The title lists five things that sit in different layers of U.S. mortgage finance: automated valuation, a “title waiver,” real estate auctions, loan quality control, and electronic mortgage notes. It adds borrower financial literacy and mortgage-backed securities (MBS) issuance. They connect, but they are not one product or one rule.
Two clarifications up front. First, the official sources reviewed support appraisal waivers and appraisal-copy timing waivers. They do not support a general “title waiver” that skips title review or title insurance. Second, “AI” in mortgage valuation is usually governed as an automated valuation model (AVM), and a federal quality-control rule for AVMs took effect on October 1, 2025. This guide covers the United States only. It gives no auction procedures, because those depend on the state and the auction type.
The pieces at a glance
| Layer | What it covers | Key point |
|---|---|---|
| Valuation | Appraisal, AVM, appraisal waiver, waiver plus property data | Describes how the property’s value was established, not who holds title |
| Valuation copies | When the borrower gets appraisals and other written valuations | Regulation B sets timing; Regulation Z limits waivers on higher-priced mortgage loans |
| AVM quality control | Controls on automated valuation models in covered mortgage decisions | Five control aims; effective October 1, 2025 |
| eNote / eClosing | The borrower’s promise to repay, created and signed electronically | Separate from the mortgage or deed of trust that secures the debt |
| MBS issuance | Pooling purchased mortgages into securities | Fannie Mae and Freddie Mac buy, hold or securitize loans |
| Auctions | Foreclosure, tax or voluntary sales | Local and type-specific; not covered here |
Valuation: appraisals, AVMs and waivers
What an appraisal waiver is, and what it is not
An appraisal waiver means the lender’s investor accepts a value without a traditional appraisal. It is a decision about the valuation method. It says nothing about whether the title is clean, and it does not replace a title search or title insurance. The Consumer Financial Protection Bureau’s overview of the mortgage process lists title insurance as its own settlement-related service, apart from appraisals and valuations.

Its 2020 announcement defined an appraisal-waiver disclosure, and a 2023 update described separate categories for waiver-plus-property-data programs. In those programs, property data is collected instead of a full appraisal. A valuation method showing up in a disclosure is a reporting field. It does not mean any given borrower or property is eligible for a waiver.

When the borrower must receive valuation copies
For first-lien loans secured by a dwelling, Regulation B (12 CFR 1002.14) requires the creditor to provide copies of appraisals and other written valuations. The copies are due promptly after completion, or at least three business days before consummation (or account opening), whichever is earlier.
Borrowers can waive the timing requirement under conditions the rule specifies. There is a narrow limit near closing. If a revised valuation arrives inside the three-business-day window, a waiver covers it only when the revision contains clerical changes alone and the earlier version was delivered at least three business days before consummation or account opening.
For covered higher-priced mortgage loans, Regulation Z §1026.35(c) says the Regulation B waiver does not apply to the appraisal-copy timing requirement. The borrower cannot waive that timing on those loans.

Quality control for AI and automated valuation models
“AI” is not a legal category in mortgage valuation. The relevant federal rule is the interagency final rule on quality control standards for automated valuation models, issued by six agencies and hosted by the Federal Housing Finance Agency (FHFA). It covers specified AVMs used in certain credit decisions and securitization determinations for mortgages on a consumer’s principal dwelling. It took effect on October 1, 2025.
The rule requires policies, practices, procedures and control systems that are designed to:
- ensure a high level of confidence in the estimates the model produces;
- protect against manipulation of data;
- seek to avoid conflicts of interest;
- require random sample testing and reviews; and
- comply with applicable nondiscrimination laws.
Accuracy is therefore only one of five themes. The rule applies by transaction and institution. It does not govern every property estimate a website shows, and it does not cover every AI system a lender uses. Compliance questions should be answered from the full rule text, not from this summary.

eNotes and eClosing
FHFA material describes an eMortgage as a loan whose eNote is generated, presented and signed electronically as part of an eClosing. An older FHFA annual report describes the key eMortgage document, the eNote, as being created, executed, transferred and stored electronically. These are explanatory definitions. They are not a full account of electronic-signature law or state recording requirements.

The eNote is only half of the loan paperwork. FHFA’s Your Step-by-Step Mortgage Guide separates two documents:
“The mortgage note is a legal document that provides evidence of your indebtedness and your formal promise to repay the mortgage loan, according to the terms you’ve agreed to.”

The mortgage or deed of trust is the separate instrument that gives the lender a security interest in the property. An eNote digitizes the first; it does not remove the need for the security instrument.

How mortgages become MBS
FHFA explains that Fannie Mae and Freddie Mac buy mortgages from lenders and either hold them or package them into mortgage-backed securities. Lenders can use the sale proceeds to make more loans. That is the main link between a borrower’s closing and the securities market. FHFA also says the common securitization platform supports issuance and administration of the two companies’ single-family securities, including the Uniform MBS (UMBS).

The earlier layers feed into this one. A loan’s valuation method, such as a traditional appraisal or an appraisal waiver, is carried into disclosures on the securities. Investors in an MBS are exposed to the cash flows of the pooled loans, while a lender that keeps a loan in its own portfolio carries that exposure itself.

For scale, an FHFA primer from 2008 reported that MBS sales funded about “three-quarters of the dollar volume of single-family loans,” up from “three-fifths in 2001.” Those figures are historical. They are not today’s market share, and no current share is stated in the sources reviewed here.
Real estate auctions
An auction cannot be explained generically. A foreclosure sale, a tax sale and a voluntary auction follow different rules, and those rules vary by state and sometimes by county. The sources reviewed do not include state-specific auction law, so no bidding steps, deposit rules or redemption periods are given here.
Before you rely on any auction guide, establish three things:
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
- the state and county where the property sits;
- whether the sale is a foreclosure, tax or voluntary auction;
- who holds the right to run the sale, as stated in the official notice.
Auctions also bear on the topics above. Valuation and title questions do not disappear because a sale is fast. As noted earlier, an appraisal waiver says nothing about title, so title status needs separate attention.
Financial literacy resources
No particular financial literacy study is cited in this article. The reliable starting point is FHFA’s mortgage education page. It points to resources on shopping for a home or mortgage, understanding mortgage rules and avoiding foreclosure. The Step-by-Step Mortgage Guide on the same site is useful for learning the vocabulary used throughout this article.
CFPB’s Regulation X (RESPA) overview adds context for the closing process. It lists mortgage applications, origination, title insurance, settlement and closing, escrow and servicing among the process areas. It also lists kickbacks and unearned fees among RESPA subjects.
Quick Recap
A practical checklist
For homebuyers and homeowners
- Ask which valuation method your lender used, and request your appraisal or valuation copy. The timing rules above apply.
- Check whether your loan is a higher-priced mortgage loan. If so, you cannot waive the copy-timing requirement.
- Ask whether your note will be an eNote, and keep the security instrument (mortgage or deed of trust) separate in your mind.
- Treat title insurance and title review as their own line items.
For housing-finance professionals
- Confirm whether a given AVM and transaction fall within the interagency rule’s scope, then map your controls to its five aims.
- Keep valuation-method data accurate, since it appears in MBS disclosures.
- Document the jurisdiction and institution requirements that apply to electronic notes.
- Do not use the 2008 FHFA figures as a current market statistic.
