An influencer’s gambling post is likely advertising when there is a commercial arrangement behind it—such as payment, a free benefit, ownership, or an affiliate link or code that earns commission—and the post promotes or refers to the gambling service. Look for a clear disclosure beside the endorsement and, in video or livestreams, within the content itself. The legal test depends on where the influencer and audience are located; the FTC guidance below is for the United States, while the CAP and Gambling Commission rules are UK examples.
How to check whether a gambling post is an ad
Use these signals together. A promotional tone alone does not prove that an influencer was paid, and a missing disclosure does not prove there was no commercial relationship. The strongest indicator is a benefit or business arrangement connected to the post.
- Check for a commercial relationship. Did the influencer receive money, a free or discounted product or service, a job or other business benefit? Do they own the gambling business or have a personal, family, or employment connection that could affect how viewers assess the endorsement? The FTC says material connections should be disclosed. - Look for a commission link or code. A personalized referral link or promo code may earn the creator commission when people sign up or make a transaction. Under UK ASA/CAP guidance, that arrangement makes the influencer an advertiser, and content referring to the linked product counts as advertising. ASA/CAP advice on recognizing social media ads.
- See what the post asks viewers to do. A direct invitation to sign up, place a bet, or use an offer is a promotional signal. In Great Britain, gambling rules also cover third parties, including affiliates, acting on an operator’s behalf. CAP Code, Section 16: Gambling.
- Inspect the disclosure. Look for plain wording such as “Ad” or “Sponsored” where viewers can notice it with the endorsement—not hidden in a profile, beyond a “more” link, or lost in a string of hashtags. In the UK, an “Ad” label is recommended when the commercial intent is not otherwise clear from context. ASA/CAP advice.
- Check the format. For video, stories, or livestreams, look and listen for a disclosure in the content itself. A description alone may not be enough under FTC guidance; audio and visible text together can make the relationship clearer. A livestream disclosure should recur so viewers who join later see it. - Consider the audience and location. Gambling promotions face additional local restrictions. In Great Britain, gambling ads must not be directed at under-18s through media or context selection, subject to the code’s stated exceptions. CAP Code, Section 16.
Does an affiliate link or betting promo code mean the post is sponsored?
Not necessarily in the narrow sense of a brand paying a flat fee, but it can still mean the post is advertising. If an affiliate link or personalized code earns the influencer commission, UK ASA/CAP guidance treats the influencer as an advertiser; content referring to the linked product counts as advertising. The arrangement may be commission-based rather than a conventional sponsorship payment.
For a viewer, the useful question is not only “Was the creator paid upfront?” but “Does the creator receive a benefit if I act on this promotion?” A commission link or code is a material commercial signal. What should a clear disclosure look like?
Use plain, direct language
Words such as “Ad” or “Sponsored” make the commercial nature easier to understand than vague labels or unexplained tags. The FTC recommends simple language and says influencers should not assume viewers already know about the relationship. A platform’s built-in disclosure feature may not be enough on its own. The FTC’s 2023 Endorsement Guides update addresses what “clear and conspicuous” means, platform disclosure tools, social-media tags as endorsements, and possible liability for advertisers, endorsers, and intermediaries. Put it where the endorsement appears
A disclosure is less useful if viewers must expand a caption, visit a profile, or follow a link to find it. FTC guidance recommends placing it with the endorsement and making it hard to miss. For images or stories, the disclosure should appear over the image long enough to be noticed; for video, include it in the video rather than relying only on the description. Why gambling promotions merit particular attention
Gambling promotions combine ordinary endorsement-disclosure questions with rules about gambling marketing and its audience. In the UK, the CAP Code covers marketing by licensed gambling operators in Great Britain and third parties, such as affiliate marketers, acting on their behalf. A historical US example shows why ownership matters as well as a paid deal. In 2017, the FTC announced a matter involving CSGO Lotto: the agency said the gambling-service owners allegedly promoted a site they jointly owned without disclosing that ownership, and paid other gaming influencers to promote it without requiring disclosures. The proposed settlement required clear and conspicuous disclosure of material connections. This is a dated enforcement example, not a complete statement of current gambling law or proof that every gambling-related mention is an ad. FTC CSGO Lotto enforcement announcement.
