EU airline passenger rules and travel insurance protect you in different ways: the rules can require an airline to provide reimbursement or rerouting, care, and sometimes fixed compensation, while insurance pays eligible losses under a specific policy. You may have a claim under both, but neither replaces the other—and payment depends on the applicable rules, your policy, and the facts of the trip.
Start with who is responsible and what triggered the problem
For a flight disruption, the airline may owe rights under passenger rules. An insurer may separately cover a loss if it falls within the policy. A package holiday can also involve obligations from the organiser. These are separate routes, with different triggers, remedies, limits, and claim procedures.
| Protection | Who may owe it | Typical remedy | What determines eligibility |
|---|---|---|---|
| Air-passenger rules | Operating airline | Reimbursement or rerouting, assistance, and in some cases fixed compensation | Route, operating carrier, disruption, notice and delay circumstances |
| Travel insurance | Insurer | Payment of eligible costs or losses, subject to limits and excess | Policy wording, insured event, declarations, exclusions, and claim evidence |
| Package-travel rights | Package organiser | Remedies under package-travel rules | Whether the booking qualifies as a package and the circumstances |
Package-holiday rights are independent of cancellation-insurance rights, and not every flight booking is a package. See the European Commission’s package-travel guidance.
Check whether EU air-passenger rules apply to your flight
Under the European Commission’s Your Europe air-passenger guidance, the rules apply to flights within the EU operated by EU or non-EU airlines; flights departing the EU for a non-EU country operated by either; and flights arriving in the EU from outside when operated by an EU airline. The guidance says the rules also extend to Iceland, Norway, and Switzerland, and notes a caveat where a traveller has already received benefits under relevant non-EU law. Route and operating carrier matter; citizenship alone does not determine eligibility.

What the airline may owe for cancellation or delay
Cancellation
For a cancellation, passengers generally choose between reimbursement of the ticket, rerouting at the earliest opportunity, or rerouting later at a convenient date, subject to comparable conditions and seat availability. Assistance at the airport may also be due. If the airline gave less than 14 days’ notice, compensation may apply; the airline can avoid that compensation if it proves qualifying extraordinary circumstances that could not have been avoided even with reasonable measures.

Arrival delay
An arrival at the final destination at least three hours late may qualify for compensation, subject to exceptions including extraordinary circumstances. Care during a departure delay depends on the delay’s duration and flight distance. If departure is delayed at least five hours, the rules described by Your Europe provide for reimbursement and a return flight.

Compensation bands are not insurance limits
The European Commission’s Your Europe guidance, accessed in 2026, lists these statutory compensation bands. They are not amounts promised by a travel-insurance policy, and eligibility conditions and permitted reductions apply.
| Flight distance | Compensation band in Commission guidance |
|---|---|
| 1,500 km or less | €250 |
| Over 1,500 km within the EU, or other flights between 1,500 and 3,500 km | €400 |
| Over 3,500 km | €600 |
What happens when baggage is lost, damaged, or delayed
The Commission says airlines are liable for checked baggage that is lost, damaged, or delayed, up to approximately €1,300. This is a liability ceiling, not an automatic payout; the amount recoverable depends on the applicable rules, evidence, and circumstances. A passenger may arrange a higher airline liability limit in advance for a fee, no later than check-in. For expensive belongings, the Commission advises considering private insurance if the airline’s limit would not be sufficient.

Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What travel insurance can add
Insurance can address risks that airline passenger rules do not generally insure as a broad package, such as emergency medical costs or cancellation for a covered non-airline reason. Whether any particular loss is covered depends on the contract. Do not rely on a comparison-site headline or a label such as “comprehensive”: check the policy schedule and full wording.
- Medical treatment and emergency transport: check hospital and other treatment expenses, ambulance cover, evacuation, and repatriation or return travel if you cannot use your original ticket.
- Health declarations: verify how the policy treats pre-existing conditions, symptoms or conditions under investigation, declarations, acceptance terms, and exclusions.
- Cancellation and curtailment: identify covered causes, the maximum insured trip cost, when cover begins, and exclusions.
- Baggage and valuables: compare the total baggage limit, per-item caps, evidence requirements, and any requirement to declare valuables. An insurer’s limit and an airline’s baggage liability are different protections.
- Trip fit: confirm destination and transit-country coverage, trip duration, annual-policy trip limits, age rules, residency eligibility, and cover for planned activities or sports.
- Costs and claim process: check the excess per person or claim, whether it applies separately to different sections, the 24-hour assistance service, and whether treatment or other costs need prior approval.
- Exclusions: review provisions on alcohol or drugs, travel against official advice, known events, and other circumstances relevant to your trip.
The UK Foreign, Commonwealth & Development Office advises UK travellers to check intended destinations, including transit, trip length, emergency care, evacuation and repatriation, existing physical or mental health conditions, and planned activities. It also says EHIC/GHIC cards are not a substitute for travel insurance: they do not cover private healthcare, repatriation, or additional costs such as mountain rescue. This is UK government guidance, not EU legislation or advice tailored to every reader’s jurisdiction; use the terms and rules relevant to your policy and residence.
EIOPA’s 2019 thematic review reported that around 70% of its respondents excluded pre-existing medical conditions from the cover offered. That is a finding about respondents to that review, not a current estimate for every insurer or country; exceptions and limited emergency cover varied. EIOPA said: “When it comes to travelling with pre-existing medical conditions, it is very important that consumers are aware of the coverage they have and understand the limits of their travel insurance policy.”
How to make a claim without confusing the two routes
- Record the disruption: keep the flight number, scheduled and actual arrival times, airline notices, and communications.
- Contact the operating airline: make the relevant passenger-rights claim and keep receipts for reasonable expenses. If the response is unsatisfactory, Your Europe lists national enforcement bodies and other available dispute-resolution routes.
- For baggage, act within the written deadlines: retain the property irregularity report, purchase evidence, and airline correspondence, and use the airline’s required process.
- Notify the insurer separately: follow the policy’s notice deadline, ask which documents it requires, and obtain any required approval before arranging treatment or incurring costs where possible.
- Check coordination terms: tell the insurer about relevant airline payments or claims and follow the policy’s rules. Do not assume that making two claims means you can recover the same loss twice.
Claims depend on the itinerary, event, applicable exceptions, policy wording, and evidence; neither an airline nor an insurer outcome can be guaranteed in advance.
Which rules are currently in force?
As of 4 October 2026, the European Commission said revised air-passenger rules adopted in July 2026 were expected to enter into force the following summer; the Council reported final clearance on 13 July 2026. The Commission’s 28 July 2026 article said: “Until then, you can continue to benefit from the existing EU rules.” It described expected changes including clearer baggage-allowance information, faster claims, better rerouting and support for cancellations or significant delays, and improved connecting-journey protections. These are future changes, not protections to assume are already in force. Check the Commission’s revision update for the effective date and implementation details before relying on them.
