and their contributions.
