Practices differ by casino and location. Check the specific operator’s privacy notice, ask direct questions about biometric identification and data handling, and limit optional account and app data.
Do casinos use facial recognition?
Some casinos may use facial recognition or other biometric identification, but the available official Nevada gaming materials do not establish how common it is or show that every casino uses it. Surveillance rules and patron-data practices vary by operator and jurisdiction. For a particular casino, its current privacy notice and a direct response from its privacy contact are more useful than assumptions based on another property.
Nevada’s Gaming Control Board lists gaming and surveillance regulations, but that listing does not establish facial-recognition prevalence across casinos: Nevada Gaming Control Board regulations.
What to check before you visit or join a rewards program
Find the operator’s privacy notice and check what information it collects, why it collects it, who it shares it with, how long it keeps it, and how to submit privacy requests. Pay particular attention to references to biometric data, facial imagery, surveillance, security, loyalty accounts, personalization, and third-party service providers.

If the notice does not answer your questions, contact the casino’s privacy team or the contact listed in the notice. Ask specifically:
- Does the casino use facial recognition or another biometric method to identify visitors?
- Are images analyzed only in real time, or are images or biometric templates retained?
- What purposes does the casino rely on, and what is its stated legal basis?
- Can biometric information be linked to a loyalty account, payment record, or security record?
- Which vendors or other third parties receive images or related data?
- How long is each kind of information retained?
- Can you request access, correction, or deletion, or opt out of any collection or use? If so, how?
Keep a copy of the privacy notice and the casino’s response. Policies and practices can change, so check the current notice rather than relying on an old answer or another operator’s policy.

Limit optional data sharing
Decide whether the benefits of a loyalty program justify providing profile information and linking activity to an account. Review optional profile fields, connected accounts, and app permissions—especially location and personalization settings—and decline what you do not want to share when those choices are available.
These steps can limit information you provide through accounts and apps; they do not establish that the casino will stop camera surveillance or any biometric analysis it conducts under its own policies.

What Nevada law and federal guidance say
Nevada: biometric data and security duties have defined scope
Nevada Revised Statutes Chapter 603A defines biometric data to include facial imagery and other physiological or behavioral characteristics capable of identifying a person. It also includes security and consumer privacy provisions, but the applicable duties and rights depend on the specific provision, the data and operator involved, and statutory scope rules and exceptions. The definition alone does not establish that every casino use is covered or give every visitor a universal right to stop facial recognition. Read Nevada Revised Statutes Chapter 603A and seek advice about your circumstances if needed.
Nevada Gaming Control Board: a specific gaming-system requirement
The Board’s FAQ says licensees must assess the collection, maintenance, and transmission of sensitive patron information and establish documented safeguards for gaming systems approved by its Technology Division. That stated scope should not be treated as a rule covering every camera or data system at every casino. See the Nevada Gaming Control Board FAQ.

FTC: concerns and recommendations, not a casino-specific ruling
The FTC’s 2023 biometric-policy statement identifies privacy, data-security, bias, and discrimination concerns. It says the agency may consider issues such as whether a company assessed foreseeable harms, disclosed unexpected collection, evaluated vendors, and monitored third parties when examining potentially unfair practices. This is agency guidance and enforcement policy, not a finding about any named casino. The FTC’s May 2023 release quoted Bureau of Consumer Protection Director Samuel Levine: “In recent years, biometric surveillance has grown more sophisticated and pervasive, posing new threats to privacy and civil rights.” Read the FTC release on biometric information.
An earlier FTC staff report recommended privacy practices for certain facial-recognition uses, including notice and choice in some examples. It expressly distinguishes recommendations beyond existing law from enforceable legal requirements; it is not a guarantee that casino visitors can opt out. What not to rely on—and where to take a concern
Do not count on a mask, hat, camera blocker, or generic privacy device to defeat casino facial recognition. The reviewed evidence does not establish a physical product that reliably prevents recognition or changes an operator’s collection practices. Nor does declining a loyalty account establish that cameras will not be used.
If you believe a casino mishandled your information, keep the notice and relevant correspondence, then contact the privacy authority or gaming regulator for the jurisdiction. Which rules apply and what options may be available depend on the location, operator, data, and facts. A qualified local attorney can advise on a specific legal question; do not assume that a particular legal remedy is available without that assessment.
