There is no universal tax rule for recurring payments. To manage tax on a membership or subscription, identify what the customer receives, where the seller and customer are located, how the sale is made, and which party local law treats as responsible for collecting and remitting tax. Then check the rules in every relevant jurisdiction and keep the records needed to support your decisions.
Start with what the customer is paying for
The word “membership” or “subscription” does not determine the tax treatment. Describe the actual supply before checking rates or setting up billing. A plan might provide digital access, physical goods, live or human-delivered services, event admission, facility access, or a bundle of benefits; different rules may apply to each.
HM Revenue & Customs (HMRC) specifically addresses membership benefits supplied by clubs, associations, and similar bodies for a subscription or other consideration in VAT Notice 700. That is a reason to examine the benefits and how they are supplied—not to assume that all dues are taxable or exempt.
For a bundle, record its components and how customers can obtain them. Check the relevant jurisdiction’s rules for the bundle rather than assuming that one component determines the treatment of the entire charge.

Build a jurisdiction-by-jurisdiction obligation map
Before charging tax, identify where the seller operates and where each customer is located. Determine whether the customer is a business or consumer when local rules make that distinction relevant. Keep the evidence required to support those conclusions; acceptable evidence and recordkeeping rules depend on the jurisdiction.
For each place where a sale could create an obligation, check whether the supply is taxable, whether an exemption applies, what registration threshold and measurement period apply, and when registration must take effect. Also verify the applicable rate, invoice requirements, filing frequency, and payment deadline. Do not apply a rate or threshold from one state or country to another.
United States: check each state separately
In the United States, a seller may have a state sales-tax obligation because of physical presence or, in some states, economic nexus from remote sales. Economic-nexus thresholds, what counts toward them, measurement periods, and the taxability of particular products or services vary by state. The Streamlined Sales Tax Governing Board’s Remote Seller State Guidance is a framework for checking state rules, not a universal answer for every subscription.

United Kingdom: distinguish digital services and customer type
HMRC’s guidance on digital services calls for determining where the consumer is, whether the service is digital, and whether the customer is a business or private consumer. It says UK consumer digital services are liable to UK VAT; services to consumers outside the UK may instead be liable in the consumer’s country. These are UK rules and should not be generalized to other countries or to every kind of membership benefit.
Japan: check the platform and B2B/B2C rules
Japan’s National Tax Agency (NTA) says that, from April 1, 2025, when a foreign business supplies B2C electronic services through a specified platform and receives consideration through that platform, the specified platform business is treated as the supplier and must file and pay consumption tax. Separately, the NTA explains that certain electronic services supplied from outside Japan to domestic businesses or consumers may be treated as domestic transactions, with a reverse-charge approach for defined B2B services. Check the NTA’s conditions for the particular transaction; the platform rule is not a worldwide rule.
Identify who handles a platform sale
Do not assume that a marketplace, app store, payment processor, or billing provider has taken over every tax obligation. Read the seller agreement and determine who is treated as supplying the customer, who sets the sale terms, who authorizes payment, who delivers the service, who invoices, and who collects and remits tax. The legal answer depends on the relevant jurisdiction and, in some cases, how the platform operates.

Under HMRC’s UK digital-services guidance, a third-party platform may have to account for VAT if the statutory conditions concerning supplier identification, terms, payment authorization, or delivery are not all met. HMRC distinguishes that situation from an entity whose only role is processing payments. This specific UK guidance does not make every platform responsible for tax on every sale.

But marketplace sellers may still have registration or filing requirements, and direct sales can independently trigger obligations. Check both the platform’s role and your own activity in each state.
Set up billing and tax operations
- Classify each plan. Document what each tier includes, how benefits are delivered, whether physical items are shipped, and whether the plan includes multiple kinds of supply.
- Map sales and customers. Identify your business locations, customer locations, customer types, direct channels, and platforms. Retain the location and business-customer evidence required by the applicable rules.
- Check taxability and thresholds. For each relevant jurisdiction, verify the rules for the actual supply, exemptions, nexus or registration thresholds, measurement periods, and registration dates using current official guidance.
- Confirm who is responsible. Review platform and service contracts, then compare their stated roles with local law. Record what remains your responsibility.
- Register before collecting where required. Confirm the effective date and any invoicing or other requirements with the relevant tax authority or a qualified tax professional. Do not treat software configuration as a substitute for registration.
- Configure and test charges. Make sure each plan, customer type, location, and exemption is handled as intended. Check that invoices or receipts distinguish tax from the underlying charge where required.
- Reconcile and file. Match billing records to platform statements, refunds, tax collected, returns, and payments. Keep the supporting records together for the required retention period.
Check whether the billing contract changes transaction counts
A recurring payment is not necessarily a separate transaction for every threshold test. The Streamlined Sales and Use Tax Agreement, as amended through May 20, 2025, gives two contrasting examples for transactional economic-nexus analysis: an annual subscription agreement billed monthly counts as one transaction, while a new 30-day agreement that automatically renews each month counts as twelve transactions over a year. States use different threshold measurement periods, and this agreement’s example is not a rule binding every state. Check the law in each state before counting your subscriptions.

Choose tools without confusing calculation and compliance
Tools can help with tax work, but their roles differ. Compare the legal seller and collector, supported jurisdictions and tax types, recordkeeping, and the services included. Ask specifically whether a provider calculates tax only or also supports registration, returns, remittance, notices, or audit response. The contract and local law determine what responsibility remains with the seller.

Keep sales tax separate from income reporting
Sales tax or VAT collected on a customer charge is a different issue from reporting income on an income-tax return. The IRS says that if you receive payments for selling goods or services, you must report all income on your tax return, regardless of the amount reported on Form 1099-K. A payment app or marketplace’s information reporting does not determine whether the underlying income is taxable. Check current IRS guidance for Form 1099-K reporting rules rather than treating an information-reporting threshold as an income-tax threshold.
Check the special case of exempt organizations
For organizations claiming U.S. federal tax-exempt status, membership fees require analysis under the rules applicable to that status; they are not automatically treated the same in every situation. IRS Publication 557 (January 2025) explains that providing services, admissions, facilities, or merchandise to members as part of an organization’s overall activities does not, by itself, turn membership fees into gross receipts subject to the publication’s $5,000 or 1% limit. It also says that fees used as a means to sell goods, admissions, services, or facility use to the general public without a common goal or interest may be gross receipts rather than membership fees. This is an exempt-organization distinction, not a general sales-tax rule.
Review the setup when something changes
- You enter a new state or country, or your sales cross a registration threshold.
- You add, remove, or materially change a membership benefit, product, or service.
- You change from an annual contract paid in installments to monthly renewals, or change other billing terms.
- You begin selling through a marketplace or app platform, or change providers or platform arrangements.
- Your customer mix changes between businesses and consumers, or you begin relying on an exemption.
- A tax authority changes its guidance, rates, thresholds, or filing requirements.
Keep contracts, plan descriptions, invoices, customer-location evidence, exemption or resale documents where applicable, refunds, platform statements, tax records, and filed returns. For a seller operating in multiple jurisdictions, or where a classification or platform arrangement could materially affect liability, ask a qualified tax professional to review the specific facts.
