In the United States, emulator software is not automatically illegal—but owning a game does not automatically make every ROM download or copy-protection bypass lawful. The legal questions differ depending on what was copied, how it was obtained, and whether a technological measure was circumvented.
Why “Is emulation legal?” has more than one answer
Emulation is software that imitates another device so software made for that device can run elsewhere. The emulator program, a console’s BIOS or firmware, a game file, and a security key are different materials. Creating or using an emulator does not by itself answer whether copying or distributing any of those materials infringes copyright.
For a specific situation, separate three questions: what material was copied, how it was copied or shared, and whether someone bypassed a technological measure. A lawful answer to one does not automatically settle the others.

Does owning a cartridge make downloading its ROM legal?
Not automatically. A ROM is a copy of game software; owning the physical cartridge does not, by itself, establish that a particular downloaded file was authorized or that its copying and distribution were lawful. The source of the file and the acts of making, downloading, and sharing it matter.

The legal sources cited here do not settle every personal-backup or format-shifting scenario. So it would be too broad to say either that owning a cartridge always makes downloading its ROM legal or that every personal copy is necessarily unlawful. The case about emulator development discussed below does not authorize ROM sites or decide every owner-made copy scenario.
What does the Connectix decision say about making emulators?
In Sony Computer Entertainment, Inc. v. Connectix Corp., the Ninth Circuit considered Connectix’s intermediate copying of Sony PlayStation BIOS software while it reverse-engineered the system to develop its Virtual Game Station emulator. The court found that the intermediate copying at issue was fair use under the circumstances described in its opinion. Read the Ninth Circuit opinion.

The decision supports the narrower point that developing an emulator is not automatically copyright infringement. It is not blanket permission to copy protected code into an emulator, distribute BIOS or firmware, or copy and distribute game files. Nor does it establish that every kind of reverse engineering is fair use: the holding was tied to the copying and facts before the court. It is a Ninth Circuit appellate decision, not a nationwide Supreme Court ruling, and other jurisdictions may apply different law.

Copyright infringement and anti-circumvention are distinct legal questions. Even when someone argues that a copy would not infringe copyright, bypassing a technological measure may raise a separate issue under Section 1201 of the Digital Millennium Copyright Act (DMCA).

The U.S. Copyright Office says Section 1201 “generally makes it unlawful to circumvent technological measures used to prevent unauthorized access to copyrighted works,” including games and computer software. The Office’s explanation of the 2024 Section 1201 proceeding describes the rule; Chapter 12 of Title 17 contains the statutory text.
Section 1201 includes exceptions and periodically adopted exemptions for specified activities. Those exemptions are limited by their wording and conditions, not a general emulator or personal-backup license. The current text of the triennial exemptions is the relevant place to check whether a particular activity is covered. Owning a game, standing alone, should not be treated as an automatic exemption from the anti-circumvention rules.

What the 2024 Yuzu judgment establishes
Nintendo sued Tropic Haze, the company behind the Yuzu emulator. The case concluded in March 2024 with a consent judgment and permanent injunction concerning Tropic Haze, Yuzu, and specified circumvention materials. The judgment and injunction bind the parties and other persons as specified in the order.
Because the case ended in a consent judgment, it should not be described as a trial or appellate ruling that all emulators are unlawful. It is a significant result in a dispute involving Yuzu and the conduct addressed by that order, but it does not decide every emulator’s design or every user’s actions.

How to assess a particular emulator setup
There is no reliable one-word verdict based only on the fact that a game owner uses an emulator. These distinctions identify the facts that matter without treating them as a substitute for advice about a specific case.
- Identify the material. Emulator code, BIOS or firmware, game software, and keys are not interchangeable. Ask what was copied, distributed, or obtained.
- Trace the copy. A temporary copy made during reverse engineering is different from obtaining a playable game file online or distributing one to others. Consider the source and the copying or sharing that actually occurred.
- Check for circumvention separately. If a technological measure was bypassed, assess that conduct under Section 1201 independently of the copyright question, including whether a specific current exemption applies.
- Account for location. The Connectix decision is Ninth Circuit authority. U.S. law may differ by jurisdiction and is not a universal rule for other countries.
What Nintendo says—and what that statement is
Nintendo’s support FAQ says unauthorized emulators can encourage use of unauthorized game copies and that some circumvent game security measures.
