Keep the video as received, preserve the device or source when possible, document every transfer and action, and work from a verified copy—not the only original. Those steps help show how the file came to be in its present state, but they do not by themselves prove who recorded it, that the depicted events are true, or that a court will admit it. Authentication and admissibility depend on the evidence, the witness or technical foundation, and the law that applies to the case.
What preservation and authentication establish—and what they do not
Preservation means protecting the recording and its context from avoidable change or loss, while documenting how it was obtained and handled. Authentication means offering a sufficient basis to identify the item as what the party claims it is. They are related but distinct: careful preservation helps a witness or examiner explain the file, while authentication is a legal foundation assessed under the applicable rules and facts.
The Scientific Working Group on Digital Evidence (SWGDE), in Best Practices for Digital Video Authentication, version 1.2, listed 2024-03-07, defines authentication as “the process of substantiating that the data is an accurate representation of what it purports to be.” A technical examination can assess a file’s source, structure, metadata, history, and signs of change. It cannot alone establish the real-world truth of what appears in the video: a camera-original recording, for example, could show a scripted reenactment.

It cannot show who recorded the video, when the depicted events occurred, whether the scene is genuine, or whether the file was edited before hashing. Those questions may require independent support, such as a witness with knowledge, the source device, provider records, or forensic examination.

What the federal rule says about authentication
For federal proceedings, Federal Rule of Evidence 901(a) provides that “the proponent must produce evidence sufficient to support a finding that the item is what the proponent claims it is.” Rule 901(b) gives non-exhaustive examples, including testimony from a witness with knowledge and comparison by an expert or factfinder with an authenticated specimen.
This is a federal baseline, not a universal rule for every U.S. state or country. The foundation can vary depending on whether the offered item is a camera recording, an exported copy, a screen capture, a social-media post, or material interpreted by a technical expert. State rules, local practice, and case-specific rulings may differ. A copy or a gap in the custody record does not, by itself, decide admissibility. Counsel should apply the governing jurisdiction’s rules and case law to the particular evidence.
Preserve the received video and its context
Identify the source and how the file arrived
As soon as practical, record who created, exported, sent, or downloaded the video; the device, camera, account, or service involved; the original file name and format; and when and how you received it. Include the date, time, and time zone of acquisition, along with relevant camera or account identifiers. Ask whether the recording was edited, messaged, posted, exported, or re-encoded before it reached you. If that history is unknown, record that it is unknown rather than filling the gap with an assumption.

Keep related material
Preserve the source device or physical media where possible, along with associated material that can explain the file’s history: memory cards, proprietary players, export logs, emails, download-portal records, available metadata, and reference files. Keep the original file as received. Do not rename, trim, enhance, convert, or overwrite that copy as a way of preparing it for review.
If physical media must be acquired for forensic examination, ordinary read/write access can change it. SWGDE’s Best Practices for Digital Forensic Video Analysis, version 2.0, listed 2025-12-10, recommends a hardware or software write blocker for flash media and hard drives so the media can be accessed read-only or through a write-protecting mechanism. This is a forensic acquisition precaution, not a requirement that every person handling a video must buy specialist equipment.
Make and verify a working copy
- Retain the submitted original. Store the received file and source media securely, with access limited to people who need it. Keep the original unchanged.
- Hash the source file and working copy where feasible. Use an approved cryptographic hashing method and record the method, the file to which each result relates, and when the hash was computed. NISTIR 8387, published 2022-09-08, recommends hashing digital images and other objects and keeping the hashes separate from the objects in secure storage when appropriate.
- Verify the copy before analysis. Compare the working copy’s hash with the source file’s hash. A match supports that the two files are byte-identical at that point. If hashing cannot be performed, document why and what other handling steps were taken.
- Use the verified copy for review and processing. Retain the original separately. Store hash records securely and separately from the evidence when appropriate, so the integrity record is not lost along with a file.
Hashing establishes a useful checkpoint, not an unbroken history reaching back to the camera. It cannot detect changes made before the first hash, establish recording provenance, or prove the events are genuine.

Keep a chronological chain-of-custody record
SWGDE defines chain of custody as chronological documentation of evidence movement, location, possession, and disposition. Make notes at the time of each event, from receipt through examination and final disposition. A practical record should identify:
- Who provided the evidence, who received it, and the method and date/time of receipt, including the time zone.
- Where the original, source device, working copies, and any derivatives were stored, and who had access.
- Each transfer, the people involved, the date/time, and the new location or custodian.
- Copies created, hashes recorded, tools or processes used, and any conversion, enhancement, or other action taken.
- How and when the evidence was returned, transferred, or otherwise disposed of.
Retain supporting records such as receipts, screenshots, photographs, portal records, download confirmations, and tool reports. SWGDE’s Best Practices for Digital Forensic Video Analysis, version 2.0, emphasizes contemporaneous notes and documentation sufficient for another appropriately trained analyst to reproduce and evaluate the work.
Handle exports, downloads, and enhanced versions carefully
Prefer the native or original format when feasible. An export may be the only file available, but document the system and method used to obtain it, whether it is a copy, and any known steps between the camera and the file in hand. An exported file may have different metadata or quality from the source recording; do not describe it as a camera-original unless that status is supported.

Perform analysis and processing on the verified working copy. Record each operation, its order and settings, and the difference between input and output. Avoid lossy transcoding for further analysis: conversion can change visual appearance, timing, or metadata, even when the decoded content appears similar. If a converted or enhanced version is offered as an exhibit, identify it as a derivative and retain the original for comparison. Do not let an enhancement obscure what was changed or imply that it restores details that are not present in the source.

Remote recordings may be subject to retention limits, and a shared download link may expire or become restricted. Identify the relevant account, device or camera, and date/time period promptly, and document the service, acquisition method, and time zone. Preserve downloaded material in durable storage as soon as practical.

- Use legal authority appropriate to the matter before acquiring remotely stored video. Depending on applicable law and provider policy, a preservation request or formal legal process may be needed.
- Check for both cloud copies and edge or local storage, such as an SD card or local hub.
- When possible, obtain a download through the logged-in service interface rather than relying only on an emailed link. Seek provider-held data directly when appropriate; it may include a higher-quality recording, additional metadata, original data, or documentation of the acquisition process.
- Document what was requested and obtained, the provider or interface, the relevant camera and time period, and any limitations or missing material.

What different versions of a recording can support
The file’s label alone does not establish its history. Evaluate the provenance and custody record, whether the native file and source device remain available, copy verification, metadata and frame timing, image and audio completeness, and whether a knowledgeable witness, provider documentation, or qualified examination can explain the file.

These checks help assess the strength and limits of a foundation; none guarantees admission. SWGDE’s authentication guidance describes contextualization, source identification, and content authentication as useful categories. Metadata should be considered with other file attributes and examination methods because it can be changed without affecting playback.
When to involve a forensic video examiner or lawyer
Seek a qualified forensic video analyst when the source is disputed, the file may have been re-encoded or altered, multiple generations or formats must be compared, timing or metadata matters, or processing is needed for court. An examiner may assess the container and structure, codec, metadata, frame timing and sequence, image and audio content, and source-device characteristics. A known sample from the alleged device—or a sample consistent with the file’s asserted generational history—may assist comparison.
