The safest SaaS choice is not the vendor with the most attractive regional-hosting label or the longest compliance badge list. Choose the service and plan that can prove where each data flow goes, who can access it, how international transfers are protected, what security controls are in scope, how support operates worldwide, and what happens when you leave. Put those answers—and remedies for missed commitments—in the contract before signing.
What your evaluation must establish
Evaluate every shortlisted service against the same questions. A vendor should be able to answer them for the exact product, edition, region and support tier you would buy—not merely for its company or platform generally.
- Location: Where are customer content, backups, logs, telemetry, disaster-recovery copies and support records collected, stored, replicated and processed?
- Access: Which vendor, affiliate, subprocessor and support personnel can access the data, from which countries, under what approval, authentication and logging controls?
- Lawful transfers: If personal data leaves a jurisdiction, what transfer mechanism and supplementary safeguards apply, and how are changes communicated?
- Assurance: Does the current audit report or certificate cover the legal entity, product, service boundary and plan you are buying?
- Operations: Do support coverage, uptime measurement, recovery commitments, incident communications and exit assistance meet your business requirements?
Use privacy or legal specialists for the obligations that apply to your actual data, jurisdictions and sector. A procurement framework can expose gaps, but it is not a jurisdiction-specific legal opinion.

Inventory the data and processing
- Classify the content: public, internal, confidential, personal, sensitive personal, financial, health, regulated or customer-owned.
- Identify related data such as user profiles, attachments, messages, prompts, search indexes, metadata, audit trails, diagnostics and crash reports.
- Record who owns each data set and which organization determines the purposes and means of processing.
- State retention, legal-hold, deletion and backup-purge requirements.
- List data that is prohibited from the service, such as a category that cannot legally or contractually be transferred outside a specified country.
Map jurisdictions and business impact
- List the countries of affected individuals, your contracting entity, operating teams and customers.
- Note sector, customer and public-contract obligations that may impose location, audit or incident-notification conditions.
- Set recovery-point and recovery-time expectations, maximum tolerable outage and any seasonally critical periods.
- Separate mandatory requirements from preferences that can be scored. A vendor that fails a mandatory condition should not remain in the same ranking as one that passes it.
Assign a practical risk tier
For each use case, document the consequence of disclosure, alteration, unavailability, unlawful transfer and failed deletion. A low-risk collaboration workspace can use a lighter evidence package than a service processing sensitive customer records, but the criteria should be recorded rather than assumed.
2. Trace every data location and access path
A country selector usually describes only one part of a service. Request a current, product-specific data-flow diagram and ask the vendor to identify the legal entity responsible for each step.
| Flow to verify | Questions to ask | Evidence to retain |
|---|---|---|
| Primary storage | Which facility and country hold the production copy? Is the choice enforced for this plan or merely preferred? | Product documentation, order form or contractual region commitment |
| Replication and disaster recovery | Where are replicas, snapshots and failover environments located? Can an outage move processing outside the selected region? | Architecture statement and recovery-region list |
| Backups | Are backups encrypted, how long are they retained, and when are they purged after deletion? | Backup-retention schedule and deletion procedure |
| Logs and telemetry | Do application logs, usage analytics, diagnostics, crash dumps or security events contain customer data or identifiers? Where are they processed? | Logging and telemetry data-flow description |
| Optional features | Do search, artificial-intelligence, transcription, monitoring or support features introduce another processor or country? | Feature-specific terms and subprocessor mapping |
| Support access | Can support staff view content during a ticket or incident? From which countries, with whose approval, and for how long? | Support-access policy and access-log commitments |
| Subprocessors | Where is each subprocessor established and where does it process your data? Does the list distinguish processing purpose? | Current subprocessor register and change-notice terms |
Ask whether selecting a region constrains all of these flows or only the primary database. Capture the answer for each service and plan; a vendor’s enterprise edition may have controls that are unavailable in a standard plan.

Make access a separate review
“Stored in country X” does not mean “never accessible from outside country X.” Review administrative access, customer support, security monitoring, incident response and remote maintenance independently. Require least privilege, strong authentication, approval or ticket linkage, time limits, logging and periodic review. If the vendor cannot describe who can access data during an emergency, the residency answer is incomplete.
3. Separate residency from international-transfer compliance
Data residency asks where data is located or processed. Transfer compliance asks whether moving personal data to another jurisdiction is lawful and adequately protected. Keeping a database in a preferred region does not eliminate transfers through support, subprocessors, telemetry or disaster recovery.
European Data Protection Board guidance explains that a transfer of personal data outside the European Economic Area requires an adequate level of protection or an appropriate safeguard, such as Standard Contractual Clauses or Binding Corporate Rules, subject to the conditions that apply to the transfer. Confirm which mechanism covers your specific flow, the parties signing it and any supplementary measures needed after a transfer assessment.

Questions for the vendor and your legal team
- Which transfers occur for the selected product, including remote access by personnel?
- Which entity is the exporter, which is the importer, and which transfer instrument is incorporated into the contract?
- Are government-access risks, encryption, access controls and transparency measures documented?
- How will the vendor notify you of a legal or operational change that affects the transfer?
- Can the service be configured to avoid a transfer, or is the transfer intrinsic to support or security operations?
Have counsel determine whether the mechanism and supplementary measures satisfy the law applicable to your facts. Record the conclusion and the evidence in the vendor file instead of relying on a generic “global compliance” statement.

4. Validate security evidence at the service and plan level
Request the latest audit report, certificate or independent assessment through the vendor’s trust process. A badge is a starting point, not proof that every feature or plan is covered.
Check the scope before reading the conclusion
- Issuer and date: Identify the auditor or certifying body, report period, issue date and expiry or renewal status.
- Legal entity: Confirm that the entity in the report is the entity contracting with you or that the relationship is clearly covered.
- Product boundary: Check the named service, deployment model, region and environment. A corporate report may exclude the product you are buying.
- Plan applicability: Verify whether the purchased tier is included, including optional modules and customer-managed components.
- Exceptions: Read qualifications, deviations, control exceptions and complementary customer controls.
- Period continuity: Look for gaps between reports and ask how controls operated during any gap.
Trust centers for different products can show different attestations, dates and applicability. Vendor materials from Microsoft, Plaud, Commvault, DataRobot, Greenhouse and Notion illustrate why the exact report and scope must be checked rather than inferred from a company-wide claim. These examples are not rankings or endorsements.
Request control evidence that matches your risk
- Identity and access management, including privileged-access approval, separation of duties, multi-factor authentication and access reviews.
- Encryption in transit and at rest, key ownership, key rotation and options for customer-managed keys.
- Secure-development practices, code review, dependency management, vulnerability disclosure and remediation targets.
- Security testing, penetration-test summaries and treatment of material findings.
- Incident detection, containment, notification and the information supplied for your own regulatory or customer notices.
- Business continuity, disaster recovery, backup integrity and restoration testing.
- Physical and environmental controls for facilities that host or process the service.
Ask which controls are your responsibility. A report can assume customer configuration, identity management or network restrictions that you must implement yourself.
5. Put processor obligations in the contract
Review the data-processing agreement, service terms, order form and security addendum together. Important promises should not exist only in a sales presentation or a changeable web page.
European Data Protection Board guidance identifies contract subjects that commonly need to be addressed between a controller and processor. Check that your documents cover:

- Confidentiality obligations for personnel and appropriate technical and organizational measures.
- Authorization of subprocessors, equivalent downstream protection and a process for changes.
- Assistance with data-subject rights, security incidents, impact assessments and consultations with authorities.
- Information needed to demonstrate compliance, audit or inspection cooperation and reasonable limits on that cooperation.
- Return or deletion of data at the end of service, including copies held in backups, subject to clearly stated legal-retention exceptions.
- International-transfer terms, governing safeguards and responsibilities if a transfer mechanism becomes unavailable.
Make commitments measurable
Define the data classes and services covered, the regions permitted, the notice period for material changes, and the remedy if the vendor cannot meet the requirement. If the vendor reserves broad rights to change processing locations or subprocessors, negotiate a termination or migration right that is usable in practice.
6. Govern subprocessors instead of accepting a static list
Obtain the current subprocessor register and map each entry to its purpose, processing location and data category. A list of company names without those fields is difficult to evaluate.
Check whether the vendor provides advance notice of additions or replacements, how you can object, and what happens if the objection cannot be resolved. An objection right is meaningful only if it has an actionable outcome, such as migration assistance or termination without an unreasonable penalty. Confirm that the vendor remains responsible for equivalent protection in the downstream contract.

Microsoft’s supplier materials demonstrate that notice periods can differ by data or subprocessor type. Treat that as a prompt to inspect the current data-processing terms for your service, not as a market-wide standard.
7. Evaluate global support as both an operational and privacy control
Support affects availability and can create a separate path to customer data. Request a support schedule for the geography and customer tier you will actually use.
| Support dimension | What to compare |
|---|---|
| Coverage | Staffed hours, time zones, weekends, public holidays and follow-the-sun handoffs |
| Channels | Portal, email, phone, chat and emergency channels; whether each is included in your plan |
| Language | Languages available for normal cases and critical incidents |
| Severity | Definitions for critical, high, normal and informational cases, with examples |
| Response | Initial response target, update cadence and escalation trigger by severity |
| Restoration | Target or objective for restoring service, and whether it is contractual |
| Escalation | Access to engineering, incident management, an account team or named contacts |
| Data access | Whether access is customer-approved, time-limited, logged and restricted by region |
Do not treat a response-time promise as a resolution-time promise. Ask whether support personnel can access content during ticket handling, issue reporting or incident response, and whether the same regional restrictions apply to that access. Supabase’s published FAQ is an example of explicit support-access disclosure; use such disclosures to expand your data-flow review rather than assuming every vendor operates identically.

8. Read the SLA calculation, exclusions and remedies
An uptime percentage is meaningful only with its definition. Obtain the SLA and test it against a month of realistic incidents.
Verify the calculation
- Measurement period and measurement points.
- Whether availability is measured globally, by region, tenant or endpoint.
- Planned maintenance, force majeure, customer-caused events, beta features and third-party failures excluded from the calculation.
- How partial outages, degraded performance, failed authentication and data-loss events are treated.
- Monitoring source, evidence available to customers and the deadline and process for making a claim.
Assess the remedy
Record service-credit tiers, caps, exclusions and whether credits are your only remedy. For a critical service, negotiate appropriate termination rights or other remedies when repeated failures exceed an agreed threshold. Check that support response commitments are contractual and whether they vary by severity, plan, region or channel. A public procurement checklist commonly asks vendors to state uptime, performance and support response times, downtime notice, exclusions, calculation method, monitoring, remedies and termination rights; use those prompts, then tailor the terms to your service risk.
9. Specify portability and exit before you need them
Exit planning is part of security and resilience. A vendor that can delete data but cannot provide a usable export may still leave you exposed to operational or legal risk.
- Define the export format, schema, attachments, metadata, audit records and encryption method.
- State how much notice you must provide and how long the vendor will keep the service available during transition.
- Specify technical assistance, documentation, testing support and rates for work beyond the included service.
- Set a deletion deadline for production data, replicas and backups, while identifying narrowly defined legal-retention exceptions.
- Require written confirmation or evidence of deletion where appropriate.
- Test a representative export before committing to a high-risk deployment.
Ensure the DPA, SLA and commercial order form do not contradict one another on retention, termination or deletion timing.

An illustrative scoring method is to rate each comparative criterion from 0 to 5 after evidence review, multiply by an internally agreed weight and record the document supporting the score. The scale is a governance aid, not an industry benchmark. Record “not stated” when a vendor has not supplied comparable information; do not convert silence into a favorable score.

Red flags and practical responses
“Hosted in your region” with no flow map
Risk: Backups, logs, support or failover may still cross borders. Response: Request the complete map and make the covered flows contractual.
One compliance logo for every product
Risk: The attestation may exclude your service, plan, region or period. Response: Obtain the report, read its boundary and identify complementary customer controls.
Subprocessor page without purposes or locations
Risk: You cannot assess transfer exposure or downstream processing. Response: Require a purpose-and-location register and a workable notice and objection process.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problems24/7 support advertised without a schedule
Risk: The promise may mean ticket intake rather than staffed response or engineering escalation. Response: Get severity definitions, response and restoration targets by plan and channel.
Deletion promise limited to production systems
Risk: Copies may remain in backups or legal-retention stores. Response: Specify backup purge timing, exceptions and confirmation.
Transfer terms incorporated only by a changeable web page
Risk: The commitment can change without the notice or remedy your policy requires. Response: Attach or identify the governing version in the contract and negotiate change rights.
Procurement checklist for the final approval
- Data categories, owners, jurisdictions and prohibited uses are documented.
- Mandatory region, transfer, security, support, recovery and exit requirements are marked pass or fail.
- A current data-flow map covers storage, replication, backups, logs, telemetry, optional features, subprocessors and support.
- Support access is documented by role, country, approval, duration and logging.
- The transfer mechanism and supplementary safeguards have been reviewed for the actual flows.
- The audit or certificate covers the purchased product, plan, entity, region and period.
- Exceptions and complementary customer controls have assigned owners.
- The DPA covers instructions, confidentiality, security, subprocessors, assistance, audits, transfers and deletion.
- The subprocessor register and change process provide an actionable objection remedy.
- SLA calculations, exclusions, monitoring, credits, escalation and termination rights are understood.
- Export, transition assistance, deletion and backup-retention terms have been tested or made testable.
- Privacy, security, procurement, operations and legal approvers have accepted the residual risks in writing.
How to make the decision
Choose the vendor that can provide complete, current and contractually enforceable evidence for your required flows—not the vendor with the broadest marketing language. If two vendors pass the mandatory gates, prefer the one whose data paths are simpler, support access is narrower and more observable, evidence is easier to refresh, and exit is more practical. Record unresolved assumptions as risks with owners and deadlines; never bury them in a generic “compliant” conclusion.
