For qualifying events on or after October 1, 2026, eligible employees covered by North Carolina’s paid parental leave program can receive 12 weeks of leave at 100 percent of eligible regular pay. The federal Family and Medical Leave Act (FMLA) is different: it can provide eligible employees up to 12 workweeks of unpaid, job-protected leave. The programs may run at the same time, so they do not automatically add up to 24 weeks.
How North Carolina paid parental leave and FMLA differ
North Carolina’s paid parental leave is a state benefit for covered employees and qualifying events. FMLA is a federal leave entitlement for employees who meet its eligibility rules. One can provide pay while the other provides unpaid, job-protected leave; when both apply, they may overlap.

Which employees may qualify?
North Carolina state paid parental leave
The state overview identifies executive-branch employees and employees of participating public schools and community colleges. It does not establish that every public employee in North Carolina is covered. Ask HR whether your employer participates and whether your position is covered.

The event date is important. OSHR says the 12-week, 100-percent-pay benefit applies to qualifying events on or after October 1, 2026. The older OSHR materials describe four weeks for other eligible parents and eight weeks for eligible employees who give birth before that date. Those older amounts should not be used to determine the benefit for a later event, and older eligibility rules should not be assumed to govern the updated policy.

Federal FMLA
Under the Department of Labor’s general eligibility guidance, an employee must have worked for the employer for at least 12 months, worked at least 1,250 hours during the 12 months immediately before leave, and work at a location where the employer has at least 50 employees within 75 miles. Public agencies are covered employers regardless of size, but their employees still need to meet the individual eligibility conditions. See the Department of Labor FAQ for details.
What events can the leave cover?
OSHR’s paid parental leave overview describes qualifying events related to a child’s birth or placement. Because the detailed state policy is being updated, check with your agency HR office about which events and circumstances qualify under the current rules.

FMLA also provides leave for qualifying family and medical reasons. For birth or placement bonding leave, the Department of Labor says intermittent leave is available only if the employer approves it, and bonding leave must conclude within 12 months after the birth or placement. Other FMLA reasons may follow different rules.

If an employee qualifies for both programs for the same event, paid parental leave may be designated to run concurrently with FMLA. In that case, the paid weeks are also counted against the employee’s available FMLA leave; the two entitlements are not automatically sequential. Ask HR how each leave will be designated and counted, including whether any other accrued paid leave applies.

What to confirm with agency HR
OSHR says Session Law 2026-40 took effect October 1, 2026, and that the detailed policy and FAQs are being updated. The overview establishes the headline benefit and covered employer categories, but it does not settle every implementation question. Before planning leave, ask your agency HR office to confirm:
- Whether your employer and position are covered by the state program.
- Whether your event qualifies and which event date controls.
- How the current state eligibility rules apply to your service and work history.
- What notice, documentation, scheduling, and leave-request steps apply.
- Whether you meet FMLA’s service, hours, and worksite tests.
- Whether the state leave and FMLA will overlap, and how the time will be counted.
- How pay and health benefits will be handled during the leave.
For general federal rules, consult the U.S. Department of Labor FMLA FAQ. For the state benefit, consult North Carolina OSHR’s Paid Parental Leave overview and ask your agency HR office how the current policy applies to your circumstances.
