Under the federal Title IX procedure established by the 2020 regulations, a formal complaint can trigger a structured process that includes an investigation, evidence review, and—at a postsecondary institution— a live hearing with advisor-led relevant cross-examination. The steps and timing depend on the applicable rules and the college’s policy.
What happens after you report sexual assault to a college?
A report gives the college notice of what was reported. Under the Department of Education’s description of Title IX, when a covered school has actual knowledge of sexual harassment in a U.S. program or activity, it must respond promptly in a way that is not deliberately indifferent. The Title IX Coordinator should explain supportive measures and how to file a formal complaint. Supportive measures may be available whether or not a formal complaint is filed.

A report is not automatically a formal complaint
A report can lead to contact from the Title IX office and a discussion of support and reporting options. A formal complaint is the step that starts the federal grievance procedure described in the 2020 regulations. Ask the Title IX Coordinator which route applies to your situation and what the college’s written policy requires.

Ask the coordinator what supportive measures are available, how to request them, and who will receive information about your report. The sources described here do not establish a promise of absolute confidentiality; the school’s obligations and ability to investigate depend on the circumstances and applicable policy. What is the Title IX investigation process?
The following is a simplified outline of the federal procedure under the 2020 regulations. It applies only when that procedure governs the matter; a college’s current policy and the specific facts determine which rules apply. The investigation is intended to gather and assess information, not to presume either party’s responsibility.
- Written notice: The school gives written notice of the allegations and the grievance process.
- Investigation: The school investigates, with an adequate, reliable, and impartial process. The parties have an opportunity to present witnesses and other evidence.
- Evidence review: Before the investigative report is completed, each party gets an equal opportunity to inspect and review evidence directly related to the allegations and may submit a written response.
- Investigative report: The school prepares a written report for the next stage of the process.
- Live hearing at a postsecondary institution: Under the 2020 federal procedure, each party’s advisor may ask the other party and witnesses relevant questions, including cross-examination. If a party does not have an advisor, the school must provide one for that purpose. The decision-maker determines which questions are relevant.
- Written determination and appeal opportunity: The decision-maker issues a written responsibility determination, and the procedure provides an opportunity to appeal.
The 2020 regulations also restrict reliance on statements from a person who does not submit to cross-examination at the hearing, subject to the regulation’s conditions. The hearing format and safeguards described here should not be assumed to apply to every other campus disciplinary process.
What evidence can be used in a college investigation?
Potentially relevant information may include the parties’ accounts, witness accounts, and documentary or other material connected to the allegations. The federal framework emphasizes an impartial investigation and a fair opportunity for both parties to present evidence and respond to relevant evidence. It does not mean that any particular item will be admitted or decisive; that depends on the applicable policy, procedural rules, and case facts.
During a process governed by the 2020 regulations, the parties’ equal opportunity to inspect and review evidence directly related to the allegations occurs before the investigative report is completed. They may submit written responses. At a postsecondary hearing under that procedure, the decision-maker evaluates relevance and the advisor-led questioning rules apply.
How long does a Title IX investigation take?
There is no universal number of days that applies to every college investigation. The Department of Education’s Office for Civil Rights (OCR) calls for designated, reasonably prompt timeframes for major stages, while its guidance explains that resolution time can vary with the complexity, severity, and extent of the alleged harassment. The college’s published policy is the place to check its target durations and any extension provisions.
Keep that campus schedule separate from OCR’s external complaint deadline: OCR says a complaint generally must be filed within 180 days of the incident, and a person does not have to first use the school’s grievance procedures. That 180-day period concerns the external OCR route; it is not a deadline for a college to finish its investigation. Verify current filing instructions and any case-specific rules with OCR.

These routes are distinct. The federal Title IX framework described here does not establish the procedures or outcomes for a police investigation, nor does it evaluate any particular college’s policy.
Which Title IX rules apply now?
The legal framework is time-sensitive. The Department of Education says a federal district court vacated the 2024 Title IX Final Rule on January 9, 2025, and identifies the 2020 regulations as the basis for OCR enforcement. That does not by itself establish which procedure a particular college applies to every matter. Check the institution’s current written policy and any applicable institution-specific or state-law requirements, especially before relying on a hearing, evidence, or appeal rule.
What should you ask the college?
The Title IX Coordinator or the institution’s written policy can clarify how the rules apply in a specific case. Useful questions include:
