The date the qualifying event occurs determines which North Carolina state employee parental-leave rules apply. For events before October 1, 2026, the Office of State Human Resources (OSHR) describes the prior benefit as eight weeks for an eligible employee who gives birth and four weeks for another eligible parent. For events on or after October 1, 2026, Session Law 2026-40 authorizes eligible full-time employees to take up to 12 weeks of paid parental leave. The law leaves important eligibility and administration details to policy, and OSHR says updated policy and guidance are forthcoming. Contact your agency HR office to confirm how the current rules apply to you.
Which rules apply to your qualifying event?
Use the date of the event—not the date you read this page or submit a request—to identify the framework. OSHR distinguishes events before October 1, 2026, from events on or after that date. The new statute’s benefit is “up to 12 weeks,” not a guaranteed fixed award for every employee.
| Qualifying-event date | Benefit described in official materials | Important qualification |
|---|---|---|
| Before October 1, 2026 | Eight weeks for an eligible employee who gives birth; four weeks for another eligible parent. | These amounts and the former program’s eligibility and pay descriptions are prior-framework guidance from OSHR. They should not be assumed to govern events under the new law. OSHR paid parental leave |
| On or after October 1, 2026 | Up to 12 weeks for an eligible full-time employee; part-time leave is prorated under Commission policy. | The statute assigns eligibility and implementation details to policy. Who can qualify under the new law?
The statute covers eligible employees subject to its provisions. It defines the qualifying event as becoming a parent to a child. A child includes a newborn biological child or a child under 18 newly placed with the employee for adoption, foster care, or another legal placement. The definition is not limited to birth parents. Session Law 2026-40
OSHR’s existing program page describes coverage for executive branch employees and participating public schools and community colleges. School and college implementation may also depend on the policies of their governing bodies, so employees in those settings should confirm coverage with their HR office. OSHR paid parental leave

Service requirements are not yet settled in the published guidance
OSHR’s description of the prior program specified 12 months of employment and pay status for at least half that time. The new statute directs the State Human Resources Commission to set a minimum service period and rules for aggregating service across an executive branch agency, public school, or community college. The reviewed new-law materials do not establish the final minimum-service duration. Do not treat the old 12-month description as confirmed eligibility criteria for a new-law event. How much paid leave can an eligible employee take?
For a qualifying event on or after October 1, 2026, the statute allows an eligible full-time employee to take up to 12 weeks. Part-time employees’ leave is prorated under Commission policy and capped at 12 weeks. The amount is therefore not necessarily 12 weeks for every employee: eligibility, proration, and other administration rules depend on policy. Session Law 2026-40
For a qualifying event before October 1, 2026, OSHR describes eight weeks for an eligible employee who gives birth and four weeks for another eligible parent. That distinction belongs to its prior-framework guidance; the new statute provides up to 12 weeks after a qualifying event without stating those separate amounts. Is the leave paid, and must you use accrued leave first?
The statute authorizes paid parental leave and expressly says employees do not have to exhaust sick or vacation leave first. Parental leave is in addition to shared leave and other leave authorized under state or federal law. It has no cash value when employment ends and is not used to calculate retirement benefits. Session Law 2026-40
OSHR’s prior-program description says eligible employees received 100 percent of regular pay. The statute does not itself specify a pay calculation for the new benefit, and OSHR says its policy is being updated. Ask your agency HR office how pay will be calculated for a qualifying event on or after October 1, 2026. OSHR paid parental leave
How does parental leave relate to FMLA or other leave?
OSHR lists Family and Medical Leave as a separate program with its own eligibility and rules. The new statute says parental leave is additional to other leave authorized by state or federal law, but that does not mean the programs have identical eligibility, timing, or payroll treatment. Ask HR how to coordinate the benefits and any other leave that applies to your situation. OSHR paid parental leave OSHR Family and Medical Leave Session Law 2026-40

How do you request paid parental leave?
OSHR’s page lists a request form and prior policy materials, but says the policy is being updated for the law effective October 1, 2026, with new FAQs and guidance to follow. The statute delegates request procedures and other operational details to policy; the reviewed materials do not establish a universal deadline or documentation checklist for new-law requests.
- Contact your agency HR office promptly. Explain the qualifying event and its date, and ask which rules and forms apply to your employment setting.
- Confirm eligibility and the leave amount. Ask about the current service requirement, how part-time leave is calculated if relevant, and how any other leave will be coordinated.
- Follow the current agency process. Confirm submission deadlines, required documentation, scheduling, and any updated form or policy before relying on an older OSHR form.
Use the OSHR paid parental leave page for the current state-level materials and links; your agency HR office can confirm the process applicable to your case.
What details still depend on Commission policy?
The law directs the Commission to establish several implementation rules. The published materials reviewed here do not settle the following details, so employees should not infer an answer from the 12-week maximum alone:

- The minimum service period and how service across covered employers is aggregated.
- How part-time leave is prorated.
- The maximum number of times an employee may use the benefit in a 12-month period.
- Available leave following miscarriage or a child’s death during birth.
- Operational request procedures, including deadlines and documentation.
OSHR says its policy, FAQs, and guidance are being updated. Check with HR for current direction rather than applying a prior rule to a new-law event.
