North Carolina’s expanded paid parental leave took effect October 1, 2026. Eligible employees covered by the new law may receive up to 12 weeks after a qualifying event on or after that date. The new limit does not apply retroactively: the state’s current guidance describes up to eight weeks for eligible employees who gave birth before October 1 and up to four weeks for other eligible employees with an earlier qualifying event.

How the October 1 date changes the amount of leave

The qualifying event date—not the date an employee requests leave—determines which amount applies under the North Carolina Office of State Human Resources (OSHR) guidance. The General Assembly’s Session Law 2026-40, Senate Bill 1041, created the new State Human Resources Act and added G.S. 126A-71. The statute says: “Any eligible full-time employee subject to this section may take up to 12 weeks of paid leave after a qualifying event.”

Qualifying event OSHR-described leave for eligible employees
Before October 1, 2026; employee gave birth Up to 8 weeks
Before October 1, 2026; another qualifying event Up to 4 weeks
On or after October 1, 2026 Up to 12 weeks

These amounts are ceilings, not automatic guarantees for every public employee. The governing law and applicable employer policy determine eligibility. See the enacted law, Session Law 2026-40, and OSHR’s Paid Parental Leave guidance.

Which events and parents are covered?

The law covers a qualifying event involving a newborn biological child, or a child under age 18 newly placed with the employee for adoption, foster care, or another legal placement. The statutory definition of parent includes those forms of becoming a parent; OSHR’s summary also lists birth, adoption, foster care, and other legal placement.

The event must meet the law and the employer’s applicable policy. Employees with a particular placement or employment situation should ask HR how the policy applies rather than assume every arrangement qualifies.

Who qualifies, and do you need a year of service?

OSHR’s current public summary says employees need at least 12 months employed by an executive branch agency, participating public school, or community college, and must have been in pay status for at least half of that time. The statute directs the State Human Resources Commission to set a minimum service period and says aggregate service among covered executive-branch agencies, public schools, and community colleges is to be credited under its policy.

Part-time employees

The statute directs the Commission to provide prorated leave for part-time employees, capped at 12 weeks. It does not establish a specific calculation in the statutory provision, so part-time employees should ask HR for the applicable policy and calculation.

How the leave interacts with other benefits

Paid parental leave is separate from accrued sick and vacation leave: the statute says employees may take it without exhausting those balances. It is also additional to shared leave and other leave authorized by state or federal law. The benefit has no cash value when employment ends and is not included in retirement-benefit calculations.

What public school and community college employees should check

The law directs local boards of education and community college boards of trustees to adopt policies substantially equivalent to the Commission’s policy. For public schools, there was a transition issue as of September 2026: the North Carolina Department of Public Instruction (DPI) said the State Board’s existing rule, 16 NCAC 06C .408, had not yet been updated and that it was awaiting proposed rulemaking.

DPI’s September 1, 2026 notice said its position was not legally binding on public school units without a formal rule change and advised units to consult local counsel about individual cases. Employees at a school unit should check its current written policy with HR; community college employees should likewise confirm their institution’s implementing policy. DPI’s notice is available at Paid Parental Leave Update – All PSUs.

How to confirm your leave and request it

  1. Identify the qualifying event date and type. Note whether it occurred before or on/after October 1, 2026, and whether it involved birth, adoption, foster care, or another legal placement.
  2. Check your employer’s coverage and policy. Determine whether you work for a covered executive branch agency, participating public school, or community college, and obtain the current written policy from HR.
  3. Ask HR to apply the service rules to your case. Confirm your months employed, pay-status history, treatment of prior covered service, and any part-time proration.
  4. Get the current request procedure and forms. OSHR’s leave page says updated FAQs and guidance are forthcoming and marks linked resources as most relevant to events before October 1. Check the current OSHR guidance and policy pages before relying on an older form or FAQ.

OSHR also provides a summary of the expansion on its HR Transformation page. Because implementation material is in transition, employer HR is the practical source for the current process and a decision on an individual employee’s eligibility.
