There is no universal rule that makes a game ROM download legal just because you own the cartridge or use an emulator. Check the law where you are, whether the rights holder authorized that specific file and source, and whether you are downloading someone else’s copy, making your own archival copy, or sharing a file. Those are different acts, and an exception for one may not cover the others.

Start by identifying the download and the country

Before looking for an exception, write down the facts that determine which rules may apply:

  • Country: Identify the country relevant to your download and use. Copyright rules and exceptions differ by jurisdiction.
  • Game and platform: Record the exact title and system, and identify the publisher or other rights holder if possible.
  • Source: Note the website, store, service, or person supplying the file, and whether the rights holder explicitly authorized that release.
  • What you plan to do: Distinguish downloading a copy distributed by someone else from making an archival copy of a copy you lawfully own, and from uploading or sharing a file.
  • Copy protection: Check whether obtaining or using the file would require bypassing a technical protection measure.

Owning a cartridge or disc is not, by itself, a complete answer about the legality of a separate internet download. WIPO-hosted legal analysis describes making a ROM as wholesale duplication and says that, in most jurisdictions, it would be clear-cut infringement without authorization from the rights holder. That is a broad analysis, not a survey of every country or game.

Check official local copyright sources

  1. Find the government source for your country. Look for the national copyright office, government intellectual-property authority, or current copyright statute. Confirm that the source applies to your country and is current.
  2. Search for the rules that match your intended act. Check provisions or guidance on copying computer programs or game software, private or archival copies, distribution, and anti-circumvention. Do not assume that a general reference to “personal use” covers game software or a download from an unauthorized source.
  3. Read the conditions, not just the label. If an exception appears relevant, check what it says about lawful ownership or acquisition, the source of the copy, transfer or destruction of copies, access to online services, commercial use, and circumvention.
  4. Check the rights holder’s own release information. Prefer an official store, publisher page, or explicit license that identifies the release as authorized. A file-hosting page or peer-to-peer listing does not show that the rights holder approved the copy.
  5. Get local legal advice if the sources conflict or the consequences matter. General guidance cannot determine the status of every title, file, and set of circumstances.

Separate a third-party download from an archival copy

Downloading a file supplied by someone else

Check both the applicable law and whether the rights holder authorized that source. A game being old, unavailable in stores, or offered for free on a third-party site does not establish permission to copy it. Nintendo’s official UK guidance warns that peer-to-peer offers and third-party file links for Nintendo games can be unauthorized copies; treat this as a warning about the source, not as a substitute for checking local law.

Making a personal archival copy

An archival-copy exception, where one exists, may have specific requirements and may not cover downloading a copy uploaded by another person. In the United States, the U.S. Copyright Office describes a limited archival-copy privilege for computer programs: it is conditioned on lawful ownership, and the archival copy must be destroyed or transferred with the original when the original is transferred. This U.S.-specific guidance does not authorize public distribution of backup copies and should not be treated as a rule for other countries.

Uploading or sharing a ROM

Sharing is a separate act from keeping a copy for yourself. Do not assume that a personal-copy exception permits uploading, distributing, or otherwise making the file available to others. Check the local rule for distribution as well as any rule that may apply to making the copy.

Check emulation and copy-protection rules separately

An emulator and a game ROM are separate legal questions. Emulator software does not, by itself, grant permission to acquire or use copyrighted game files. Check the status of the file and its source independently from the status of the emulator.

Also check whether your intended method involves circumventing copy protection. U.S. regulations include narrow, conditional game-related anti-circumvention exemptions, including situations involving lawful acquisition, ceased server access, or preservation by eligible institutions. These exemptions are not a general permission to download ROMs, and they do not establish what is permitted in another country.

Use rights-holder statements carefully

A rights holder’s statement can clarify its position on its own games, but it is not a universal statement of the law. Nintendo Australia, for example, says: “It is illegal to download a Nintendo ROM from the internet whether or not you own an authentic copy of that game.” Attribute that statement to Nintendo Australia and to Nintendo games; do not extend it to every publisher, country, or kind of copy.

For a specific game, look for an official release or license that covers the file and source you intend to use. If you cannot verify authorization, do not treat the presence of a download link as evidence of permission.
