In the United States, screenshotting a Facebook post and sharing that screenshot are different legal questions. A screenshot can copy someone else’s copyrighted writing, photo, or other creative work. Keeping a copy privately is not the same as publicly reposting it or using it commercially, and there is no blanket rule that makes every screenshot legal—or illegal. The answer depends on what the screenshot contains, how you use it, and the law that applies where you are.
Is it legal to screenshot a Facebook post?
There is no universal yes-or-no answer for every country and every situation. In a U.S.-focused overview, making a screenshot is one act; publishing, distributing, or using that copy is another. The copyright question concerns the material reproduced and what you do with it—not merely the fact that it was displayed on a screen.
A screenshot might contain a short text post, a photograph, an illustration, or several kinds of content at once. Those works may be protected by copyright. The U.S. Copyright Office’s materials describe copyright protection and fair use, but do not establish a general “screenshots are allowed” exception. Fair use is assessed in context; a use does not become fair automatically because it is for criticism, education, news, or only a small excerpt.

Does taking a screenshot differ from reposting it?
Yes. A screenshot saved for your own reference is not the same practical situation as uploading it to your own page, sending it to a large audience, or using it in an advertisement. The possibility of copyright or other legal issues generally becomes more consequential when you reproduce and distribute someone else’s material, but “private” does not itself guarantee that every capture or use is lawful.

These are risk distinctions, not automatic legal outcomes. A public post is not automatically free to reuse, and a private message is not automatically subject to one universal sharing rule. The specific facts and governing law matter.
Can a Facebook post’s contents be copyrighted?
Potentially. Copyright can cover original writing and visual works such as photographs and illustrations. A screenshot may reproduce one or more of those works, even if the post is short or appears in a feed alongside Facebook’s interface.

Meta’s Help Center guidance, titled “How to make sure content you post to Instagram or Threads doesn’t violate copyright law,” warns that posting another person’s content can infringe copyright even if you bought or downloaded it, or recorded it on your own device. Meta recommends getting written permission from the author before posting. That is platform guidance; it is not a court ruling that resolves every possible screenshot use.
Permission is often the clearest practical route when you want to republish someone else’s post or image. Ask the person who holds the relevant rights, describe where and how you plan to use it, and keep a written record of the response. A person who shared a photo may not necessarily own every right in it, so permission from the poster may not settle all rights questions.
Does fair use let you repost a screenshot?
Not automatically. Fair use is a fact-specific U.S. doctrine, not a blanket exemption for screenshots or social-media posts. The U.S. Copyright Office’s Fair Use Index provides information about fair-use decisions; it does not say that a particular category of screenshot use is always permitted.

Calling a use “commentary,” “news,” “education,” or “noncommercial” does not decide the issue by itself. Nor does using only part of a post guarantee that the use is fair. Whether an exception applies requires assessing the particular use under applicable law. If the screenshot is important to an article, campaign, or commercial project, get advice from a lawyer familiar with the relevant jurisdiction rather than relying on a label.

No. Facebook’s terms, content policies, and privacy settings are separate from the laws that may govern copyright, privacy, publicity, or other rights. A platform rule may affect whether content or conduct is allowed on Facebook, or what happens to an account, but it does not by itself determine whether an act is lawful under every applicable law.
Meta’s help material about data scraping and protecting information on Facebook and its U.S. Regional Privacy Notice concern platform privacy and Meta’s handling of personal information. The notice, effective May 23, 2025, is not a complete statement of every user’s legal responsibilities when redistributing another person’s post. Check Facebook’s current terms and help materials for platform rules, but do not treat them as a substitute for legal analysis.

What if the post is private, sensitive, or part of a dispute?
Audience settings and sensitivity can matter to the practical and legal risks, but they do not create a single rule that answers every case. The source material here does not establish jurisdiction-by-jurisdiction rules for privacy, right of publicity, confidentiality, intimate images, harassment, or admissibility of evidence. Those questions can depend on local law and the details of the situation.
- Private or limited-audience posts: Do not assume that being able to view a post means you have permission to publish it elsewhere.
- Intimate or sensitive material: Avoid redistributing it without qualified advice and a clear legal basis. The potential harm can be serious, and laws vary.
- Threats, harassment, or misconduct: If you are preserving a screenshot to report conduct, share it only with appropriate people or channels and consider getting local advice about safe handling.
- Potential litigation: If a screenshot may be evidence, ask a lawyer in the relevant jurisdiction how to preserve and use it. Do not assume a screenshot alone proves context or authenticity.
Is the DMCA permission to screenshot posts?
No. The Digital Millennium Copyright Act is not a general permission to copy or repost Facebook content. The U.S. Copyright Office explains that the DMCA addresses important parts of online copyright, including notice-and-takedown mechanisms, certain access-control rules, and copyright-management information. Those subjects do not amount to a blanket screenshot exception.

A practical decision checklist before sharing a screenshot
- Identify what you copied. Is it someone’s original writing, photograph, illustration, or a mix? Consider whether anyone besides the poster may hold rights in the material.
- Decide what you will do with it. Retaining a record, sending it privately, publishing it publicly, and using it commercially are different uses; do not treat them as interchangeable.
- Check permission and exceptions. If you plan to publish, ask the rights holder for written permission where possible. Do not assume fair use applies without a fact-specific assessment.
- Consider privacy and harm separately from copyright. Audience settings, personal information, sensitive content, and the circumstances of capture may raise issues that copyright alone does not answer.
- Check the relevant jurisdiction. If the use is commercial, sensitive, contested, or likely to become evidence, consult a lawyer qualified where the relevant people and events are located.
