There is no universal rule in the sources reviewed that requires every AI-generated actor to appear in a film’s end credits. Disclosure duties depend on the work, where it is distributed, and whether a law, collective-bargaining agreement, or contract applies. For a fictional work, an appropriate notice may be one way to tell viewers that content was generated or manipulated; the EU AI Act does not specifically prescribe end credits as the placement. Separately, permission to use a real performer’s likeness or voice is a rights question that a credit cannot fix.

Do AI-generated actors have to be listed in film credits?

Not under a single, general film-credit requirement established by the sources reviewed. A production may have obligations under a law, union agreement, or individual contract, but those obligations are not interchangeable. In particular, an audience-facing disclosure that content was generated or manipulated is not the same thing as naming a performer or production contribution in the credits.

Before deciding what to put on screen, identify the source of any obligation:

  • Statute or regulation: may require a disclosure for a defined type of content, such as a deepfake or an advertisement.
  • Collective-bargaining agreement: may require a producer to notify or bargain with a union about specified uses of synthetic performers or digital replicas.
  • Individual contract or other rights: may govern use of a performer’s recognizable likeness or voice.
  • Voluntary editorial choice: a production can give viewers additional context even when no source reviewed prescribes a particular credit line.

Do not assume that a rule applying to an advertisement also applies to a narrative film, or that a union process creates a public credit requirement. Check the rule that covers the actual production and use.

What does the EU AI Act require for fictional works?

Article 50 of Regulation (EU) 2024/1689 distinguishes obligations for providers of generative AI systems from obligations for people or organizations deploying AI. Providers must ensure that generated synthetic audio, image, video, or text outputs are marked in a machine-readable format and detectable as artificially generated or manipulated. Separately, deployers using AI to generate or manipulate deepfake content must disclose that fact clearly and distinguishably.

For content forming part of an evidently artistic, creative, satirical, fictional, or analogous work or programme, Article 50 limits the deployer’s disclosure obligation: the existence of generated or manipulated content must be disclosed in an appropriate manner that does not hamper the work’s display or enjoyment. The text does not say that the disclosure must appear in end credits. A production should therefore choose a placement suited to the work and its distribution rather than describe credits as the required placement.

The European Commission’s AI Act FAQ discusses film-production environments, including closed-loop uses, and distinguishes production activity from final output in relevant circumstances. That discussion is not a blanket exemption for every filmmaking workflow. Whether a particular use is covered depends on its facts and the applicable implementation guidance. A generative tool used behind the scenes does not, by itself, establish that an audience-facing actor credit is required.

How should you distinguish a synthetic performer from a digital replica?

SAG-AFTRA’s 2026 TV/Theatrical contracts page uses a key distinction: a synthetic resembles a person but is not recognizable as a specific individual; a digital replica resembles a specific person. The difference matters because a recognizable performer’s likeness or voice raises rights and consent questions that do not arise in the same way for a wholly synthetic character.

Use in the work What it means Accurate audience-facing description
Wholly synthetic character A generated performer not recognizable as a particular individual, in SAG-AFTRA’s terminology. Describe the character or performance as synthetic or AI-generated; do not imply that a named human actor performed it.
Digital replica An asset resembling a specific person, such as a performer’s likeness or voice. If authorized and appropriate, identify the use as a digital replication of that performer rather than a new live performance.
AI-altered human performance A person performed, and AI tools altered, extended, or otherwise modified that performance. Credit the performer’s actual contribution and describe the alteration accurately; do not label the entire performance wholly AI-generated.

These are practical wording recommendations based on the categories in union materials, not an official universal credit taxonomy. SAG-AFTRA’s 2023 contract FAQ also distinguishes wholly synthetic performers from replicas based on actual performers and describes notice and bargaining requirements; use the agreement that applies to the production rather than assuming that terminology alone determines the process.

How do you disclose an AI actor in a movie or video?

Choose a clear, proportionate notice that tells viewers what was generated or manipulated and does not overstate a person’s involvement. Depending on the format and applicable rule, a notice might appear in the work, in a production note, or in the end credits. For an evidently fictional work in the EU, the placement should be appropriate and should not hamper display or enjoyment. None of these placements is established by the sources reviewed as a universal legal requirement for every AI performer.

  • Wholly synthetic character: “The character [name] is an AI-generated synthetic performer.”
  • Authorized digital replica: “The film uses an authorized digital replica of [performer] for [specified scene or material].”
  • AI-altered performance: “[Performer] performed the role; AI tools were used to alter or extend [specified element].”

Be specific about the work that was generated or changed. Avoid wording that suggests a person performed material they did not perform, or that conceals a material use of a recognizable person’s likeness behind a vague “AI-assisted” label. If a separate machine-readable mark is required, an on-screen sentence or an end-credit entry is not a substitute for that mark.

Does a credit give you permission to use a performer’s likeness?

No. Audience transparency and authorization are separate checks. California’s AB 2602 addresses contractual terms and professional representation when a contract authorizes a digital replica of a living performer. AB 1836 concerns commercial use of deceased performers’ replicas, including in film and television. SAG-AFTRA’s March 20, 2026 statement about Val Kilmer’s digital replication says that, under the applicable agreement and state law, estate consent is required to use a deceased performer’s digital replica in a motion picture. Other applicable rights and agreements may also matter.

That means an accurate credit does not cure missing consent, an inadequate contract, or failure to follow an applicable union process. Resolve authorization and contractual requirements before using a recognizable person’s replica, then decide what disclosure viewers should receive.

Do advertising rules apply to every film or online video?

No. The advertising sources in the materials reviewed describe narrower rules, not a general credit standard for narrative films or all online video. California SB 1050, signed September 16, 2026, requires explicit disclosure in audio or video advertisements using AI-generated performers to sell a product or service, according to the Governor’s signing announcement. SAG-AFTRA reports that New York’s synthetic-performer advertising law took effect in June 2026.

Do not extend those summaries to a film, a non-advertising online video, or a different kind of promotional material without checking the operative law. The California material cited here is the Governor’s announcement rather than the full chaptered statute, and the New York information is SAG-AFTRA’s summary. For a compliance decision, confirm the current statutory text, definitions, effective dates, geographic reach, exceptions, and enforcement provisions.

What should a production check before release?

  1. Classify the use. Decide whether the work features a wholly synthetic character, a recognizable person’s digital replica, an AI-altered human performance, or a combination. Do not treat these as synonymous.
  2. Check audience-disclosure rules. Identify the jurisdictions and content type involved, including whether the work is fictional, a deepfake, or an advertisement. Confirm whether a disclosure or machine-readable mark applies and what placement is permitted or required.
  3. Clear performer rights. If a recognizable person’s likeness or voice is involved, verify the required authorization and contractual steps. For a deceased performer, check applicable estate-consent requirements as well as other rights.
  4. Check union and contract terms. Determine whether the production is covered by a collective-bargaining agreement and whether notice, bargaining, consent, or another process applies. SAG-AFTRA’s 2026 TV/Theatrical contracts page says producers may not use synthetics without first bargaining with the union; that is an agreement obligation for covered productions, not a general public-facing credit rule.
  5. Write and place the notice accurately. Say what was generated, replicated, or altered; avoid implying a human performance that did not occur. Choose a place viewers can reasonably encounter while respecting any applicable requirement and, for an artistic or fictional work under the EU provision, avoiding interference with display or enjoyment.

Because legal requirements can vary by jurisdiction, agreement, and use, production teams making a specific compliance decision should consult the operative law and contract documents rather than rely on a generic credit formula.
