There is no single yes-or-no answer for the whole United States. Stake.us listed 22 states as unavailable on July 10, 2026, and its terms also reserve the right to exclude other jurisdictions. In states it does not list, access is not proof that the service is lawful. State law and regulator positions differ; the available official sources establish an Illinois regulator challenge, not a legal clearance for every other state.
What “legal” means for Stake.us
Three different questions often get collapsed into one:

- Does Stake.us currently allow access from your state? This is the operator’s availability policy, which can change.
- Does your state permit the particular games and prize-redemption mechanics offered? That depends on applicable state law, not just the site’s location settings or terminology.
- Has your state regulator taken a position? An enforcement action can show how a regulator views the service, but one state’s position does not decide the law in every other state.
The sources available for this overview answer the first question with Stake.us’s published restrictions and document an official enforcement position in Illinois. They do not establish an independent state-by-state legal conclusion for all U.S. jurisdictions.

In a Help Center notice dated July 10, 2026, Stake.us listed these 22 states as unavailable:

Check the current list and terms before relying on past availability.
How the site describes its play and prizes
Stake.us distinguishes two forms of play in its terms. The distinction describes the operator’s rules; it does not by itself determine how a regulator or court would classify the activity under a particular state’s law.

The terms place responsibility on customers to determine whether sweepstakes are lawful where they live. That statement is the operator’s position, not a state-by-state legal determination. Stake.us’s policies identify Sweepsteaks Limited, registered in Cyprus, as the owner and operator, and state: “SWEEPSTAKES ARE VOID WHERE PROHIBITED BY LAW.”

What the Illinois Gaming Board said
Illinois is an example of a state regulator taking a public position. In a cease-and-desist letter dated February 4, 2026, the Illinois Gaming Board said it had reason to believe Stake.us was operating an illegal online casino without authorization. The Board said it had observed games offering cash and cryptocurrency, stated that Stake.us was not licensed or authorized by the Board, and demanded that the company block Illinois residents or discontinue cash and cryptocurrency offerings.

- Double check if the URL/website is genuine before entering card details online. Do not provide any gift card details (example: claim code) to someone you do not know or trust. There are a variety of scams in which fraudsters try to trick others into paying with gift cards.
- If you believe that your Card has been lost or stolen, notify Mastercard immediately by calling 1-833-791-7288. You will be asked to provide the Gift Card number and other identifying information.
- Use your Mastercard Gift Card in the U.S. everywhere Mastercard debit cards are accepted, including online. Your Amazon.com Balance cannot be used to purchase Mastercard gift cards.
Board Administrator Marcus D. Fruchter wrote in that letter: “Consequently, Stake (stake.us)’s activity constitutes illegal gambling in violation of Illinois law.” This is the Illinois Gaming Board’s stated position and demand. It is not a court holding, and it does not establish the legal status of Stake.us in other states.
How to check your own state
- Check Stake.us’s current restricted-state notice and terms. The 22-state list here is dated July 10, 2026; it may no longer reflect the operator’s current access policy.
- Look for the relevant state regulator’s position. Identify the regulator responsible for the activity at issue and check for current public notices or enforcement actions. Do not treat another state’s action as a ruling for yours.
- Consider the mechanics, not only the labels. The site’s Gold Coins and Stake Cash terminology explains how it describes its own products, but does not settle how state law applies to play and prize redemption.
- Do not infer legal approval from access. A state’s absence from Stake.us’s restricted list means only that it was not included in that operator notice; it is not confirmation that the activity is lawful there.
If you compare online gaming services
Check each service and state independently rather than assuming a similar “sweepstakes” label means the same thing legally. Useful points to compare are:

- Whether the relevant state regulator authorizes the activity offered.
- How play currencies work and whether, and how, prizes can be redeemed.
- What responsible-play controls the service provides.
Stake.us’s Responsible Play policy describes breaks in play and self-exclusion. It says indefinite self-exclusion has a minimum period of six months; this is a platform-stated control, not a legal guarantee or a substitute for checking state rules.

As of the sources dated July 10, 2026, Stake.us said it did not accommodate players in 22 states and reserved broader exclusions in its terms. Illinois’s gaming regulator separately challenged the service in a February 4, 2026 letter. Neither the operator’s list nor Illinois’s position settles the question for every other state. Treat availability and legality as separate questions, and verify the current terms and your state regulator’s position before playing or attempting to redeem prizes.
