The October 3 report says police arrested 25-year-old Samuel Reveron Ascanio on September 24 after a 911 caller reported three men emerging from a manhole near Park Avenue and East 61st Street at about 4:30 a.m. It identifies Kevin Rodriguez as the second person charged and says a third man remained at large. It says a federal warrant had been issued two days before that incident in connection with a separate September 20 arrest over alleged criminal mischief involving parts removed from a U-Haul van in Queens. Those warrant and charging details are attributed to an ICE spokesperson and police sources; the underlying records were not available in the cited reporting.

Why the judge released him—and what is disputed

ICE Enforcement and Removal Operations New York City Field Office Director Kenneth Genalo criticized the release, saying: “New York City had a clear opportunity to transfer this individual to ICE in a secure, controlled environment.” He added: “Instead, the city recklessly released him despite his repeated arrests and unresolved criminal charges — a choice that needlessly returned an alleged public-safety threat to the streets.” These are ICE’s characterizations, not court findings. How this fits earlier New York sewer sightings
Earlier reports document separate incidents, but do not establish that the people involved shared a purpose or were connected to Ascanio. An Associated Press report published June 3, 2026 described at least three nighttime instances captured on security cameras in Brooklyn and Queens. One Williamsburg video showed roughly seven people emerging into an intersection; a Gravesend video showed another group emerging after police said they had entered around 11 p.m.; and a May 5 Queens video showed three people in waterproof gear opening and entering a maintenance hole. NYC’s Department of Environmental Protection said it inspected the two Brooklyn locations and found no infrastructure damage. A September 23 local report described three people seen emerging around 4:35 a.m. near Park Avenue and East 61st Street, a block from a hotel where Israeli Prime Minister Benjamin Netanyahu was expected to stay. At that point, the report said no arrests had been made and authorities had not stated what the people were doing underground. The October 3 account later described arrests tied to a September 24 incident, so the two reports reflect different dates. The earlier report said there was no evidence of a terrorist connection. Are sewer explorers a security threat?
The reports establish that people were seen entering or emerging from sewer infrastructure in several incidents; they do not establish a single motive, coordinated activity, or a terrorist link. The valuables explanation in the Manhattan case is attributed to the complaint as described by the October 3 report. Earlier sightings were described variously as possible scavenging or urban exploration, without a publicly established common explanation in the cited accounts.
