No—High 5 Casino’s Sweeps Play is not available while you are physically in New York. High 5 lists New York as a restricted state and says it uses geolocation to block access from restricted locations. Separately, New York law prohibits certain online sweepstakes games that combine dual currency, casino-style play, and a chance to win cash or cash equivalents. High 5’s state restrictions and New York Racing, Pari-Mutuel Wagering and Breeding Law § 912 support that answer.
What “not available” means for High 5 Casino
High 5’s current restrictions page names New York as a state where Sweeps Play is unavailable. The operator says geolocation blocks access from restricted states, so being a New York resident is not the only relevant consideration: the stated restriction applies when a user is located in New York. Check High 5’s current state restrictions before relying on availability, because operator rules can change.
High 5’s terms describe its service as not offering “real money gambling.” That is the operator’s description, not a legal determination, and it does not override the New York restriction or make Sweeps Play available in the state. High 5’s Terms of Use were updated June 26, 2026.

High 5’s help information distinguishes its free-to-play Classic mode from Sweeps Play. Do not treat availability of one mode as proof that the other is available. Confirm the rules and access conditions for the specific mode in High 5’s current terms and help pages.

What New York law prohibits
New York Racing, Pari-Mutuel Wagering and Breeding Law § 912 defines an “online sweepstakes game” by specific features: it is played online or on a mobile device, uses a dual-currency system, simulates casino-style gaming, and allows exchange for or a chance to win cash or cash equivalents. The statute makes it unlawful to operate, conduct, or promote games meeting that definition in New York. It also prohibits specified entities, including platform providers and media affiliates, from supporting those activities.
The law does not say that every free casino-style game is prohibited. Its definition turns on the dual-currency and cash or cash-equivalent prize elements as well as simulated casino play. The statute leaves the State Gaming Commission to determine what constitutes a dual-currency system. The New York Senate’s announcement says games without cash-redeemable rewards are unaffected. See the statute and the Senate announcement of the law.

Enforcement and penalties
Section 912 provides for fines of $10,000 to $100,000 per violation and authorizes enforcement by the Gaming Commission, State Police, or Attorney General’s office. The statute’s latest revision shown is December 12, 2025. These are statutory consequences; they are not a statement that an individual player faces those fines simply for visiting a site.
Why High 5 restricted New York
On June 6, 2025, New York Attorney General Letitia James announced that 26 sweepstakes casino platforms were ending sales of sweepstakes coins in New York after receiving cease-and-desist letters. High 5 Casino was among the named platforms. The Attorney General described the state’s position that wagering cash-redeemable virtual coins on games of chance constitutes gambling regardless of how operators characterize the way the coins are obtained. The Attorney General’s announcement provides that enforcement history.

New York enacted Chapter 605 in December 2025, formalizing the prohibition in § 912. The current statute and High 5’s own state-restriction page establish the present answer; the 2025 enforcement action explains how the restriction developed. No court ruling specific to High 5 is needed to establish that its operator currently lists New York as restricted.

What to do if you are in New York
- Do not assume that High 5’s “not real money gambling” wording makes Sweeps Play lawful or accessible in New York.
- Check High 5’s current restrictions and the terms for the particular mode you intend to use; Classic and Sweeps Play are distinct.
- Do not try to bypass a location block. High 5 says it blocks restricted-state access, and masking your location would not change the applicable law.
- For legal questions about your circumstances, consult a qualified New York attorney or the relevant state authority.
