A federal judge temporarily blocked the Trump administration from building a border wall and related infrastructure in Big Bend National Park and the wider Big Bend region on October 2, 2026. The order is a preliminary injunction during an ongoing lawsuit—not a final decision on whether the project or the legal waivers behind it are lawful.
What construction did the judge block?
U.S. District Judge Kathleen Cardone’s October 2 injunction bars federal contractors from continuing construction in the park and surrounding areas while the lawsuit proceeds, according to the Associated Press and The Texas Tribune. The reported scope covers border barriers and related infrastructure across the Big Bend region. The signed order was not available in the cited reporting, so its precise boundaries, exceptions, and operative terms are not established here.
“Border infrastructure” is broader than a wall alone. The federal waiver notice describes a framework that can include physical barriers, roads, project access, earthwork, site preparation, drainage, lighting, cameras, and sensors. The notice also reports more than 89,000 apprehensions in the Big Bend Sector between fiscal years 2021 and 2025; that figure concerns the sector, not Big Bend National Park specifically. Federal Register notice, June 9, 2026.
Why is the construction being challenged?
The lawsuit challenges federal waivers meant to accelerate border construction by setting aside legal requirements. A coalition that includes local landowners, businesses, conservation advocates, and other opponents argues that the project and waivers threaten environmental, historic, religious, and community interests. Those are plaintiffs’ and supporters’ claims in an ongoing case, not findings established at trial. The Texas Tribune.

The dispute therefore involves both the federal government’s authority to use the waivers and the anticipated effects of construction—including impacts on cultural and natural resources, local communities, and recreation. The preliminary injunction does not resolve those underlying questions.
What did the judge say about the case?
The Associated Press reported that Cardone found the plaintiffs were “likely to succeed on the merits of at least one of the claims in suit,” likely to suffer serious irreparable harm without an injunction, and that the balance of equities and the public interest favored them. Those are the reported reasons for interim relief. They do not amount to a final ruling that the government acted unlawfully. Associated Press, October 2, 2026.

How long will construction remain paused?
The available reports say contractors cannot continue construction in the park and surrounding areas until the lawsuit is resolved. They do not establish a specific end date, and the exact terms could depend on the signed injunction or later court action. The signed order and subsequent docket updates are needed to confirm the precise duration, any exceptions, or changes to the pause.
