Utah residents should not assume Stake.us is legal to play just because Utah is absent from Stake.us’s published list of restricted states. Utah law defines gambling and online gambling broadly enough to raise a material question about chance-based play involving something of value and a possible return. Stake’s terms also exclude jurisdictions where applicable law precludes play and place responsibility for checking local legality on the customer. The reviewed sources do not establish a Utah court ruling specifically deciding how Utah law applies to Stake.us’s current model.

Is Stake.us legal in Utah?

There is no clear yes-or-no answer established by the sources reviewed. Utah’s gambling statutes raise a serious legal concern for online play involving chance, something of value at risk, and the prospect of receiving something of value. But those statutory definitions are not the same as a court ruling on Stake.us’s current product or on every individual player’s circumstances.

For a definitive answer about your situation, consult a Utah attorney. Do not treat the platform’s state-list omission as legal permission.

Does Stake.us allow access from Utah?

Stake’s Help Center article, “Restricted states on the platform,” dated July 10, 2026, names Arizona, California, Connecticut, Delaware, Idaho, Illinois, Indiana, Kentucky, Louisiana, Michigan, Maine, Maryland, Montana, Nevada, New York, New Jersey, Pennsylvania, Rhode Island, Tennessee, Vermont, Washington, and West Virginia. Utah does not appear in that list. See Stake’s restricted-states article.

That omission answers only whether Utah appears in the article’s named-state list. Stake’s Terms & Conditions, section 2.1, also cover states or jurisdictions where applicable law legally precludes play, as well as jurisdictions Stake excludes at its discretion. The terms say customers must not reside in or access the platform from an excluded territory, and assign customers responsibility for determining whether sweepstakes play is legal where they live: “It is the sole responsibility of a Customer to determine whether the Sweepstakes is legal and compliant with all regulations in the jurisdiction in which the Customer resides.”

Why Utah law raises a concern

Utah Code § 76-9-1401 defines gambling in terms that include risking something of value for a return, or risking something of value on a chance-based contest, game, scheme, or device with an understanding that someone will receive something of value for a certain outcome. It also defines online gambling to include gambling, fringe gambling, or gaming conducted by internet or mobile device. The code’s definition of fringe gambling addresses de facto gambling, lotteries, and certain gaming devices offered for value or in connection with another purchase, subject to stated exceptions.

Utah Code § 76-9-1404 addresses online gambling promotion, stating: “An actor commits online gambling promotion if the actor intentionally provides or offers to provide a form of online gambling to an individual in this state.” These statutes establish a relevant legal framework, but applying them to particular product features requires legal interpretation and facts. They do not, by themselves, establish that a Utah court has classified Stake.us’s present model.

How Stake.us describes its two play modes

Stake’s terms distinguish between two currencies and play modes. These are the operator’s descriptions, not an independent legal determination of how Utah law applies.

Mode Currency and use, as described by Stake Prize redemption, as described by Stake
Standard Play Gold Coins are virtual social gameplay currency. Stake says Gold Coins have no monetary value and cannot be redeemed for prizes.
Promotional Play / Sweepstakes Stake Cash is described as sweepstakes entries and is used for this mode. Stake says only games played with Stake Cash provide an opportunity to redeem prizes.

Stake’s terms also state that no purchase or payment is necessary to participate and that a purchase does not increase the chances of winning. Those statements describe the operator’s rules; they do not settle whether a specific feature falls within Utah’s legal definitions.

Availability, legal eligibility, and compliant access are different questions

  • Operator availability: Utah is not named in Stake’s July 10, 2026 restricted-states help article.
  • Legal eligibility: Utah law raises a material issue, and Stake’s terms defer to applicable law. The reviewed primary sources do not settle the platform-specific legal question.
  • Access compliance: Stake’s terms prohibit participation from excluded territories and attempts to circumvent location restrictions. The terms prohibit using a VPN, proxy, or similar service to mask or manipulate location.

Stake’s terms require customers to be over 21 or meet any higher minimum legal age of majority in their jurisdiction. Do not use a VPN, proxy, false address, another person’s account, or travel to defeat location restrictions.

What Utah residents should do

  1. Read Stake’s current Terms & Conditions, especially section 2.1, and do not rely on a help-page list alone.
  2. Review the current Utah statutes at the Utah Legislature’s code site if you need to understand the statutory framework.
  3. If you need a definitive answer about whether you may participate, consult a Utah attorney. The published state list and Stake’s descriptions of its play modes are not a legal ruling.

The law and platform terms can change. The Stake help article cited here is dated July 10, 2026, and Stake’s terms list version 18 on that date; check the current versions before relying on them.
