The Income Tax Department has appealed to the Income Tax Appellate Tribunal (ITAT) in New Delhi against tax relief granted to Dr Lal PathLabs over ₹32,66,18,927 in employee stock option (ESOP) expenses for Assessment Year 2022–23. The appeal challenges a Commissioner of Income Tax (Appeals) order; the report does not say that ITAT has ruled on the matter.
What is the dispute about?
The case concerns ₹32,66,18,927 in ESOP expenses—about ₹32.66 crore—that had been disallowed. The Commissioner of Income Tax (Appeals), in an order under Section 250 of the Income Tax Act, 1961, granted Dr Lal PathLabs relief against that disallowance for Assessment Year 2022–23.
The department is now challenging that relief before ITAT, New Delhi. The reported amount is the expense at issue, not a final tax liability or an amount the company has been ordered to pay.

Has ITAT ruled, and what happens next?
The report confirms that an appeal was filed, but it gives no ITAT decision, appeal number, listing information, or hearing date. It also does not provide the department’s detailed grounds of appeal or the CIT(A)’s reasoning for granting relief. The outcome therefore cannot be determined from the reported information.

The company said it “does not reasonably expect the outcome of the appeal to have any material impact” on it. This is the company’s assessment, not a tribunal finding or a prediction of the appeal’s outcome.
