Prediction markets and sports betting can both let you put money on an outcome, but they use different mechanisms. A prediction-market position is typically an event contract traded at a market price and settled under contract rules; a sportsbook accepts a wager under its odds and terms. That difference affects how prices move, whether you can exit early, how losses arise, and which regulators claim authority. In the United States, the treatment of sports event contracts remains contested: the CFTC asserts federal jurisdiction over regulated derivatives, while states have challenged some offerings under gambling laws.

What you buy: an event contract or a sportsbook wager

Prediction markets

A prediction-market participant typically buys a position in an event contract. The contract defines the event, the possible outcome or outcomes, the payout, the expiration, and how the result will be determined. Many use a yes/no format, though some contracts offer multiple choices, bundle questions, or pay according to a range of outcomes.

The contract’s wording matters. A question that sounds straightforward may still depend on a specific deadline, data source, cancellation rule, or other condition. The contract’s own terms govern resolution.

Sports betting

With conventional sports betting, a customer places a wager with a sportsbook under the odds and rules it offers and accepts. The wager’s potential payout follows those terms. Sportsbooks and products can differ, so it is not accurate to assume that every operator uses the same structure or rules.

Question Prediction-market event contract Sportsbook wager
What is the position? A defined contract traded on a market, often with yes/no outcomes and a stated payout and expiration. A wager accepted by a sportsbook under its offered odds and terms.
How is the price or payout set? The market price changes with trading; a participant’s outcome depends on entry price, settlement, and any exit price. The sportsbook presents odds and a payout under the accepted wager terms.
Can you exit before the event is resolved? Some contracts may be sold before settlement at the then-current market price, if an exit market and willing buyers are available. The CFTC materials cited here do not establish a universal early-exit mechanism for sportsbook wagers; check the operator’s terms.
What determines the result? The specific contract’s event definition and settlement rules. The specific bet’s rules and the sportsbook’s applicable terms.
Regulatory framework CFTC oversight applies to registered derivatives markets; the treatment of some sports-related contracts is contested. State-specific sports-wagering laws and regulatory systems apply, subject to the unresolved disputes over some event contracts.

How event-contract prices, payouts, and settlement work

A yes/no example

The CFTC’s consumer explainer uses a contract asking whether it will rain the next day. In its example, a yes position costs $0.70 and a no position costs $0.30; if rain occurs, the yes holder receives the stated $1 settlement payout. Before fees and taxes, the yes buyer’s gross profit would be $0.30. If the prediction is wrong, the position’s investment is lost.

The $0.70 price is a market price, not a guaranteed or independently verified probability. It may be interpreted as the market’s perceived chance of an outcome, but the trader’s actual result depends on the price paid, the settlement, costs, and—if the position is sold early—the price received.

Settlement and early exits

Before entering, read the contract’s event definition, resolution source, deadline, cancellation provisions, and settlement method. CFTC guidance says customers on regulated markets are entitled to transparent contract terms, including how settlement determinations are made. A position may be sellable before expiration, but that depends on an exit market and its liquidity; the available price may be different from the entry price or the eventual payout.

More complex or narrowly defined contracts may attract fewer participants and have lower liquidity. That can make it harder to exit quickly, or to get the price you want. A correct prediction alone does not guarantee a profit: entry price, fees, taxes, and settlement all matter.

Risk: what can go wrong in either activity

Losses and costs

A wrong event-contract position can lose the amount invested. A correct position can still produce a smaller-than-expected net return—or a loss after costs—if the entry price and fees leave too little between the cost and payout. With a sportsbook wager, the payout is governed by the accepted odds and terms. Neither structure makes a participant’s outcome certain.

Before participating, account for commissions, fees, taxes, and other costs. Do not assume that an event-contract market is cheaper, safer, more profitable, or more accurate than a sportsbook: the cited CFTC materials provide no universal side-by-side fee, customer-loss, or net-return statistics.

Market risk and the purpose of a position

An event contract can be used for speculation or to hedge an economic exposure. The CFTC’s example is a citrus farmer using a weather contract to offset possible losses from a freeze. That illustrates a possible use of the instrument; it does not show that a particular sports contract will hedge a particular person’s risk.

The CFTC says prediction markets can sometimes forecast outcomes better than polling or other forecasting approaches, and notes that their forecasts are increasingly cited by media and analysts. Its consumer page does not provide a named study or a quantified head-to-head result, so that statement should not be read as a promise that any market—or a sports event contract—will forecast accurately.

How U.S. oversight differs—and why sports contracts are disputed

CFTC-regulated derivatives markets

The CFTC describes event contracts as commonly structured as swaps and identifies registered exchanges and intermediaries as part of the regulated landscape. Its consumer guidance describes an application process, periodic examinations, market-integrity rules, and surveillance for registered markets. Where a futures commission merchant intermediates trades, customer-protection rules include requirements designed to protect customer funds. These safeguards do not remove market risk or replace the need to read a contract’s terms and costs.

The CFTC’s authority under the Commodity Exchange Act includes determining that certain event contracts are contrary to the public interest when statutory categories are involved. In 2026, the agency proposed a rule seeking comment on how to interpret “gaming,” including whether sports contests should be treated differently from other competitions. A proposal is not a final rule.

Active disputes over sports-related event contracts

Sports event contracts sit at the intersection of federal derivatives regulation and state gambling law. The CFTC asserts exclusive federal authority over commodity derivatives traded on regulated markets; states have challenged some sports-related offerings as unlawful gambling under state law. An app’s use of the label “prediction market” does not by itself settle the product’s legal classification.

In a February 17, 2026 release, the CFTC said it had filed an amicus brief in Ninth Circuit litigation involving Nevada and stated its view that it has exclusive jurisdiction over commodity derivatives, including event-contract markets. In an April 2, 2026 release, the agency said it had sued Connecticut, Arizona, and Illinois over state actions and described its view that federal derivatives law governs. Those releases state the agency’s litigation position; they are not final court rulings resolving the issue nationwide.

The CFTC’s 2025 roundtable announcement also identified questions involving sports-related contracts, gaming, preemption, state rights, and tribal sovereignty. The official materials cited here document agency positions and active disputes, not a final nationwide judicial resolution for every market or state. Legal status and availability can change, so readers should check current state rules and relevant court developments before participating.

What the listing figures do—and do not—show

In its 2026 proposed rule, the CFTC reported approximately five event contracts listed per year on designated contract markets from 2006 through 2020, 131 listed in 2021, and approximately 1,600 certified for listing in 2025. The agency said the 2025 contracts spanned financial indices, economic indicators, weather, political, international, scientific and cultural, current, and sporting events. These are contract counts, not measures of trading volume, user numbers, forecast accuracy, or market quality.

What to check before taking a position

Use this checklist for a prediction-market event contract. For a sportsbook wager, read the operator’s applicable bet and account terms instead.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Operator and access: Verify the entity’s registration and use its official app or website. Do not infer registration from an app’s branding.
  • Event definition: Identify exactly what must happen, the deadline, the source used to verify the result, and who determines resolution.
  • Payout and expiration: Confirm what each outcome pays, when the contract expires, and what happens if the event is canceled or the result is unclear.
  • Total costs: Check fees, commissions, taxes, and other charges that affect the amount you can receive.
  • Exit options: Find out whether you can sell before settlement and assess whether the contract has enough liquidity for an exit at a usable price.
  • Customer funds and account terms: Review how funds are handled, the operator’s account rules, and the applicable customer protections.
  • Risk disclosures: Read the required risk and cost information and understand that the full amount invested in a position may be lost.

The CFTC says customers should receive clear risk and cost information, timely contract terms, accurate statements, and access to funds. Those are useful checkpoints, not a guarantee of a particular outcome or individualized legal or investment advice.
