Start with the agency or organization that operates the license plate reader (also called an ALPR system), then ask its records custodian what data it holds, which retention rule applies, and whether it accepts deletion or correction requests. There is no single nationwide procedure or general deletion right established by the official materials cited here. Rules depend on the jurisdiction, the operator, the type of record, and whether the data must be preserved for an investigation or legal process.
How to make a request
- Identify the likely operator. Think about where the vehicle may have been scanned and which city, county, state agency, or other organization controlled the reader. If you are unsure, begin with local law enforcement and relevant state transportation or enforcement agencies.
- Find the operator’s policy and contact. Search its official website for “ALPR,” “automated license plate reader,” “license plate reader,” “usage and privacy policy,” “retention,” and “records custodian.” Check which systems, agencies, and uses the policy covers; a rule for one system may not apply to another.
- Ask which process applies. Contact the listed records custodian or privacy officer. Ask whether the agency accepts deletion requests and whether it has a separate correction or amendment process. A public-records request, a request to correct a record, and a request to delete data are different requests and may have different rules.
- Provide limited search details. Give the plate number, issuing state, and a specific date range; add a location if you know it. Ask the custodian how to send these details securely before providing additional personal information.
- Ask about the record’s status. Ask whether responsive data remains, what routine deletion date or retention basis applies, whether an exception or preservation request applies, and whether any vendor-hosted copy is governed by the agency’s retention rule. The agency may not be able to confirm or disclose particular records.
- Keep the response. Save your request and the reply. If the agency has no direct deletion process, ask for its applicable policy, retention schedule, and any available review or appeal route.
Sample request
Subject: Request regarding ALPR data associated with my vehicle
I am asking whether your agency, or an ALPR service provider acting for it, holds automated license plate reader data associated with my vehicle for [plate jurisdiction and plate number] during [date range and, if known, location]. Please identify the applicable ALPR privacy policy and retention schedule, whether responsive data remains in the system, the ordinary deletion date, and whether any legal or investigative preservation exception applies. If your agency accepts requests to delete or correct ALPR information, please provide the applicable procedure and a secure method for supplying any additional information needed. If the data is not held or has already been deleted, please let me know whether your process permits confirmation of that fact.

What records can a request cover?
“Vehicle data” may refer to more than the captured plate image. Clarify which record you mean, because retention, access, and correction rules can differ.
- Captured system data: A plate or vehicle image and associated ALPR information stored by the system.
- Access or audit records: Information about who accessed or queried ALPR data, or when it was shared. Virginia, for example, sets a separate retention period for audit-trail data.
- Agency records needing correction: If information is inaccurate, ask whether the operator has a correction or amendment route. That process is not necessarily a deletion procedure.
Why the answer depends on the jurisdiction
The periods below are examples of specific state laws or agency policies, not nationwide standards. Their scope and exceptions matter: some apply only to designated agencies or uses, and some distinguish routine scans from records preserved for a case or other authorized purpose.

Deletion, correction, and disclosure are not the same
A retention deadline may require routine deletion without creating a process for an individual to demand immediate deletion. Conversely, a request may not result in deletion when the data is preserved under an applicable exception. Ask the custodian which rule controls your record rather than assuming that a deadline in another state applies.
Do not treat a public-records request as a substitute for asking about deletion. Some laws restrict disclosure of ALPR system data, while a correction or amendment channel may address inaccurate information without promising deletion. California DOJ guidance describes policy and access-record requirements for covered operators, but does not establish a blanket individual deletion right; Virginia’s statute expressly limits disclosure of covered system and audit-trail data under Virginia FOIA.

How to interpret a reply
- The agency says it does not hold the data. Ask whether the answer covers the relevant system, date range, and any service provider acting for the agency. It may not be able to provide confirmation beyond what its process permits.
- The data was deleted under the routine schedule. Ask whether the response refers to captured system data only or also to associated logs and audit records, which may follow different schedules.
- The data is being preserved. Ask which policy, legal process, or exception applies and whether the agency can provide a review or appeal route. Do not assume a routine deletion deadline overrides a preservation requirement.
- The agency offers correction but not deletion. Follow its stated amendment process if your concern is inaccurate information, and ask separately whether any deletion procedure exists.
- The agency does not answer the request directly. Request the current policy, retention schedule, and records contact, then use any review channel the agency identifies.
