No reviewed Australian law or bill establishes a general ban on VPNs to stop people accessing Hulu or Netflix. The headline appears to mix up three separate issues: court-ordered blocking of some copyright-infringing websites, platform measures intended to enforce age restrictions, and Australian-content rules for large streaming services. Each has a different purpose, and none amounts to a general prohibition on VPN use.

Does a new Australian bill outlaw VPNs?

That claim is not substantiated by the Australian legislative and regulator sources reviewed as of 4 October 2026. The current law provides a process for a Federal Court to order internet providers to take reasonable steps to block specified domain names, URLs or IP addresses associated with a qualifying online location. It does not establish a general ban on owning or using a VPN. The current Copyright Act compilation sets out that site-blocking mechanism.

The legal distinction matters: an order can target access to a specified online location through a carriage service provider. That is not the same as making VPN services illegal or prohibiting every use of a VPN. The exact publication behind the headline has not been verified, so it would be misleading to treat the headline’s account of a new bill as established fact.

What Australian copyright site-blocking law does

The Copyright Act allows copyright owners to seek a Federal Court injunction requiring a carriage service provider to take reasonable steps to block access to qualifying online locations. The mechanism concerns specified sites or network addresses, rather than a general restriction on privacy tools.

This framework has a history. The Parliament’s record of the Copyright Amendment (Online Infringement) Bill 2015 describes that measure as enabling copyright owners to apply for orders to block access to certain offshore online locations. It is historical context, not evidence of a newly introduced VPN bill.

Why VPNs appeared in the 2015 debate about Netflix

During discussion of the 2015 bill, concerns were raised that a court might consider VPN websites to facilitate copyright infringement in some circumstances. Then-Communications Minister Malcolm Turnbull addressed a narrower example: someone using a VPN to access Netflix in the United States to watch content not licensed for Australia.

As quoted in parliamentary committee material, Turnbull said the bill would not cover that scenario because the US Netflix service could not be said to have copyright infringement, or facilitating it, as its primary purpose. That was a statement about the test in a particular 2015 bill. It is not a definitive ruling on all current copyright law, streaming-service terms, or VPN use.

Why VPN detection is discussed in current Australian policy

More recent Australian discussions of VPN detection relate to platform compliance with age-related rules, not to a bill banning VPNs for streaming piracy.

Age assurance and online safety codes

A Department of Infrastructure briefing dated 24 September 2025 describes VPN detection and geolocation enforcement as tools used in video streaming and discusses Netflix’s use of VPN detection in an age-assurance context. The department’s released briefing does not establish a general prohibition on VPN services.

TechRadar reported on 13 July 2026 that documents obtained under freedom-of-information laws described VPN detection as a reasonable step for service providers implementing online safety codes. That concerns how platforms may enforce obligations; it does not show that a bill outlaws VPNs to prevent Hulu or Netflix piracy. Read the report.

Under-16 social-media restrictions

A separate age-related discussion concerns Australia’s under-16 social-media restrictions. TechRadar reported on 3 December 2025 that eSafety guidance expected affected platforms to try to stop users from using VPNs to appear to be outside Australia. The report discusses possible IP and location signals as well as their limitations and potential collateral effects. This is about how platforms might enforce age rules, not a ban on VPN providers or a copyright-blocking order. Read the report.

Australia’s streaming-content law is a separate matter

Australia also has rules requiring major subscription video-on-demand services to meet Australian-content obligations. The Australian Communications and Media Authority (ACMA) says the laws were introduced on 27 November 2025. They apply to services with at least one million Australian subscribers, while services above 250,000 subscribers also have obligations. Netflix is listed among the services with at least one million Australian subscribers for the 2026 reporting year. Those are regulatory thresholds, not figures about VPN use or piracy.

The first annual reports under the 2026 reporting cycle are due 15 February 2027. ACMA’s subscription video-on-demand guidance describes these requirements. They concern Australian content on streaming services, not VPN prohibition or copyright site blocking.

What this means for viewers

  • VPN legality: The sources reviewed do not establish a new bill making VPNs generally illegal in Australia.
  • Copyright enforcement: Australian law provides for court-ordered blocking of qualifying online locations through carriage service providers.
  • Age-rule enforcement: VPN detection is part of a separate discussion about how platforms may comply with age-related requirements.
  • Streaming obligations: The 2025 SVOD law sets Australian-content obligations for covered services; it is not a VPN ban.
  • Geo-restricted streaming: The 2015 parliamentary comments about US Netflix were historical and addressed a specific bill’s test. They should not be read as a blanket statement about current law or a service’s terms.

The reviewed material does not substantiate a named statistic measuring VPN-based Hulu or Netflix piracy, or show that a proposed Australian bill responds to such a figure.
