Mercedes-Benz reached a U.S. consumer-sale milestone in 2023: California authorized the company to sell or lease vehicles with its Level 3 automated driving system, DRIVE PILOT, for use on certain highways. Mercedes announced availability for selected S-Class and EQS Sedan vehicles in California and Nevada. This is conditional automation on approved roads—not a car that can drive anywhere without a driver ready to take over.
What Mercedes-Benz’s “first” milestone means
On June 8, 2023, the California Department of Motor Vehicles (DMV) said Mercedes-Benz was the first company authorized to sell or lease vehicles with an automated driving system to the public in California. The permit applied to designated highways and specified operating conditions; it was not blanket approval for autonomous driving on every road. Mercedes-Benz’s September 27, 2023 U.S. launch announcement named California and Nevada as its initial consumer markets for DRIVE PILOT on selected S-Class and EQS Sedan vehicles. The distinction matters: California’s public-sale authorization and Mercedes’ stated initial markets describe different parts of the rollout. What Level 3 driving means for the person in the car
Level 3 is conditional automation: while the system is active and all its conditions are met, it performs the driving task without the driver continuously steering or watching the road. The human remains the fallback-ready driver and must respond when the system requests a takeover. That is different from treating a car as driverless. Mercedes’ terms require the user to remain properly seated and belted, receptive to prompts, and ready to resume control. Where and when DRIVE PILOT can operate
DRIVE PILOT is restricted to its approved operating domain. Mercedes says the conditions include approved freeways with clear lane markings, moderate-to-heavy traffic below 40 mph, daylight, clear weather, a visible driver, and no construction zone. For California, DMV’s 2023 permit release set a maximum operating speed of 40 mph and limited use to highways in daylight. It excludes city and county streets, construction zones, heavy rain, heavy fog, flooded roads, and other weather that could affect system performance. The California geography named by DMV includes the Bay Area, Central Valley, Los Angeles, Sacramento, San Diego, and Interstate 15 toward Nevada. Mercedes describes availability on major freeways in California and parts of Nevada, subject to areas approved by the relevant regulator. Which cars qualify, and what activation costs
Mercedes’ materials identify the S-Class and EQS Sedan, but do not establish a complete current list of eligible model years and trims. The 2023 launch announcement said hardware was preinstalled on selected vehicles and initial orders would be through participating dealers. The current subscription terms require compatible hardware, cellular activation, and a separate per-vehicle subscription that cannot be transferred. Mercedes announced a starting activation price of $2,500 in September 2023, with activation through the Mercedes me connect Store. What drivers must do before and during use
- Read the vehicle’s instructions and complete the required instructional video before activation; California DMV says the video is mandatory.
- Use DRIVE PILOT only when the system indicates it is available and the road, weather, traffic, daylight, and driver-visibility requirements are satisfied.
- Stay seated and belted, remain receptive to system prompts, and take control as soon as requested.
- If the driver does not respond within the specified period, an emergency-stop procedure begins. Review the vehicle documentation for the instructions that apply to that car.

Mercedes-Benz has separately announced U.S. approvals for automated-driving marker lights in California and Nevada, including a Nevada permit covering Model Year 2026 production vehicles. Those approvals concern exterior lights intended to signal automated-driving operation; they are not a new Level 3 consumer-driving approval or evidence that DRIVE PILOT is broadly available on all vehicles.
