If you want to trade contracts tied to real-world outcomes, compare the specific venue and market—not just the platform name. Kalshi is an example of a CFTC-regulated exchange; Polymarket has distinct offshore and U.S.-approved venues; and Robinhood, DraftKings, and FanDuel also distribute event contracts. Their access, contract selection, rules, fees, and legal status are not interchangeable, and a contract’s price is a market-implied probability rather than a guaranteed forecast.

What a prediction market contract is

In a common yes-or-no event contract, a trader buys the side they think will happen. A CFTC-hosted public-comment submission describes a correct side as typically paying $1 per contract. As traders buy and sell, the price reflects the market’s implied probability: for example, a price near 60 cents can be read roughly as a 60% market-implied chance, subject to the contract’s terms and trading costs. That is a reading of the market price, not an objective forecast or a promise that the outcome will occur. The mechanics description comes from a stakeholder submission, not a CFTC determination.

The Congressional Research Service (CRS) describes prediction-market prices as emerging from participants’ continuing trades toward an equilibrium. A price can change as new information arrives, but it can also be affected by limited trading, the contract’s design, and the mix of participants.

The services below are examples, not a complete or ranked directory. Platform names alone do not establish that products have identical contract inventories, fees, settlement methods, or eligibility.

Venue or service What the available evidence establishes What to check before trading
Kalshi CRS characterizes Kalshi as a CFTC-regulated exchange and describes its event categories as broad. Confirm location eligibility, the individual contract’s rules and settlement source, current fees, and liquidity in that market.
Polymarket offshore exchange CRS distinguishes a large offshore exchange that it says claims to block U.S. users. Do not assume access is available to you or that this venue shares the U.S. venue’s rules, settlement, or protections. Check current terms and local law.
Polymarket U.S. exchange CRS distinguishes a smaller CFTC-approved exchange available to U.S. customers from the offshore exchange. Verify current eligibility and the particular contract’s rules, settlement source, fees, and market liquidity.
Robinhood, DraftKings, and FanDuel CRS names these companies as offering event contracts, with differing business practices. Check which exchange or product is involved, what contracts are offered where you live, and the applicable fees and contract terms.

Choose by the use case, then inspect the market

  • For a regulated U.S. exchange structure: Kalshi is a comparison point identified by CRS, but that does not establish that a particular contract is available in your state or resolve all legal questions.
  • For Polymarket: identify whether you are looking at the offshore exchange or the separate U.S. exchange. Treat them as different venues, not one product with universal access.
  • For event contracts inside a broader consumer service: Robinhood, DraftKings, and FanDuel are additional avenues to investigate. Their inclusion does not mean their contracts, exchange arrangements, or terms are the same.

Market breadth is not the same as liquidity

CRS reported that, in the year before its February 2026 snapshot, sports accounted for about 87% of Kalshi’s $39.7 billion traded and 38% of Polymarket’s $36.2 billion traded. These are dated, aggregate volume and category figures—not current totals, forecasts, or measures of how easy it is to trade a particular contract. The Polymarket figure is sports’ share, not a combined share for all non-sports categories.

For a practical comparison, look at the individual contract you might trade. Aggregate activity does not show how much trading is available at a price you would accept, and a platform with many event categories may still have thin activity in a specific market. Review the available prices and trading activity for that contract rather than treating platform-wide volume as a liquidity guarantee.

Rules, settlement, and legal status matter

Before placing a trade, read the contract’s resolution criteria: what event counts, which source determines the result, and how edge cases are handled. A familiar event name is not a substitute for the written terms. Also check the settlement method and timing for that contract; the general description of a yes-or-no contract does not establish the rules of every market.

U.S. regulation remains contested, particularly for sports contracts and the boundary between federal derivatives oversight and state or tribal gaming authority. CRS explains that the CFTC administers the federal derivatives framework and that the Commission’s leadership asserts exclusive federal jurisdiction over contracts on registered designated contract markets. States have challenged that position. CRS also notes the CFTC may review exchange self-certifications and that the Commodity Exchange Act identifies categories—including gaming and certain unlawful activities—that may be considered contrary to the public interest. These points do not amount to settled nationwide permission for every event contract.

CRS quoted then-Acting CFTC Chair Caroline Pham saying in February 2025 that the “current Commission interpretations regarding event contracts are a sinkhole of legal uncertainty and an inappropriate constraint on the new Administration.” That was Pham’s statement at the time, not a neutral finding that resolves the present legal disputes.

What to verify before you fund an account

  1. Eligibility: Check whether the specific service and contract accept customers in your location. Do not infer access from a company’s national profile or from another venue with a similar name.
  2. Contract rules: Read the resolution criteria and identify the stated source used to settle the outcome.
  3. Costs: Confirm current trading fees and any funding or withdrawal costs directly with the service. The CRS material and CFTC-hosted submission cited here do not establish current platform fee schedules.
  4. Liquidity: Inspect the prices and activity for the exact contract. Broad category counts or historical platform-wide volume do not establish that you can enter or exit a particular position on favorable terms.
  5. Legal and product details: Confirm which venue is offering the contract and review current local rules. Terms and availability can change.
