No—not yet. Pennsylvania’s proposed Protect Our Games Act is not law, and its sponsor’s September 18, 2026, memo says it had not yet been submitted for introduction. If enacted as described, the proposal would require covered game manufacturers to give purchasers 60 days’ notice before ending a game’s use or changing its features, then provide one or more specified remedies: offline play, an independent-use patch, or a qualifying refund.
What is the Protect Our Games Act?
It is a planned Pennsylvania consumer-protection bill sponsored by state Sen. John Kane. Kane’s office circulated a co-sponsorship memo on September 18, 2026, saying he intended to introduce it. The memo also states that it “has not been submitted for introduction yet,” so it should be treated as a proposal, not an introduced bill, enacted law, or current consumer entitlement. What would publishers have to do?
Under the memo, a video game manufacturer would have to give purchasers 60 days’ notice if it intends to stop allowing use of a digital game or change its features. It would then have to provide “one or more” of the listed options. That wording does not mean every affected purchaser would necessarily receive all three.

- Enable offline use: provide the ability to use the game offline.
- Provide an independent-use patch: release a patch that lets players continue using the game online without relying on the company’s online gaming services.
- Offer a qualifying refund: refund an amount based on the game’s highest offered price during the 12 months before the operator stops providing services for ordinary use. The amount could not be less than 25% of the game’s initial sale price.
How would the proposed refund work?
The memo sets both a reference price and a minimum. The refund would be tied to the highest price at which the digital game operator offered the game during the 12 months before it stopped providing services for ordinary use, but it could not be lower than 25% of the initial sale price. The memo does not provide a worked example or explain how the formula would be administered in particular purchase situations. These are proposed terms, not refunds players can claim under current Pennsylvania law.
Which games would be exempt?
The memo describes three exemptions:
- Subscription access lasting only for the subscription term: games offered through a service that provides access only while the subscription lasts.
- Some games offered for free: games provided for no monetary consideration, unless a player has made purchases or invested money to upgrade characters or unlock features. The exception is therefore not a blanket exemption for every free-to-play game.
- Access the seller cannot revoke: games where the seller cannot withdraw access after the transaction. The memo gives a permanent offline download to external storage for use without an internet connection as an example.
What happens to digital games when servers go offline?
Under this proposal, a covered shutdown or feature change could trigger advance notice and one or more remedies, but the measure would not guarantee that every game remains playable in its original form. The listed options distinguish between offline use, an independent patch for continued online use, and a refund. Which option or options a purchaser would receive would depend on the proposal’s final text and, if enacted, its application to the particular game.

Who would enforce it if it became law?
The memo names the Pennsylvania Attorney General and district attorneys as enforcement authorities. That is the enforcement arrangement described for the proposed act; it does not create a present remedy while the measure remains unintroduced.

Kane’s memo frames the issue as a difference between a physical or offline copy and license-based digital access that can be affected by a company’s decisions. It also cites a prospective 2028 end to Sony’s video game disc production as context. That future production statement is part of the sponsor’s rationale in the memo, not an independently verified production announcement here. The memo quotes Kane’s office as saying: “At the request of constituents, I will soon introduce the Protect Our Games Act to address this consumer protection issue.”
