Yes, police may ask for footage from a Tesla parked near a crime, and in some circumstances seek a warrant to tow the car and examine its stored video. A San Francisco Chronicle report dated August 31, 2024 describes Oakland investigations in which officers requested nearby Tesla recordings. In at least three reported July and August instances, officers sought warrants to tow vehicles and search their stored video.
That reporting concerns specific Oakland cases, not proof that departments nationwide routinely seize Teslas. Whether useful footage exists, and whether officers can obtain it, depends on the car’s recording settings, storage, the event itself, owner consent and applicable local law.
What happened in Oakland
The Chronicle reported that Oakland officers treated Teslas parked near crime scenes as potential sources of surveillance evidence, even when the owners were not suspected of wrongdoing. Officers often asked owners for recordings. In other reported cases, warrant applications sought authority to tow a Tesla and search video stored in the vehicle.
The article counted at least three such warrant-seeking instances during July and August. That is a count of examples in that report, not a national rate or evidence that every police department uses the same approach.

Could your Tesla have recorded the crime?
Possibly, but Sentry Mode is conditional event recording rather than a continuously guaranteed record of everything around the car.
How Sentry Mode works
Tesla describes Sentry Mode as using vehicle sensors and exterior cameras to detect suspicious activity or a significant threat while the vehicle is parked. Settings, event-detection behavior, software version, vehicle model and the circumstances around the car determine whether a clip is created.

- The car may have been parked with Sentry Mode disabled.
- An event may not have met the system’s detection threshold.
- A camera view, lighting condition or obstruction may make a clip incomplete or unusable.
- The vehicle may have generated an alert without retaining a playable recording.
- Older clips may have been overwritten or deleted.
The Chronicle specifically cautioned that there is no guarantee a nearby Tesla recorded the crime.

Tesla’s privacy notice says, “Sentry Mode footage is not transmitted to Tesla.” For Sentry Mode recordings, saved video is stored locally on a USB drive installed in the vehicle. If no suitable drive is installed, the vehicle may send an alert while having no footage available for police to retrieve. This statement concerns Sentry Mode recordings, not every type of vehicle, account or connectivity data.

How police can seek the footage

The San Francisco Police Department’s Non-City Entity Surveillance Cameras policy provides a local example: “Absent a search warrant, SFPD access to all non-City entity surveillance cameras or systems will be obtained through the express consent of the individual or entity managing the surveillance system at the time of the request.” The policy applies to SFPD and should not be treated as a nationwide rule.
The Oakland examples show both routes in practice: officers obtained consent in some reported cases and pursued warrants in others. A department may also seek a warrant when an owner or provider refuses historical footage and investigators can legally justify the request.

What happens if officers ask you for Sentry Mode footage?
If you want to cooperate
- Ask for the incident number, requesting agency and the date, time and location investigators are examining.
- Do not alter, rename or delete potentially relevant files. Preserve the original USB drive and make a separate working copy if you need to review clips.
- Ask how officers want the material transferred and request a receipt or written record describing what was provided.
- Record the vehicle’s model, software version, drive and relevant Sentry Mode settings so the context of the clip is preserved.
If you are unsure or do not consent
You can ask whether the request is voluntary and whether officers have a warrant. Do not physically interfere with a lawful search or tow. If the request concerns a warrant, a threatened seizure or a criminal investigation involving you, contact a lawyer in your jurisdiction promptly; the effect of consent and the scope of a warrant are fact-specific.
Making sure your Tesla can save Sentry Mode clips
Tesla’s privacy notice and owner documentation describe USB storage as the way Sentry Mode saves footage. Requirements vary by vehicle, model year, port type, formatting and software. The Model 3 owner’s manual, for example, specifies drive and preparation requirements; owners should follow the manual for their exact vehicle rather than assume any USB drive will work.
- Use a drive that your vehicle and current manual support.
- Format and prepare it exactly as Tesla instructs.
- Verify that Sentry Mode is enabled when parked and that the car recognizes the drive.
- Periodically check that clips are actually being written and that the drive has usable space.
A compatible drive improves the chance of retaining an event, but it cannot make Sentry Mode detect an event, create a complete view or preserve footage that was never recorded.
