Stake.us does not list Massachusetts among the states it says it cannot accommodate, but that is not the same as government approval. Massachusetts law restricts certain sweepstakes conducted through electronic devices, and the materials available do not show a state court or regulator ruling specifically on Stake.us’s current model. So whether it is lawful for you to play in Massachusetts is not conclusively settled by these sources.
Does Stake.us allow players in Massachusetts?
Stake.us’s help page, dated July 10, 2026, lists states where the platform says it cannot accommodate users. Massachusetts is not on that list (Stake.us restricted states). This describes the operator’s stated availability, not a determination by Massachusetts authorities that the service is legal.
The platform’s terms also exclude jurisdictions where applicable law precludes play, as well as places it excludes at its discretion, and say customers are responsible for determining whether participation is lawful where they are. Read the current Stake.us terms alongside the restricted-states list; either may change.

Massachusetts General Laws chapter 271, section 5B defines a sweepstakes broadly as a game, advertising scheme, plan, or other promotion in which a person may enter or become eligible for a chance-determined prize, whether or not payment is required. The law defines an “entertaining display” to include visual information presented as actual or simulated game play.

Section 5B prohibits knowingly possessing an electronic machine or device with intent to operate it, or putting it into operation, to conduct or promote a sweepstakes through an entertaining display. The prohibition covers the entry process and prize reveal. The statute also contains exceptions, including certain state-authorized gaming and a narrow grocery-retailer discount sweepstakes. See the official text of Massachusetts General Laws c. 271, § 5B.
The Massachusetts Attorney General’s guidance on gaming and 940 CMR 30 describes rules against unfair or deceptive practices that conceal an unauthorized lottery or sweepstakes. Among the factors it identifies are how the business operates, whether the transaction’s main purpose is game play rather than a legitimate purchase, and whether a free-play option exists and how it works.

How does Stake.us describe its games and tokens?
Stake.us calls itself a social casino. Its help materials say Gold Coins have no monetary value and are for play, while Stake Cash are sweepstakes entries that may be redeemed for prizes under the platform’s terms. The platform also describes daily-login token awards and optional Gold Coin bundle purchases that may include Stake Cash. Those are the operator’s descriptions, not independent legal conclusions about how Massachusetts law applies.
The terms say the platform and games do not offer real-money gambling, while also describing Stake Cash as sweepstakes entries and prizes redeemable through promotional play. The difference between an operator’s label and the legal classification of its activity is one reason the platform’s presence on an availability list cannot settle the Massachusetts question.

Has Massachusetts ruled specifically on Stake.us?
The official materials cited here do not establish a Massachusetts court or regulator decision specifically classifying Stake.us’s current sweepstakes model. It would therefore go too far to call Stake.us definitively approved or definitively illegal in Massachusetts based only on the state’s general sweepstakes law and the platform’s own list.
The Attorney General has sent enforcement letters concerning other operators. For example, a letter regarding BetOnline says the office believed that operator offered unlicensed online gambling and betting products in Massachusetts without required Massachusetts Gaming Commission licensing (Massachusetts gaming enforcement letters). That is an example involving a different named operator; it does not determine Stake.us’s status.

Can you use a VPN to access Stake.us from Massachusetts?
No. Stake.us’s terms prohibit participation from excluded territories and expressly bar VPNs, proxies, or similar tools used to mask or manipulate location to evade restrictions. Do not use a location-masking tool or other workaround to get around the platform’s rules.

Under chapter 23N, licensed operators may accept approved sports wagers from people physically located in the Commonwealth through commission-approved mobile applications or digital platforms. This is sports betting under state licensing and rules, not the same product category as Stake.us’s sweepstakes-style social casino.

To check whether a sports-wagering operator is licensed, use the Massachusetts Gaming Commission’s approved sports-wagering operator list and look for the Commission’s official seal. The governing provisions are in Massachusetts General Laws chapter 23N. Confirm current age, location, and other eligibility requirements with the operator and Commission information.
