After a job loss in India, do not treat “severance” as one guaranteed payment. Check each item separately: contractual or employer-offered severance, notice pay, any applicable statutory retrenchment compensation, earned wages and leave, gratuity, and your EPF account. What is payable depends on your legal coverage, service history, state, contract, and the actual form of separation.

What am I entitled to after a layoff in India?

Start by identifying what kind of separation took place and which rules apply to you. An employer’s announcement calling a job loss a “layoff” does not, by itself, establish that the legal category of layoff or retrenchment applies. The payment package may combine different items, and each can have a different legal basis, calculation, payment date, and tax treatment.

The Ministry of Labour & Employment says India’s four Labour Codes—the Code on Wages, Industrial Relations Code, Code on Social Security, and Occupational Safety, Health and Working Conditions Code—came into effect on 21 November 2025. For a case arising after that date, check the applicable Code and rules rather than relying on an older statute alone. The Chief Labour Commissioner’s published section 25F material remains useful for understanding the stated retrenchment protections, but it is not by itself a determination of the current rule for every worker or state.

Keep the payment categories separate

This is a checklist of distinct issues, not a promise that every item is payable in every termination. In particular, statutory coverage cannot safely be assumed for every professional or managerial employee.

Is notice pay mandatory if I’m laid off?

There is no safe one-line answer for every employee. The Chief Labour Commissioner (Central) page describing section 25F says that, for a workman with at least one year of continuous service who is covered by that provision, retrenchment conditions include one month’s written notice stating the reasons or wages in lieu of notice, compensation at the prescribed rate, and notice to the appropriate government or authority.

That source describes the Industrial Disputes Act provision. Since the Ministry says the Labour Codes took effect on 21 November 2025, confirm the applicable Industrial Relations Code provision, rules, state requirements, and facts for a separation now. The old section 25F text should not be presented as the only law currently in force.

If you are not covered by the relevant statutory retrenchment protection, your employment contract, standing orders, state Shops and Establishments law, settlement terms, or another applicable rule may matter. The applicable answer can depend on your role and duties, establishment, service history, state, contract, and the employer’s stated reason and form of separation. For a disputed or substantial amount, have an India employment-law adviser review the documents.

How is severance pay calculated in India?

First establish what the employer means by “severance.” It may refer to an additional package or ex gratia payment, or the employer may use it loosely to describe a settlement that also includes other dues. Ask for a written itemization and the basis for each figure before comparing the offer with a statutory or contractual amount.

Use the statutory measure only after confirming coverage

The section 25F text published by the Chief Labour Commissioner describes compensation for a covered workman with at least one year of continuous service as 15 days’ average pay for every completed year of continuous service, with a part of a year exceeding six months counted under the stated measure. It also describes the notice requirement and government notice conditions. This is not a universal severance calculator: coverage, the governing current law, the relevant wage definition, service calculation, and state rules must be checked before using the measure in an individual case.

Compare the written package line by line

  • Identify which amount is notice pay, statutory compensation, employer-offered severance, or another settlement component.
  • Check the calculation inputs shown by the employer, including the wage basis and recognized service period.
  • Confirm whether notice will be worked or paid in lieu, and record the payment date for each item.
  • Check whether earned salary, leave encashment, gratuity, bonus or incentives, and benefits or insurance end dates are addressed separately.
  • Ask how tax withholding is being handled and whether the employer’s figures are gross or net.
  • Keep the written offer, separation letter, contract, payslips, service records, and final settlement statement together.

These checks help expose what is included and what remains unresolved; they do not establish a universal package amount.

Will I receive gratuity if my job is terminated?

Gratuity is a separate benefit from severance and notice pay. The Labour Ministry’s 2026 Labour Code FAQ says gratuity payable on or after 21 November 2025 is governed by the Code on Social Security, 2020. It also says a fixed-term employee is eligible where service under the contract is for one year from its start.

That FAQ does not calculate a particular employee’s payment. Before relying on a figure, check the operative provisions and your eligibility, wage base, service period, and circumstances of separation. Ask the employer to show the gratuity calculation as its own line rather than assuming it is included in a package total.

Should I transfer or withdraw my PF after leaving a job?

EPF is an account decision, not severance. EPFO’s “About EPFO” page lists Form 13 for transferring an old account to a new one, Form 19 for a member’s final settlement, and Form 31 for withdrawals in certain cases. Which route is available depends on current eligibility and your circumstances; the form list is not a recommendation to withdraw.

Check EPFO’s current claim guidance and your account records before filing. If you have pension-related service or other complications, verify how the proposed claim affects those records instead of treating the EPF balance as interchangeable with a separation payment.

Is severance or notice pay tax-free?

Do not assume that every termination payment is tax-free. The Income Tax Department’s salary guide describes section 10(10B) relief for qualifying retrenchment compensation, including a ₹5,00,000 cap in the cases described by that guide and subject to its formula and scheme-specific conditions. The guide also addresses salary, provident-fund, and gratuity tax topics; the treatment depends on the payment type and qualifying conditions.

Ask for the final-settlement statement to identify each payment and tax withholding separately. Because the Department guide’s stated relief is conditional, verify the rules for the relevant tax year with a qualified tax adviser if the package combines several payment types or the tax treatment is unclear.

What documents should I check before accepting a settlement?

  1. Read the separation letter. Confirm the stated reason and form of separation, effective date, notice arrangements, and any conditions tied to accepting the offer.
  2. Review your employment terms. Check the contract, applicable policies, standing orders if relevant, and documents describing your role and service history.
  3. Request an itemized calculation. Ask the employer to show the amount and basis for each component, including notice pay, any retrenchment compensation, severance, salary, leave, gratuity, and variable pay if applicable.
  4. Check benefit end dates and records. Clarify when insurance and other benefits end, and review your EPF account details before choosing an account process.
  5. Resolve coverage and tax questions. If the package depends on whether you are a covered workman or on a particular legal calculation, seek local employment-law advice; consult a tax adviser for complex payment treatment.

Central sources do not settle every state-specific rule, role classification, contract term, or individual calculation. Treat an employer’s package summary as an offer to verify against the relevant documents and law, not as proof that all statutory or contractual dues have been accounted for.
