Indian versus overseas SaaS does not, by itself, determine the GST result. The decisive facts are who supplies the service, where the supplier and customer are located, the customer’s tax status, the place of supply, and whether the transaction qualifies as an import or export of services.
For an Indian business, the practical split is between an Indian supplier billing an Indian customer, an overseas supplier billing an Indian customer, and an Indian supplier billing a customer outside India. Each route has different tax, reverse-charge and invoice-documentation questions.
The three SaaS transactions businesses must distinguish
“Indian SaaS” and “overseas SaaS” are commercial descriptions, not complete GST classifications. Start by mapping the legal supplier and recipient for the specific subscription or bundle. Then determine the place of supply and whether the service is an import, an export or a domestic supply.
| Transaction | Supplier and recipient | GST question | Invoice focus |
|---|---|---|---|
| Indian-to-Indian | Supplier in India; business customer in India | Usually a domestic taxable supply, subject to classification and the applicable place-of-supply rule. | Tax invoice, tax rate and amount, supplier and customer identifiers, place-of-supply details where applicable, and reverse-charge indication if relevant. |
| Overseas-to-Indian | Supplier outside India; Indian business customer | May be an import of services on which the Indian recipient pays IGST under reverse charge when the statutory conditions are met. | Foreign supplier invoice plus the Indian recipient’s reverse-charge records and tax documentation. |
| Indian-to-overseas | Supplier in India; customer outside India | Can be a zero-rated export only if every statutory export condition is satisfied. | Export endorsement and evidence supporting the selected zero-rated route. |
The Central Board of Indirect Taxes and Customs (CBIC) publishes the sectoral FAQ and statutory material used to apply these distinctions. The FAQ is available at CBIC’s Sectoral FAQs, and the governing integrated-GST material is on the IGST Act page.

What GST rate applies to SaaS?
CBIC’s Sectoral FAQs state: The rate of GST on IT services is 18%.
That is the official FAQ’s stated rate for IT services; it is not a blanket answer for every product that a vendor markets as SaaS. A subscription can include software access, implementation, consulting, support, training, advertising or other elements. The classification of the actual supply should be reviewed before applying a rate.
Use the 18% figure as an identified CBIC position for an IT-services classification, not as permission to ignore the facts of a bundled contract. The FAQ page does not state a publication year, so a live transaction should be checked against the current notified rate and classification.
Indian supplier billing an Indian business
When a domestic tax invoice is generally required
CBIC’s invoice rules generally require a registered supplier of taxable services to issue an invoice within 30 days from the date of supply. The exact timing can have exceptions, so the supplier should check the current rule text for its registration and transaction type. The rules are published at CBIC’s Tax Invoice, Credit and Debit Notes page.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsA SaaS supplier should make the invoice identify the legal supplier and customer, describe what was supplied, show the value and applicable tax rate and amount, and include the relevant place-of-supply and reverse-charge fields. The invoice number must be unique within the supplier’s numbering system and the invoice must carry its date.
Domestic invoice checklist
- Supplier’s legal name, address and GSTIN.
- A unique serial number and invoice date.
- Customer name and address, and GSTIN or other recipient information where the rules require it.
- A description that explains the subscription period, user or account scope and any separate implementation or support items, rather than an unexplained “SaaS fee.”
- Taxable value, tax rate and tax amount.
- Place of supply, including the State name for an inter-State supply where applicable.
- An indication of whether tax is payable under reverse charge, when that provision applies.
- Payment terms and a reference to the contract or purchase order, if used by the parties’ controls.
The invoice should match the commercial reality. If a customer receives a one-year subscription but is billed monthly, each invoice should identify the relevant billing period. Credit notes, cancellations, upgrades and downgrades should be reconciled to the original invoice rather than left as unexplained net adjustments.

What the Indian customer should verify
- Confirm that the supplier name, GSTIN and legal contracting entity match the purchase order and vendor master.
- Check the service description, service period, taxable value and tax calculation against the subscription agreement.
- Confirm that the place-of-supply treatment is consistent with the customer’s registration and the transaction’s inter-State or intra-State character.
- Check whether the invoice marks reverse charge. Do not assume that a field left blank means the transaction is outside GST.
- Retain the invoice, agreement, renewal notices, payment evidence and credit notes together so the tax position can be reconstructed later.
Overseas supplier billing an Indian business: import and reverse charge
When reverse-charge IGST may apply
CBIC’s import-of-services FAQ describes a reverse-charge outcome where the supplier is outside India, the recipient is in India and the place of supply is in India. The Indian recipient, rather than the foreign supplier, may have to pay IGST under reverse charge when the statutory conditions are satisfied. The result must be tested against the actual supplier, recipient and place-of-supply facts.
The FAQ’s stated example also makes clear that paying the foreign supplier in Indian rupees does not, by itself, remove the import-of-services analysis. Currency is not a substitute for the statutory tests.

- Identify the contracting supplier. A local reseller, an Indian subsidiary and a foreign parent can produce different documentation and place-of-supply questions. Use the entity named in the order form and invoice, not merely the brand shown in the application.
- Identify the recipient. Establish which Indian legal entity receives the service and whether it is registered or otherwise treated as a business recipient for the relevant provision.
- Determine the place of supply. The IGST Act contains general and special rules. Do not infer the answer solely from the supplier’s country or the location of the software’s servers.
- Test import conditions. If the supplier is outside India, the recipient is in India and the statutory place-of-supply conditions point to India, assess reverse-charge IGST and the associated return and accounting requirements.
- Preserve evidence. Keep the foreign invoice, contract, user or account records, payment record, tax calculation and any documentation supporting the place-of-supply conclusion.
Foreign invoices and Indian tax records
A foreign supplier’s invoice will not necessarily contain every field required on an Indian GST tax invoice. The Indian buyer should not rewrite the supplier’s document as if it were an Indian-issued invoice. Instead, retain the original commercial invoice and create the Indian reverse-charge documentation required by the current rules and the buyer’s accounting controls.
The record should make the tax logic auditable: supplier location, recipient location, service description and period, consideration, exchange-rate method where a conversion is needed, place-of-supply analysis, IGST amount, payment date and the return in which the liability is reported. Confirm the current notified procedure before filing.
OIDAR: why online software can have special rules
The IGST Act’s definition of online information and database access or retrieval services (OIDAR) includes the provision of software and other intangibles through the internet or an electronic network. A cloud application delivered electronically can therefore require an OIDAR analysis rather than a casual assumption that it is an ordinary offline service. See the IGST Act material and CBIC’s OIDAR explainer.

CBIC distinguishes supplies by a foreign OIDAR provider to an Indian business recipient from supplies to a non-taxable online recipient. The reverse-charge description for a business recipient and the collection or registration treatment for a non-taxable online recipient are not interchangeable. Before deciding who must collect or remit tax, establish the customer’s status and apply the rule for that type of recipient.

Questions to ask for an OIDAR review
- Is access delivered automatically over the internet or an electronic network, with little or no human intervention?
- Is the supplier actually outside India, or is an Indian entity the contracting and invoicing party?
- Is the customer an Indian business recipient, a registered person, or a non-taxable online recipient under the applicable provision?
- Which place-of-supply rule applies to this customer and service?
- Do the invoice and customer-location records support the conclusion?
Indian SaaS supplier billing an overseas customer
When an Indian SaaS sale can be zero-rated
Qualifying exports of services are zero-rated. A foreign customer alone does not prove that a subscription is an export; every statutory export condition must be satisfied. The supplier should test the parties’ locations, the place of supply, consideration and any establishment-related condition under the current law. The relevant statutory framework is on CBIC’s IGST Act page.
Zero-rated treatment is different from saying that no documentation is needed. The supplier must be able to show why the service qualifies and which zero-rated route it selected. A customer’s overseas email domain, foreign currency payment or foreign billing address may support the file, but none of those facts alone replaces the statutory test.
The two routes described by CBIC
| Route | How tax is handled | What the supplier seeks |
|---|---|---|
| Export on payment of IGST | Charge and pay IGST on the export supply. | Refund of the eligible IGST, subject to the applicable refund procedure. |
| Export under bond or LUT without payment of IGST | Supply without payment of IGST under the applicable bond or letter of undertaking. | Refund of eligible input tax credit, subject to the applicable requirements. |
The commercial choice between these routes affects cash flow, paperwork and refund timing. It should be made with the supplier’s registration, credit position and current procedural requirements in mind.
Required export endorsement
CBIC’s invoice rules prescribe an endorsement for export service invoices. Use the wording that corresponds to the route actually used:

- “SUPPLY MEANT FOR EXPORT ON PAYMENT OF IGST”
- “SUPPLY MEANT FOR EXPORT UNDER BOND OR LETTER OF UNDERTAKING WITHOUT PAYMENT OF IGST”
Do not place both endorsements on one invoice or use the LUT wording when the supply was made on payment of IGST. The export invoice should also carry the ordinary supplier, recipient, service, value and invoice-identification particulars required by the rules.
Invoice comparison: what changes by transaction
| Invoice or record element | Indian supplier to Indian business | Overseas supplier to Indian business | Indian supplier to overseas customer |
|---|---|---|---|
| Supplier identity | Indian legal name, address and GSTIN. | Foreign supplier’s legal identity and original invoice details; Indian recipient keeps reverse-charge records. | Indian supplier’s legal name, address and GSTIN. |
| Customer identity | Indian recipient details and GSTIN where required. | Indian recipient’s legal entity and registration status. | Overseas recipient’s legal name and location details supporting export analysis. |
| Tax treatment | Applicable domestic GST treatment after classification and place-of-supply review. | Potential IGST under reverse charge when import conditions are met. | Zero-rated only after all export conditions are met; choose payment-of-IGST or bond/LUT route. |
| Place of supply | Show the relevant place-of-supply information, including State name for an inter-State supply where applicable. | Document why the place of supply is or is not in India. | Document the place of supply and the statutory export conclusion. |
| Special wording | Reverse-charge indication if applicable. | Indian reverse-charge tax record; foreign invoice may not contain Indian fields. | One of CBIC’s two prescribed export endorsements, matching the route used. |
A practical GST workflow for SaaS procurement and billing
For a business buying SaaS
- Capture the legal entities before purchase. Save the order form, terms, invoice and the name of the entity that will actually charge the card or bank account.
- Classify the service. Separate software access from implementation, consulting, support, training or other line items where the contract does so.
- Determine the customer category. Record whether the recipient is an Indian business and whether it is registered, because OIDAR and reverse-charge treatment can differ by recipient type.
- Determine place of supply. Apply the relevant IGST Act rule; do not use the supplier’s headquarters or payment currency as a shortcut.
- Check for import treatment. For a foreign supplier and Indian recipient, assess reverse-charge IGST when the statutory conditions point to an import.
- Build the audit file. Keep invoices, contracts, user evidence, payment records, exchange-rate support and the tax calculation together.
- Reconcile renewals. Recheck the contracting entity, price, service scope and tax treatment when a subscription renews or changes plan.
For an Indian SaaS supplier selling abroad
- Confirm the overseas customer’s legal identity and location.
- Test every statutory export condition for the actual service and customer relationship.
- Select payment of IGST with refund or supply under bond/LUT without payment of IGST, based on the applicable procedure.
- Put the corresponding export endorsement on every relevant invoice.
- Retain contracts, customer-location evidence, payment records and refund-supporting documents.
- Reassess the position if an Indian affiliate, reseller, local establishment or intermediary becomes involved.
Common mistakes and how to correct them
“The supplier is foreign, so there is no Indian GST”
A foreign supplier can create an import-of-services reverse-charge issue for an Indian recipient. Rework the analysis using supplier location, recipient location and place of supply.
“We paid in rupees, so it is not an import”
CBIC’s FAQ expressly says that rupee payment does not change the conclusion in its stated import example. Currency should be recorded, but it is not the deciding test.
“Every SaaS invoice is 18%”
CBIC states 18% for IT services in its FAQ. A bundle still needs classification review, and the current notified position should be checked for the actual supply.

“The vendor’s PDF contains everything GST requires”
Foreign invoices often follow the supplier’s home-country format. For a potential import, preserve that invoice and create the Indian reverse-charge records required by the current rules.
“OIDAR means the same rule applies to every online customer”
CBIC distinguishes business recipients from non-taxable online recipients. Confirm the customer category before deciding who accounts for tax.
“We can use either export endorsement”
The endorsement must match the route actually used: payment of IGST or bond/LUT without payment. Correct an inconsistent invoice through the applicable document process rather than leaving contradictory records.
Keeping the position current
CBIC’s statutory pages and FAQs are official sources, but consolidated pages and explanatory material can lag later amendments. Before applying this guidance to a live subscription, check the current notified GST rules, rate and classification, the latest place-of-supply provisions, refund procedure and any transaction-specific exception.
This framework is designed to help a business ask the right questions. It does not determine the classification of a particular SaaS bundle, the parties’ exact registrations or a customer’s OIDAR status. Those facts can change the result and should be reviewed by the business’s tax adviser.
