Treat an AI agent as a preparation aid, not as the accountable taxpayer, tax practitioner or auditor. For each material tax decision, preserve the evidence, the agent’s output and changes, the human review and approval, and the final filing or accounting action—alongside the statutory books and records that apply to the taxpayer. Indian tax sources specify recordkeeping, electronic edit-history, retention and certain signed audit workflows, but the official sources cited here do not prescribe a universal AI decision-log template.
What should an AI tax decision record contain?
Create a traceable packet for each material tax position or filing action. It should let a reviewer move from the conclusion to the evidence, see what the agent produced, identify who reviewed it, and locate the final action. Keep statutory books and source documents independently of an AI chat transcript or vendor dashboard.
- Identity and scope: taxpayer or entity, tax regime, relevant tax year or return period, issue identifier, responsible business owner, and whether the decision remained a draft or was acted on.
- Evidence inputs: copies or stable references to relevant invoices, ledgers, contracts, returns, notices and reconciliations. Record each document’s date, origin and version, and link the agent’s material statements to their supporting evidence.
- System context: agent or application name, model and version where available, run timestamp, task or prompt version, connected tools or data sources, and material configuration changes. Record only metadata actually available; do not invent or backfill it.
- Decision history: the question asked, agent output, assumptions, cited tax provisions or source records, uncertainty or escalation flags, and any human edits, rejection or override. Preserve prior versions instead of silently replacing an answer.
- Approval: reviewer’s name or unique user ID, role or authority, what was reviewed, decision (approve, reject or return for correction), timestamp, and any conditions. Bind approval to the precise version reviewed.
- Outcome and retention: final journal entry, return or form version, payment or withholding action, filing acknowledgment, and the retention schedule or legal hold applied.
This is a practical governance design, not a list of fields mandated by an AI-specific tax rule. The statutory obligations below attach to particular taxpayers, records and tax workflows.

How do you build a reviewable approval workflow?
- Define the issue and period. Assign an issue ID and state the tax question, entity, applicable regime and return period before the agent runs.
- Freeze the evidence set. Preserve or reference the source versions provided to the agent. Include a manifest or equivalent index so a reviewer can tell what material was in scope.
- Capture the run. Save the output and available system metadata, along with the task instructions, tools or data connections used, and any uncertainty flags. Do not treat a fluent answer as evidence that its assumptions are correct.
- Route exceptions to a person. Require review where the output is uncertain, conflicts with source documents, changes a prior position, or would affect a filing, payment or accounting entry. Record corrections and overrides as distinct events.
- Approve the exact version. Have an authorized reviewer record a decision against the output and supporting packet actually examined. If the packet changes materially, send the revised version for review rather than carrying forward the earlier approval.
- Record the action and preserve the packet. Link the approval to the resulting journal entry, return, payment or filing acknowledgment. Apply the retention schedule and any relevant hold to the underlying records and decision packet.
A practical audit trail should make it possible to answer: what was decided, for which period, from which evidence, with what agent output and human changes, by whom, when, and what happened next.

What do Indian tax rules require for the underlying records?
The tax record rules concern the underlying books and documents, and their exact reach depends on the applicable law and record set. An agent’s summary cannot replace invoices, books, supply records, stock information, input tax credit support or other evidence required for the taxpayer’s circumstances.

These periods are not interchangeable or universal retention rules for every Indian tax record, prompt, log or data object. Check the applicable tax year, taxpayer category, current amendments, proceedings and other retention obligations.

Can an AI agent approve or certify a tax return?
An internal workflow can record that a human reviewed an AI-assisted position, but it does not turn the agent into the accountant or replace any prescribed certification. For example, Income Tax Department guidance for Form 3CB-3CD describes an accountant examining factual details, observations and prescribed particulars, and a workflow in which the CA uploads the form using a digital signature certificate. The described prerequisites include active DSCs for the CA and taxpayer. See the Income Tax Department Form 3CB-3CD User Manual for that form’s workflow.
Use the packet to make review visible and connect it to the signed form or other final action. It is not evidence that the agent’s conclusion was independently correct, nor does the example establish a universal human-approval rule for every tax decision.

Do you have to keep AI prompts and full reasoning for GST?
The official materials cited here establish requirements for underlying accounts, electronic edit logs, specified retention and audit workflows; they do not establish a tax-specific general duty to preserve an AI agent’s full reasoning or follow a particular AI approval schema. Keeping relevant prompts, outputs, versions and approvals is a prudent way to make material decisions traceable, but distinguish that governance recommendation from the specific legal record duties that apply to the taxpayer.
How should personal data and storage location be handled?
Tax records and agent inputs may contain personal data, so map what is processed, who can access it, how long it is kept and which legal requirements apply. The cited MeitY Gazette notification of 13 November 2025 phases commencement of the Digital Personal Data Protection Act, 2023; the notified Digital Personal Data Protection Rules, 2025 also have staggered commencement dates. As of 7 October 2026, the one-year and eighteen-month commencement dates measured from publication have not all elapsed. Check the current official timeline and any corrigenda before treating a particular processing duty as operative.

The cited Income-tax Rules’ India-accessibility and India-based daily-backup language applies to the specified books and documents covered by that rule. It does not, by itself, establish a blanket India-only hosting rule for every AI prompt, model, application log or other data object.

- Export original records and logs in a usable format, with links between tax conclusions and their evidence.
- Restrict who can create, alter, review and approve records, and bind approval to the version reviewed.
- Apply retention schedules and legal holds, and explain deletion behavior.
- Support the accessibility and backup-location conditions for the specific records covered by the applicable Income-tax Rules.
- Identify agent, model, task and configuration versions where those details are available.
Test whether the exported packet still lets a reviewer reconstruct a decision without access to a live vendor account. A system’s features do not establish that a particular taxpayer’s implementation satisfies the law.
