To determine whether a medical device is affected by U.S. import tariffs, identify its exact Harmonized Tariff Schedule of the United States (HTSUS) classification, legally relevant country of origin, and expected entry date. Check that classification in the current HTSUS, then look for additional measures such as Section 301 duties, Chapter 99 provisions, and any applicable trade-agreement preference. A device-specific rate cannot be determined from the words “medical device” alone.
If you do not know the correct HTSUS subheading, ask the supplier, importer of record, customs broker, or trade attorney for a classification review before relying on a tariff estimate.
Why “medical device” is not a tariff classification
U.S. customs treatment is based on the product’s tariff description and facts, not simply on whether a regulator or manufacturer calls it a medical device. Function, design, materials, components, intended use, and whether the item arrives alone or as part of a set can affect classification. The same broad medical purpose can cover products that fall under different tariff provisions.

Because no device model, proposed HTSUS code, origin, importer, or entry date was supplied for this guide, it cannot state a rate for any particular product. The workflow below shows how to obtain a product-specific answer.
Information to collect before checking a tariff
Assemble a fact sheet that a broker or classification specialist can use. Include:
- The device’s commercial name, model, and a plain-language description of what it does.
- Its principal function and intended medical or non-medical use.
- Construction materials, technical characteristics, dimensions, and operating method.
- Major components and whether the shipment contains accessories, replacement parts, software, or a complete system.
- Whether the item is imported as an individual product, an unassembled product, or a set with other goods.
- Technical literature, product drawings, user manuals, photographs, and regulatory descriptions that explain how it works.
- Every manufacturing location involved in making the finished product and its major components.
- The expected U.S. port or mode of entry and the anticipated entry date.
- The proposed HTSUS subheading supplied by the manufacturer, distributor, or customs broker, if one exists.
Do not assume that an FDA device category, registration, or product code automatically determines the customs classification. The tariff lookup is keyed to tariff nomenclature and merchandise facts.

Outbyte Driver Updater FREEFix the driver behind crashes, sound loss and screen glitchesFind Drivers →Outbyte PC Repair FREEClear out junk files and repair common Windows errorsFree Scan →Step 1: Obtain and verify the HTSUS classification
Start with the proposed code
Ask the supplier, distributor, importer’s broker, or internal trade-compliance team for the proposed HTSUS subheading. U.S. Trade Representative guidance says that a user who does not know the relevant subheading should contact a supplier, distributor, or customs broker. A Section 301 lookup generally requires an eight-digit subheading, while entries can use a more detailed ten-digit statistical number.
Understand the eight- and ten-digit levels
The eight-digit subheading is the level used to identify products in Section 301 action lists. The ten-digit number adds the statistical reporting suffix used for entry reporting. Do not truncate a ten-digit classification casually or assume that two products sharing a heading have the same treatment. Confirm the complete number in the current schedule and retain both the eight-digit subheading used for additional-duty searches and the full ten-digit number reported for the shipment.
Check the current HTSUS
Verify the proposed code in the live HTSUS published by the U.S. International Trade Commission (USITC). The HTSUS contains the tariff rates and statistical categories for imported merchandise. Search the full description, chapter and heading notes, unit of quantity, general rate, and any special rate that could apply to the product’s origin.
Search results identified a 2026 HTSUS Revision 21. That reference is a dated revision, not a permanent answer. Use the schedule in effect for the planned entry and check for later revisions before filing. A code that appears to match a product description does not, by itself, resolve additional duties or origin eligibility.

Resolve classification uncertainty before importing
If two headings appear plausible, document why one describes the device more specifically. Give the broker the technical fact sheet rather than asking for a classification based only on a marketing name. For a high-value, recurring, or disputed import, request a product-specific customs review before the shipment is entered.
Step 2: Read the ordinary tariff treatment
Once the classification is confirmed, record the HTSUS line’s general and special rates and read the associated notes. The general rate is the ordinary tariff treatment; a special rate may apply when an origin qualifies for a trade agreement or another preference. Keep the exact code and the schedule revision in your import file so a later reviewer can reproduce the lookup.

Do not stop after finding a base rate. Additional measures can be imposed through provisions outside the ordinary tariff line, and a tariff schedule revision can alter the treatment between shipments.
Step 3: Check Section 301 and other additional duties
Use the USTR product lookup
Search the U.S. Trade Representative’s Section 301 product lookup with the relevant eight-digit HTSUS subheading. Review the action list, modification history, and additional rate shown for that subheading. USTR states: “Every product subject to the Section 301 actions is identified by an 8-digit or 10-digit HTS Subheading.”
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsThe lookup answers the Section 301 question only. It is not a determination of every duty that may apply to an entry. Record the action and modification dates and compare them with the planned entry date.
Review Chapter 99 provisions
Check the current HTSUS Chapter 99 provisions and any other official measures that apply to the product’s origin and entry date. Chapter 99 provisions can operate alongside a medical-device classification. A U.S. Customs and Border Protection ruling, N348360, illustrates this kind of combination for an orthopedic device classified under HTSUS 9021.10.0090.
That ruling is a fact-specific example, not a classification precedent for other devices. Do not copy its code, Chapter 99 provision, rate, or dates to a different product unless the facts and legal provisions genuinely match.
Check whether an exclusion is effective
If a Section 301 or other additional-duty exclusion appears relevant, verify all of the following:

- The exact HTSUS classification is included.
- The product description and technical facts fit the exclusion’s scope.
- The country of origin and entry date satisfy the stated conditions.
- The importer can claim it correctly in the entry documentation.
USTR provides links to exclusion information, but the existence of an exclusions page does not establish that a particular medical device currently has an available exclusion.
Step 4: Determine the legally relevant country of origin
Origin must be analyzed from the manufacturing record, not merely the ship-from address. Gather where the device is assembled, where substantial manufacturing occurs, and how imported components are transformed. A change in manufacturing location can change the applicable tariff treatment even when the product model is unchanged.
Give the origin analysis to the same broker or trade specialist reviewing classification. Keep supporting production records with the entry file, especially when more than one country contributes components or manufacturing operations.

Step 5: Check an FTA preference without treating it as the whole answer
The U.S. Department of Commerce FTA Tariff Tool can show negotiated preferential rates and rules of origin for covered U.S. free-trade-agreement partners. Enter the partner country and the relevant HS code, then read the preference conditions and origin rules.
Recommended Free Tools
The tool has important limits. It displays negotiated FTA preferences, not every U.S. tariff measure. Its disclaimer warns: “However, the actual tariff classification, assessment, and update to the nomenclature is up to the customs authorities in the United States or the FTA partner countries.” Schedules can also contain nomenclature that has not been updated since an agreement was negotiated.
Therefore, an FTA result is one part of the check. Confirm the current HTSUS classification, origin qualification, Chapter 99 treatment, Section 301 status, and entry-date rules separately.
How the main tariff-checking sources differ
| Source | Primary scope | Typical input | What it does not settle |
|---|---|---|---|
| USITC HTSUS | Ordinary tariff rates and statistical classifications | HTSUS code and product facts | It does not, by itself, resolve every additional-duty action or product-specific classification dispute. |
| USTR Section 301 lookup | Section 301 actions, modifications, and additional rates | Relevant eight-digit HTSUS subheading | It is not a complete determination of all tariffs on an entry. |
| Commerce FTA Tariff Tool | Preferential rates and origin rules under covered U.S. FTAs | FTA partner and HS code | It does not cover every tariff measure; customs authorities control classification, assessment, and nomenclature updates. |
| CBP ruling database | How CBP treated a particular fact pattern | Comparable product facts or a ruling number | A ruling’s code and rates should not be generalized to a different device without matching facts. |
A repeatable tariff-checking workflow
- Describe the merchandise. Complete the technical fact sheet, including function, materials, components, intended use, set configuration, and manufacturing locations.
- Obtain a proposed HTSUS code. Ask the supplier, distributor, or customs broker for the eight- or ten-digit subheading they would report.
- Validate the code in the current HTSUS. Read the heading and chapter notes, confirm the statistical suffix, and record the revision used.
- Record ordinary rates. Capture the general and applicable special rates and any relevant schedule notes.
- Run the Section 301 check. Search the eight-digit subheading in USTR’s lookup and record the action, modification, additional rate, and effective dates.
- Inspect Chapter 99 and other measures. Review provisions that could apply to the product’s origin and planned entry date.
- Analyze origin and preferences. Determine origin from manufacturing facts, then use the FTA tool only if a covered agreement may apply.
- Test exclusions or exceptions. Match the exact classification, product description, origin, and entry date to the currently effective text.
- Have the result reviewed. Ask a customs broker or trade attorney to check the complete entry facts when classification, origin, exclusions, or financial exposure is uncertain.
How to compare a preliminary tariff result
When reviewing a worksheet or broker quote, separate the result into identifiable parts instead of recording one unexplained percentage. First list the ordinary HTSUS general rate and any special rate considered. Then list each additional measure separately, including its legal provision, product scope, origin condition, effective date, and any exclusion. This format makes it possible to see whether a later change affects the base classification, an additional duty, or a preference.
Check that the code used in each source is at the same level. USTR’s Section 301 search uses an eight-digit subheading, while the entry may require a ten-digit statistical number. An FTA tool may display nomenclature from the agreement’s negotiated schedule rather than the newest U.S. statistical suffix. Resolve any mismatch with the broker rather than assuming the tools are interchangeable.
For recurring imports, save a dated copy or printout of each lookup, the schedule revision, and the entry date used for the decision. Reperform the check when a model changes, production moves, a new modification appears, an exclusion expires, or an entry is delayed into a different tariff period.
What can change the duty exposure between two shipments?
A shipment of the same model can receive different treatment if the manufacturing origin changes, the HTSUS is revised, a Section 301 action is modified, an exclusion reaches its end date, or the entry occurs in a different period. The shipping route alone does not establish a new origin, and a new warehouse or port does not substitute for the manufacturing analysis.
Likewise, a kit or set can require a different classification analysis from the same device imported alone. Adding accessories, replacement parts, software, or an unassembled component can change the facts presented to customs. Update the fact sheet whenever the contents or configuration changes, not only when the model number changes.

Relying on the shipping country
The dispatch location may not be the legal country of origin. Obtain the manufacturing history and document the origin analysis.
Checking only the first HTSUS result
A matching base line can coexist with Section 301 duties, Chapter 99 provisions, or another measure. Perform the additional-duty checks separately.
Using an old schedule or old web result
Tariff lines and measures change. Recheck the live HTSUS, USTR actions, exclusions, and entry-date provisions immediately before filing.
Copying a CBP ruling to another product
CBP rulings depend on the facts presented. The N348360 orthopedic-device example demonstrates a method of analysis, not an automatic answer for another device.
Treating an FTA tool as an official classification decision
The Commerce tool is useful for negotiated preferences and origin rules, but its disclaimer places actual classification and assessment with customs authorities.
Confusing a lookup result with an assessed duty
A web result is a reference point, not a product-specific customs determination. The final assessment depends on the reported classification, origin, entry facts, and measures effective at that time. Keep the supporting analysis so an importer can explain how the reported code and claimed treatment were selected.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Historical context: why older tariff news can mislead
A 2024 USTR notice discussed proposed Section 301 modifications covering 382 HTSUS subheadings and five statistical reporting numbers, representing approximately $18 billion in annual trade value in 2023. Those figures describe the scope and value of the proposed product lines in that notice, not medical-device imports alone and not a current tariff rate.
The same notice named facemasks, medical gloves, syringes, and needles among categories on which comments were sought. These are examples from a historical action and do not prove that every device, or every product in one of those categories, has a particular rate today. Use current action lists and the entry-date rules instead of relying on historical headlines.

- The supplier and importer propose different HTSUS classifications.
- The device combines instruments, electronics, software, accessories, or replacement parts.
- Manufacturing spans multiple countries or origin is disputed.
- A Section 301 action, Chapter 99 provision, exclusion, or FTA preference could materially change the duty outcome.
- The shipment is high value, recurring, subject to a tight delivery schedule, or likely to be audited.
- The importer needs a defensible classification record rather than an informal web lookup.
Using a broker is not a universal legal requirement for every importer, but professional review is prudent when the facts or financial exposure are significant. Provide the reviewer with the technical literature, manufacturing flow, proposed code, origin evidence, planned entry date, and every tariff lookup already completed. That lets the professional test the assumptions instead of starting with an incomplete product name.
What to retain in the import file
For each device model, retain the fact sheet, proposed and final HTSUS codes, schedule revision, ordinary and additional-duty findings, origin analysis, FTA documentation if used, exclusion text and effective dates, broker correspondence, and any CBP ruling relied upon for comparison. Update the file when the model, manufacturing location, tariff schedule, or additional-duty action changes.
This record does not replace customs advice, but it makes the decision traceable and helps prevent an old classification or expired exclusion from being reused.
Frequently Asked Questions
Can I determine the tariff from the fact that a product is an FDA-registered medical device?
No. FDA status does not itself determine the HTSUS classification. Customs treatment depends on the device’s function, design, materials, components, intended use, configuration, origin, and entry date.
What should I do if I do not know the HTSUS code?
Ask the supplier, distributor, importer’s customs broker, or a trade-compliance professional for the proposed subheading, then verify it in the current HTSUS. USTR specifically directs users without a subheading to consult a supplier, distributor, or customs broker.
Is the country printed on the shipping label the country of origin?
Not necessarily. Determine origin from where the device is assembled and substantially manufactured, including relevant component and transformation facts. The ship-from location alone is not enough.
Is the ordinary HTSUS rate the full tariff?
Not always. Check Section 301 actions, Chapter 99 provisions, other official measures, exclusions, and any qualifying preference separately for the product’s origin and entry date.

No. It is designed for negotiated FTA preferential rates and origin rules. Its disclaimer says customs authorities control actual classification, assessment, and nomenclature updates, and the tool does not cover every tariff measure.
Can I use the CBP N348360 orthopedic-device ruling for another device?
Only as an example of how a particular fact pattern was treated. Its classification, Chapter 99 provision, rates, and dates should not be copied unless the other product has genuinely matching facts and current legal treatment.
How often should a tariff determination be rechecked?
Recheck it for each planned entry period and whenever the model, set contents, manufacturing location, HTSUS revision, Section 301 action, exclusion, or trade preference changes. Record the schedule revision and effective dates used.
Does a historical announcement about facemasks, gloves, syringes, or needles prove my device has that rate?
No. The 2024 USTR notice was historical and described proposed product-line changes. It does not establish a current rate for every device or every product in those categories.
