Preserve more than a screenshot. Save the post as it appeared, its source URL or platform identifier, the account and platform, and the circumstances of capture. Keep an unaltered copy, document who captured and reviewed it, and assess the entire communication—including claims, endorsements, disclosures, and risk information—in the format viewers actually saw. This is a practical workflow, not a universal legal requirement; retention duties depend on the organization, product, records, and applicable policies and laws.
What to preserve before a post changes or disappears
Capture the complete communication promptly, before an edit or deletion changes what reviewers can see. A post may include more than its main text: preserve the associated media, the presentation of disclosures, and the context needed to understand the message.
- The visible post text, images, video, audio, captions, hashtags, and disclosures.
- Links included in the post, plus relevant surrounding context that affects its meaning.
- The platform, account or author, and the post URL or platform identifier, where available.
- The date and time of capture, including the time zone.
- Who captured it and how: for example, a public view, account export, or another source.
Save the original capture separately from annotated copies created for review. If content is exported, converted, or otherwise transformed, retain the original and identify what each copy represents. NIST’s technical reference on digital evidence preservation discusses preservation considerations for evidence handlers; it does not prescribe a universal checklist for private advertisers.

A screenshot can show the post’s visual appearance at a particular time, but on its own it may not preserve the source identifier, capture context, or information needed to understand how the content was presented. Treat it as one part of a review record, not as proof that every relevant detail was retained or that a particular legal duty was met.
Pair the image with the source URL or platform identifier when available, capture date and time with time zone, account and platform details, and a note about how it was obtained. Preserve relevant source exports or other available records alongside the screenshot. Keep an untouched original; use a clearly labeled copy for annotations. The practical objective is to retain the content and its meaning. FDA’s Part 11 scope guidance discusses electronic records in its regulatory context; it does not make every marketing screenshot automatically subject to Part 11.
A repeatable capture and review workflow
- Capture the post in its actual presentation. Record the public-facing post and relevant context. Include the complete text and media, not just a cropped claim or image. For stories, reels, or other changing formats, preserve the disclosure and content together as presented.
- Log the source and capture circumstances. Note platform, account or author, post URL or identifier, capture date and time with time zone, collector, and capture method. Identify whether the record came from a public view, account export, or another source.
- Preserve originals and label copies. Retain the unaltered capture. Keep exports, conversions, and annotated review copies with it, and clearly state what each file is. FDA electronic-record guidance says copying processes should preserve record content and meaning.
- Store and track the record. Use the organization’s designated recordkeeping location. Log who collected and reviewed the material, when, and any later change or export. Apply relevant retention and legal-hold policies rather than assuming a screenshot tool or storage location determines the retention period.
- Review the complete advertisement. Assess express and implied health claims, supporting context, testimonials or expert endorsements, material-connection disclosures, and risk or qualifying information. Record the review outcome and the content version reviewed.
- Check disclosure visibility in the format shown. Preserve where and how disclosures appear. A disclosure in an image or story should be visible long enough to be noticed; for video, review whether it appears within the video rather than only in its description.
- Confirm applicable product rules and escalate questions. Identify the product category and applicable company policies and legal requirements. Document the reviewer’s rationale and route unresolved regulatory or legal questions to the appropriate team.
Assess the whole message, not just the claim text
The FTC’s Health Products Compliance Guidance covers promotional material online and on social media. It applies truth-in-advertising principles to health-product claims, including claims made through influencer marketing. Claims and endorsements need to be truthful and adequately supported; an endorsement cannot communicate a claim that would be deceptive or unsubstantiated if the advertiser made it directly.
Review the post as an audience encounters it: the words, image or video, linked material, endorsement, and disclosure together. The FTC says disclosures in interactive media should be unavoidable; a hyperlink alone may be avoidable. Its Disclosures 101 for Social Media Influencers guidance advises that disclosures be hard to miss and placed with the endorsement. Preserve enough of the actual format to show placement and visibility, not merely a transcription of disclosure text.

Distinguish agency recordkeeping examples from private-company duties
FDA’s social-media policy applies to FDA personnel and agency accounts. It says: “All content created within social media that qualifies as a federal record must be captured and maintained in a recordkeeping system according to the FDA’s Records Management Policies.” That is an example of federal agency recordkeeping, not a blanket rule for private advertisers.
FDA’s For Industry: Using Social Media page describes agency work on regulated medical-product promotion. The applicable guidance depends on the product category and the status and scope of the specific document.

How to choose a capture approach
No single capture method is established as universally best. Choose an approach that fits the post and the organization’s recordkeeping process, and evaluate it against these practical criteria:
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
- Presentation fidelity: Does it show the post as a viewer saw it, including media and disclosure placement?
- Source and context: Can the record be tied to the account, platform, and post identifier, with relevant context?
- Integrity: Do exports preserve content and meaning, and are original and transformed copies distinguishable?
- Auditability: Can the organization track who captured, reviewed, annotated, or exported the record?
- Review access: Can compliance, legal, regulatory, and marketing reviewers retrieve and understand it?
- Records fit: Does storage and retention align with company policy, applicable obligations, and any legal hold?
NIST’s Guidelines on Mobile Device Forensics may be relevant when preservation involves mobile-device evidence. It is a technical reference, not a substitute for organization-specific legal and records guidance.
What FDA’s character-limited-platform draft does—and does not—say
FDA’s 2014 document, Internet/Social Media Platforms with Character Space Limitations—Presenting Risk and Benefit Information for Prescription Drugs and Medical Devices, is draft guidance marked “Not for implementation. Contains non-binding recommendations.” It discusses risk and benefit information for specified prescription drugs and medical devices. Do not present it as a final rule or extend its scope automatically to every medical product or social-media post.
