Qualcomm and Arm began a new trial in Delaware on October 5, 2026, but the billions-of-dollars figure in headlines is not a damages award. It refers to royalties Qualcomm says it could avoid paying for as long as five years if a disputed contract remedy is available. Whether that remedy survives, whether Arm breached its agreements, and whether Qualcomm can prove financial harm remain unresolved.

What the new Qualcomm-Arm case is about

This is a lawsuit Qualcomm brought against Arm, separate from Arm’s earlier case over Nuvia. Qualcomm alleges that Arm failed to provide contractually required chip-testing tools, improperly sought to terminate Qualcomm’s Architecture License Agreement (ALA), and publicized its termination effort in a way that harmed Qualcomm’s business discussions, including talks for a chip deal with Meta. Qualcomm also alleges that Arm failed to offer Technology License Agreement (TLA) terms at commercially reasonable prices and terms, and failed to negotiate certain terms in good faith. Arm disputes Qualcomm’s claims and says it intends to defend the case. Reuters reported the trial’s allegations and framing on October 5, 2026; the parties’ filings describe the claims and positions in more detail (Qualcomm’s Form 10-Q for the quarter ended June 28, 2026; Arm’s Form 6-K for the quarter ended June 30, 2026).

Why “billions” does not mean a damages award

Reuters reported that Qualcomm is seeking to stop paying royalties for up to five years, a remedy that could be worth billions of dollars. That is a possible value of royalties Qualcomm hopes to avoid paying—not money a court has awarded, an amount Arm has admitted owing, or a quantified estimate of Qualcomm’s loss. Judge Maryellen Noreika was considering whether the relevant contract term could be enforced. If that remedy is unavailable, Qualcomm could pursue a smaller damages amount instead. The outcome depends on the judge’s ruling and on what Qualcomm proves at trial. Reuters’ October 5 report describes the royalty theory and the court’s consideration of it.

Qualcomm’s own accounting disclosure also cautions against treating the headline scale as a measured liability. In its filing for the quarter ended June 28, 2026, Qualcomm said it had recorded no loss accrual because a loss was reasonably possible but not probable, and said it could not then reasonably estimate a possible amount or range. This is Qualcomm’s disclosure about its litigation exposure, not a court finding or an estimate of Arm’s liability. (Qualcomm Form 10-Q, quarter ended June 28, 2026.)

How this trial differs from Arm’s earlier Nuvia case

Issue Arm’s earlier case Qualcomm’s current case
Who sued whom Arm sued Qualcomm, Qualcomm Technologies, and Nuvia in 2022. Qualcomm filed a separate action against Arm Holdings in April 2024.
Main dispute Arm alleged breaches tied to Nuvia’s license and technology after Qualcomm acquired Nuvia. Qualcomm alleges Arm failed to perform under Qualcomm’s agreements, mishandled a termination effort, and harmed its business.
What the December 2024 jury decided The jury found Qualcomm did not breach the Nuvia ALA and that Qualcomm CPUs incorporating Nuvia designs were licensed under Qualcomm’s ALA. It could not agree on whether Nuvia breached its agreement. The new case concerns Qualcomm’s claims against Arm; it is not a retrial of the Nuvia dispute.
Status reported by October 7, 2026 The court entered final judgment for Qualcomm and Nuvia on September 30, 2025; Arm appealed on October 1, 2025. Reuters reported that the new trial began October 5, 2026; the reviewed reporting does not establish a verdict.
Money at issue The cited sources do not state a comparable current damages figure for the appeal. Qualcomm seeks royalty relief that Reuters described as potentially worth billions, but no award or precise damages figure is established.

The distinction matters because the first case concerned Nuvia’s agreement and use of technology, while the new case concerns Arm’s alleged performance under Qualcomm’s agreements and Qualcomm’s claimed business harm. The district-court judgment in the older case and Arm’s appeal are separate from any decision in the new trial. Qualcomm’s 2026 Form 10-Q, Arm’s 2026 Form 6-K, and Arm’s FY2026 annual report describe the two proceedings.

What is happening in court

Reuters described a five-day jury trial beginning Monday, October 5, 2026, alongside a related bench trial on whether Arm negotiated in good faith over the next version of its chip technology. The jury and bench proceedings address different questions within the broader dispute. Reuters also reported that Qualcomm’s agreement with Arm runs through 2033. These are trial-status details as reported on October 5; they do not establish a verdict or the eventual effect on the companies’ commercial relationship. (Reuters, October 5, 2026.)

What remains unresolved

  • Whether the court will allow Qualcomm to pursue the multiyear royalty-avoidance remedy.
  • Whether Qualcomm proves that Arm breached its contractual obligations.
  • Whether Qualcomm can establish that Arm’s conduct caused the alleged business harm and what damages, if any, follow.
  • What the court will decide on the related good-faith negotiation issue.
  • Whether the proceedings will change the parties’ commercial relationship.

As of the October 7, 2026 reporting cutoff, no trial verdict or final damages determination is established in the sources cited here. Qualcomm’s June filing likewise gives no reasonably estimable loss range; neither point should be read as predicting the eventual result.
