You cannot tell from a price difference alone. An AI shopping assistant may be repeating a retailer’s public listing, applying your account or location, showing an eligible promotion, or displaying an offer that is no longer current. To investigate, compare the same product and seller under matched conditions, then check the retailer’s listing and checkout total. A persistent difference is a clue—not proof—that personal data was used to set your price.

What counts as personalized pricing?

Personalized pricing uses personal data—or an inference about a person’s willingness to pay—to set that person’s price or effective price. It can involve a tailored coupon or promotion even when the product’s listed price is the same for everyone.

That is different from dynamic pricing, which changes with factors such as demand or inventory. Location, seller, shipping, timing, account eligibility, and promotions can also produce different offers. These explanations can overlap, and the price alone does not reveal which one applies. The FTC’s August 2026 proposed enforcement policy recognizes consumer expectations around common listed prices while also acknowledging that supply and demand can change prices; it is a proposal, not a final rule. How can I tell whether an AI shopping assistant is showing me personalized prices?

First identify what the assistant is actually showing: a retailer’s listed price, a personalized coupon, an estimated price, or a checkout total. Save the assistant’s source link and offer terms, then compare with the retailer’s own product page and checkout. If the assistant does not identify a source or explain conditions, its response alone cannot verify the price or why it was offered.

Use this checklist to make the comparison more meaningful:

  • Match the item and seller. Check the exact model, size, color, condition, and marketplace seller. Similar products or different sellers are not a controlled comparison.
  • Record the time. Note the date and time for each check; demand, inventory, and time can affect offers.
  • Match location and delivery. Use the same region or delivery address and shipping option. Record whether the amount includes shipping and mandatory fees.   • Record account and offer eligibility. Note whether each session is logged in, whether a loyalty or rewards program applies, and whether a coupon or promotion is available. An offer available only to program members is not the same as one open to everyone.
  • Compare through checkout. Check the assistant’s cited offer against the retailer’s listing and final checkout total. Save screenshots or links and note whether the assistant calls the offer current, personalized, or conditional.
  • Repeat under the same conditions. A repeated difference is worth investigating, but it still does not identify the cause or prove that personal data set the price.

These steps help control for common pricing differences; they are a practical comparison method, not a validated way to identify a retailer’s algorithm or the data it used.

Why a price difference is not proof

A difference between two prices establishes that you saw different offers—not that a seller used your personal information to set one. Demand, inventory, timing, location, delivery, seller, account status, and promotion eligibility can all matter. Promotions can change the effective price without changing the listed price. A coupon shown to one shopper does not by itself prove that another shopper paid more, or that the coupon was assigned using personal data. FTC staff said in January 2025 that more research was needed to understand when surveillance pricing raises consumer prices and how it affects information asymmetries. What evidence exists that personal data can influence prices or offers?

FTC staff’s January 2025 initial findings described intermediaries using data such as location, demographics, browsing and shopping history, mouse movements, and abandoned-cart behavior to tailor prices or promotions. The firms examined worked with at least 250 clients selling goods or services, including groceries and apparel. That is a count of clients reported in the initial study announcement—not a count of retailers proven to personalize every shopper’s price. The FTC said the study was ongoing; its examples included hypothetical scenarios to protect confidential information. The findings show that such tools and data uses exist in the material staff reviewed, but do not establish what happened in an individual shopping assistant’s response. FTC study announcement

Disclosure is not a reliable shortcut for detecting personalization. An OECD lab experiment in Ireland and Chile found that online disclosures had only limited effects on consumers’ ability to identify and understand personalized pricing; it did not confirm a significant effect on purchasing behavior. Evidence from one market should not be generalized to another. In a 2025 report on algorithmic pricing in G7 jurisdictions, the OECD summarized an Italian Competition Authority preliminary report on airline prices: personalization based on browsing history, location, or device type was rare in that review, while most differences were linked to booking time and demand. What to do if matched checks still show different prices

  1. Keep the assistant’s response, its source link, and screenshots of the retailer listing and checkout, with timestamps and offer terms.
  2. Check whether the retailer explains the difference through a sale, coupon, membership, seller, delivery charge, or regional availability. Ask the retailer how the offer was determined if the explanation is unclear.
  3. Describe what you observed precisely: different prices or offers under matched conditions. Do not label it personalized pricing unless you have evidence connecting the difference to personal data.

The FTC’s August 2026 announcement described a proposed enforcement policy statement and set September 18, 2026, as the comment deadline. Its proposed position was that undisclosed collection or use of personal data to set a price may violate laws the agency enforces; the announcement does not establish the proposal’s status after that deadline.
