You can often work two jobs, but whether you may do so—and whether you must disclose or get approval—depends on your agreements, workplace policies, role, and local law. Before starting or continuing a second job, review the rules for both roles, check for conflicts and schedule limits, and get written clarification where the requirements are unclear.
Start by checking both jobs’ governing documents
Review each offer letter, employment contract, written statement of particulars, applicable staff handbook, and any policies on outside work, conflicts of interest, confidentiality, intellectual property, data security, or availability. Employment terms can be written or unwritten; in the UK, accepting a job offer can create a contract. GOV.UK explains that employees and employers must follow contract terms until the contract ends or the terms are changed, usually by agreement (Employment contracts: Overview).
Search the documents for phrases such as “outside employment,” “secondary employment,” “exclusive service,” “consent,” “disclosure,” “conflict,” “competitor,” “confidential information,” “inventions,” and “availability.” Note which policy applies and whether the contract incorporates a handbook or other rules.

Disclosure and permission are different requirements. One document may require you to tell your employer about other work; another may require advance written consent. Follow the exact wording and process in each job’s documents. If the rule is unclear, ask HR, your manager, or the designated ethics contact in writing before starting the role. Keep the response with your employment documents, and do not treat silence as approval.

Share enough detail for the employer to assess conflicts and scheduling, but do not disclose the other employer’s confidential information. Some roles have additional rules. For example, FDA guidance says covered agency employees may need advance approval for specified outside activities and must avoid activities that conflict with government duties. That is an agency-specific U.S. federal example, not a general requirement for private-sector workers or all public employees (FDA: Outside Activity).
Check for conflicts of interest and protect confidential information
Consider whether the employers compete, serve overlapping clients, regulate or supply one another, or could reasonably view your roles as divided loyalty. Pay particular attention if either job gives you access to nonpublic pricing, customer, product, security, or strategy information relevant to the other employer.

Keep each job’s work separate:
- Use separate work accounts, devices, storage, calendars, and workspaces where practical.
- Do not transfer files, reuse nonpublic information, or use one employer’s systems or equipment for the other job.
- Do not perform one job during time you are being paid to work for the other.
- Follow confidentiality, intellectual-property, and data-security terms for both roles.
UK government material identifies confidential commercial information and competitor work that creates a conflict as relevant concerns, and notes that confidentiality clauses can protect confidential information. Whether a restriction is enforceable depends on the actual facts and applicable law; the examples are not a universal legal test (Department for Business, Innovation and Skills: Banning exclusivity: Tackling avoidance).
Add up working time and check the rules that apply
Working-time rules depend on jurisdiction, occupation, and worker status. In the UK, GOV.UK says combined hours across multiple jobs should normally average no more than 48 hours a week, usually calculated over 17 weeks. Some work counts even if unpaid when requested; the treatment of travel, breaks, and on-call time depends on the rules. Some roles have different reference periods, including trainee doctors and offshore oil and gas workers. An opt-out agreement or a reduction in hours may be relevant if the average exceeds the limit. Check the guidance for your particular work rather than assuming every hour is treated identically (GOV.UK: Calculating your working hours).

For roles outside the UK, do not apply the UK limit as if it were universal. Check local limits on working hours and rest, along with any special rules for the occupation or public-sector role.
Check whether exclusivity protections apply
In the UK, current GOV.UK guidance identifies protections from exclusivity clauses for specified categories, including workers on zero-hours contracts and workers earning at or below the lower earnings limit. The guidance also says that zero-hours measures in the Employment Rights Act 2025 are not yet in force pending full implementation. Check the live guidance and your circumstances before relying on an exception (GOV.UK: Zero hours contracts guidance for employers).

Do not assume that having a second job is automatically permitted or prohibited just because an exclusivity clause appears in a document. The effect of a clause and any statutory protection depend on the applicable law and your status. HMRC’s guidance on exclusive services addresses employment-status analysis, not a blanket rule authorizing or banning second jobs (HMRC: ESM0555, exclusive services).
Recheck when your work changes
Repeat the review if your duties, hours, clients, reporting lines, or employer policies change. A previously unrelated second job may develop an overlap, and a schedule change may affect working-time compliance. If you face a dispute about enforceability, dismissal risk, protected disclosures, or statutory rights, seek advice from a qualified employment adviser in the jurisdiction that governs your work.

What this guidance can—and cannot—settle
The legal details above are grounded primarily in UK government guidance, with a narrowly scoped FDA example for certain U.S. federal employees. The applicable answer for an individual depends on country, state where relevant, worker status, occupation, employer sector, contract wording, and any immigration conditions. Check local rules and role-specific policies before acting; this article does not determine the enforceability of a particular clause.
